THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Chapters 60 to 64 inclusive, of the Saint
Paul Legislative Code, pertaining to the Zoning Code, Use Districts,
and Rezoning of certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone the following
described property from "All Residence District to "C" Residence District:
Lots 1 and -2, Block 1, Robert L. Ware's
Eastern Heights Acre Lots, located at the
southwest corner of East Minnehaha Avenue
and McKnight Road.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the
public peace, health, and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage, approval, and publication.

Dear Sir:
This is in the matter of the petition of Sidney Schmuckler to rezone from
ItA't to ITCH Residence , property located on the southwest corner, of East
Minnehaha Avenue and McKnight Road. The property is'described as Lots 1
and 2. Block 1, Robert L. Wares Eastern Heights Acre Lots. The zoning is
ItAlt Residence and has been since the adoption of the Ordinance in 1922.
The Commissioner of Finance reports that 85.7% (12 out of 14) of the owners
of land within the prescribed 100 foot radius have signed the petition. In
1955 a petition to reclassify this property for a commercial development
was filed, but was withdrawn before any action was taken by the City Council.
The north 125 feet of the west 50 feet of this tract was formerly developed
with a single family residence which has been removed, and the entire tract
is now vacant except for a billboard. The applicants propose to develop the
site with five 11 -unit 22 storyA veneer apartment buildings with, off - street
parking accessory thereto. The tract has a frontage of 249.31 feet along
East Minnehaha Avenue and 292.44 feet along McKnight Road, resulting in an
area of approximately 723908 square feet, or 1.65 acres.
North and-across Minnehaha avenue are single family residences fronting on
East Minnehaha Avenue; south and adjoining are the rear yards of residences
fronting on Margaret Street; west and adjoining is a single - family residence
which fronts on Minnehaha Avenue; east and across McKnight Road is the
Minnehaha Drive -in Theater which is outside of the city limits; north-
easterly across the intersection is a filling station and auto repair garage,
and a variety store.
Field investigation discloses no basic objection to the reclassification of
this property to t1011 Residence as the property on the northeast corner of
this intersection is presently developed commercially as is the property
across McKnight Road to the east. The applicant's plan indicates that the
recommended standards for density and building ground coverage will be met
generously. This development can serve as a transtional use between the
residences to the west and the commercial activities to the east which is
desirable. Because of the size of the area involved, this rezoning cannot
be considered a Atspot zone ".
In accordance with the above factors, the Board of Zoning recommends the
granting of this petition to rezone the above described property from '.'Alk
Residence to 1tC1% Residence for the development as indicated in the applicantts
plans which were approved August 27, 1959.
