WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a rivo story, wood frame, triplex and its attached, single stall, wood frame garage
located on property hereinafter referred to as the "Subject Property" and commonly lmown as
719 CASE AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before February 15, 2008,
the following are the now lrnown interested or responsible parties for the Subject Property: DJS
Mortgage Capital Inc/Co Select Portfolio Servicing, 3815 S West Temple, Salt Lake City, UT
84115; DJS Mortgage Capitol Inc, 3269 S. Main St, Suite #200, Salt Lake City, UT 84115;
Christina Weber, Wilford & Geske, 7650 Currell Blvd, Suite 300, Woodbury, MN 55125; Edina

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated May 1, 2008; and
WHEREAS, this order inforxned the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHBREAS, this order informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subject Property by June 2, 2008; and
WHEREAS, the enforcement offacer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condifion; subject to demolition; and
WHEREAS, this nuisance condirion has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legisiative Hearing Officer of the Saint Paul
City Council on Tuesday, July 29, 2008 to hear testimony and evidence, and after receiving

testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the struchxre in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
August 20, 2008 and the testimony and evidence inclnding the acrion taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 719 CASE AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislarive Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing ar Building code
violations at the Subject Property.
4. That an Ordex to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies ar to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition haue not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or xesponsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the shucture in accordance with all applicable codes and ordinances. The

fifteen (15) days after the date of the Council Hearing.
2. If the above corrective acrion is not completed within this period of rime Department of
Safety and Inspections 3s hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Pau1 shall remove and dispose of such property as provided by law.
A. It is further ardered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two-story, wood frame, multi-unit dwelling with an attached one-stall garage, on a
lot of 4,792 square feet.
According to our files, it has been a vacant building since September 22, 2005.
The current property owner is Ken Du Fung, per AMANDA and Ramsey county property records.
The Cily of St. Paul has boarded this building to secure it from trespass.
There haue been nine (9) Si_TMNIARY ABATEMENT NOTICES since 2005.
There have been seven (7) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Boarding
On Apri19, 2008, an inspection of the buiiding was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NtJISANCE BUILDING was posted on May 1, 2008 with a compliance date of June 2,
2008. As of this date this property remains in a condition which comprises a nuisance as defined by
the legislarive code.
The Vacant Building registration fees are paid.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

and IegaAy described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under aathority of Chapter 45.11.
On April 09, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Sec6on, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Suilding Tnspection and Design OfFice before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame, triplex and its attached, single stall, wood frame
garage.
A Certificate of Occupanc� inspection was done on September 14, 2006, details or
the deficiencies are as follows:
1. ELECTRICAL - ATTIC - MSFC 6051 - Remove unapproved exposed wiring and
install in accordance with the electrical code. This work may require a permit(s). Ca11 LIEP at
(651) 266-9090. Remove all open wiring or provide approved methods per current electrical
code for the installation of the romex and conduit runs (BX). This is £ound tlu out the
attic.
2. ELECTRTCAL - ATTIC - NEC 300-11 Provide for all raceways, boxes, cabineCS, and
fittings to be securely fastened in place. Secure the loose conduit and junction box behmd the
toilet wall.
3. ELECTRICAL - BASEMENT - MSFC 605.1 - Repair or replace dainaged electrical
fixtures. This work may require a permit(s). Ca11 LIEP at (651) 266-9090. Repair or replace
damaged fixture(s) in basement.
4. ELECTRICAL - BASEMENT - MSFC 605.1 - Remove unapproved exposed wiring and
install in accardance with the electrical code. This work may require a permit(s). Call LIEP at
(651) 266-9090. Remove the greenfield that is hanging from the ceiling with exposed wire or
any other exposed wiring.
5. ELECTRICAL - GENERAL - MSFC 605.6 - Provide all openings in junction boxes to
be sealed.
6. BLECTRICAL - GENBRAL - NEC 410-8 (b) (1) Provide for the incandescent fixtures
in closets to have a completely enclosed lamp.
7. ELECTRICAL - GfiNERAL - SPLC 34.12 (2), 3435 (1) - Repair and maintain all
required and supplied equipment in an operative and safe condition. Power was shut off at time
of inspecfion. Provide power to all electrical equipment, lights, receptacles and switches. Test
all electrical items. Repair or replace as needed when power is turned on.
8. ELECTRICAL - C�ENERAL - MSFC 6051- AllligJit fixhues shall be maintained with
protective globes if originally equipped. Replace through out the building.
9. ELECTRICAL - UNIT 1- NEC 300-11 Provide for all raceways, boxes, cabinets, and
fittings to be securely fastened in place. Secure the romex and junction in box in the far room
off the kitchen.

10. BASEMENT - MSFC 705.1 - Provide a xequired occupancy sepazation with approved
materials and methods. This work may require a pernut(s). Call LfEP at (651) 266-9090.
The minimum raring must be one hour throughout basement.
11. BASEMENT DOdRS - MSFC 703 - Provide, repair or replace the fire xated doar and
assembly. "I'�e minimum rating must be one hour. Repair and maintain the door latch. Repair
and maintain the doar frame. Replacelrepair and maintain the door closer. (UL approved
hydraulic closures required.)
12. ELECTRTCAL - EXTERIOR - NEC 230.50 Protection of Open Conductors and Cables
Against Damage - Above Ground.-Provide approved methods per current electrical code in the
protection of the service cables on the north west corner of the building. This work sha11 be
done be a licensed electrician and may require a permit.
13. ELECTRICAL - EXTERIOR - MSFC 605.1 - Remove unapproved exposed wiring and
install in accordance with the electrical code. This work may xequire a pernut(s). Call LIEP at
(651) 266-909�. Remove the old feeder wire hanging in the conduit.
14. ELECTRICAL - EXTERIOR - SPLC 34_14 (2) f- Provide and maintain an minimum of
1 foot candle at the grade level of exterior exits and entryways for security. This work may
require a permit(s). Call LIBP at (651) 266-9090.
15. ELECTRICAL - GARAGE - MSFC 605.6 - Provide electrical covex plates to all outlets,
switches and junction boxes where missing. Provide a cover on the junction box located in the
south east comer of the building. Remove the receptacle in the junction box.
16. ELECTRICAL - GENERAL - BULLETIN Ol-1 ! BULLETIN 80-1 (Properiy
Maintenance Code).-Provide for all electrical wark be brought up to code per the attached
bulletins. See attached copies.
17. ELECTRICAL - HALLWAY TO BASEMENT - MSFC 605.6 - Provide electrical cover
plates ta a11 outlets, switches and junction boxes where missing. Provide a cover on the junction
box the door to the basement.
18. ENTIRE BUILDII3G - SPLC 34.09 (I) a, 3432 (1) a- Pravide and maintain foundation
elements to adequately support this building at a11 points. &uilding inspector from LIEP to
check on structural components of the building.

free from holes and deterioration. All exterior unprotected surfaces must be painted or
protected from the elements and maintained in a professional manner free from chipped or

6. Ordering the owner to remove or repair the building(s) at 719 Case Avenae within fifteen
(15) days $om adoption of resolution.
The property owner of record, Ken Du Fung, appeared with Leong Hiu who provided translation for
Mr. Du Fung.
Mr. Magner stated the building was a two-story, wood frame, multi-unit dwelling with an attached
one-stall gazage on a lot of 4,792 square feet and had been vacant since September 22, 2005. A
team inspection had been done on September 26, 2006, the vacant building registration fees were
current, and the $5,000 performance bond was posted on July 25, 2008. On Apri19, 2008, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on May 1, 2008 with a
compliance date of June 2, 2008. To date, the property remained in a condition which comprised a
nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value
of the land to be approximately $34,300 and the building to be $166,400. Real estate taxes were
current. Code Enforcement estimates the cost to repair the building to be approximately $70,000 to
$80,000. The cost for demolition was estimated to be approximately $14,190 to $18,190. There
had also been trine suuunary abatements issued to this property since 2005, seven of which went to
work order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse, cut tall grass and weeds, and boazding. Mr. Magner stated that
the new owner planned to rehab the property and had already pulled a building permit. Code
Enforcement recommends the building be repaired or removed within 15 days. He presented
photographs of the property.
Ms. Moermond asked about the summary abatement orders and how many had been issued since
the new owner had taken possession of the property. Mr. Magner stated there was a work order the
beginning of May to clean up the yard which was done by the City; another work order was done in
mid-May to board the building, and there was an order to cut the grass in early June which was
done by the owner. He believed Mr. Du Fung did not purchase the property until later in May.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1889, was a very substantial-sized house, and was a Victorian-era building. She believed the
dQUb1e front porch had been an addirion that had been added to the house likely at the time the
house became a dupiex. She also noted that there had been some exterior alterations to the building.
This property had not been sutveyed and there was one house in close proximity to this property
that had been surveyed and was listed as a site of significance. This was also located within one
block of the Payne Avenue potential historical district and she encouraged rehab of the building.
Mr. Magner stated that under the current zoning of the property, he did not believe it could be used
as a tk�ree-plex due to the size of the lot. He was unsure if zoning would allow it be de-converted to
a duplex. The neighbors had previously expressed concern over the hi�-density use of this
building and the density of the sunounding neighborhood. The neighbors were also particularly
frustrated wiflrthe behavioral issues of the tenants and the poor management by the owners.
Ms. Moermond asked whether the rehab of the building had begun. Mr. Hiu responded that rehab
had not commenced as they had just pulled the building permit. Ms. Moermond stated that she had
concern with the building being three units and suggested it needed to be a single-family dwelling
or a duplex particularly since this was on such a small lot.

Mr. Magner stated that in reviewing the file from the team inspecrion done on September 26, 2006,
it noted that the plumbing, heating and electrical inspection reports had not been included. He
believed that a new code compliance inspection would need to be done and should be done as either
a single-family dwelling or a duplex.
Ms. Moermond asked whether they had considered de-converting the building to a single-family
dwelling. Mr. Hiu responded that they thought a duplex would be best. Pvlr. Magner stated that
when a property is being rehabbed, it was his recommendation that it become a conforming use.
The conforming use at it exists would be a singl�family dwelling since it was on a sub-5,000
square foot lot. Currently, a hi-piex would require a 7,500 square foot lot which he would consider
over-use of the land. Addirionally, he believed there would be cost savings in rehabbing the
building to a single-family as opposed to a duplex. He said that he wanted to see this property
become an asset to the neighborhood as he did not want to have this property come back for future
hearings.
Ms. Moermond asked whether the owner planned to live at the property. Mr. Hiu responded that
Mr. Du Fung planned to use the property as an inveshnent property.
Ms. Moermond told him that she knew the City Council would want this property to be a single-
family home particulazly given the history of complaints at the property. She suggested they
develop plans to rehab the property as a single-family home as well as a duplex. She was aware
that Section 8 Public Housing continuously was looking for housing for large families. She
suggested he investigate this option and rehabbing the house as a single-family dwelling. Ms.
Moermond explained that the City Council had voted to have this building demolished in 2006
because they wanted the building to be converted to a single-fasnily house. The owners of the
property then appealed the decision to the courts.
Ms. Moermond stated that she will recommend continuing the hearing to August 26 to allow time to
obtain a new code compliance inspectian done as a single-family residence and a duplex; complete
a work plan done in accordance with the code compliance inspection report; and provide financial
documentation indicating the amount of funds necessary to complete the repairs.

Siu Lui Fung, property owner, appeared with Leong Hiu who provided translation.
Ms. Moermond requested staff report.
Mr. Magner stated that this was a laid over from July 29, 2008. At that rime, the owner, Ken Du
Fung, was present along with Mr. Hiu and indicated they had just acquired the property and planned
to rehab it. At that time, the concern was to reduce the occupancy. The unit was a 3-plex which
was non-conforming use and the owner was going to investigate further whether they were going to
de-convert this into a single family or to a duplex. They were to submit a work plan, financial plan
and get a code compliance for both a single-family dwelling ar a duplex.
Mr. Hiu stated they had applied for duplex code compliance inspection. He also stated that Mr.
Fung will be doing the work himself.
Ms, Moermond asked whether Chis would be an owner-occupy duplex and whether they planned to
move into the house. Mr. Hiu responded that they could consider it, however, they own about four
or five other properties in Saint Paul and they also own several houses in San Francisco.
Ms. Moermond asked for a report from Ms. Barr. Ms. Barr stated the property was built in 18$9
and was a Victoria-era double house. It was located just outside of the potential Payne District.
There is only one empty lot on the block and it was a good candidate for affordable housing.
Ms. Moermond asked if a work plan had been done. Mr. Hiu responded that the City had not called
them yet to schedule the inspection. Mr. Magner stated that they were waiting on the Code
Compliance from Mr. Seeger. They had applied for it at the end of July and as of today; it still had
not been completed. He recommended that this matter be laid over until the code compliance was
completed.
Ms. Moermond recommended continuing the hearing to Legislative Hearing on September 9 far a
wark p1an and financialletter and continuing the City Council Public Hearing to September 17.
Ms. Moermond noted on the record a memo from Mai Vang that the neighbor, James Cusick, of
732 Jenks Avenue called and stated that he is opposing the rehab of this property because it has
always been an eyesore. There had been many problems with the property and he wouid like to see
the building come down.

Property owner, Ken Du Fung and family friend, Leong Hiu, appeared.
Ms. Moermand stated that work orders and financial plans were needed from the property owner,
and had not yet been submitted.
Mr. Magner stated that there was an old code compliance report for the property and that an
application for a new code compliance inspection had been submitted on July 31, 2008, but Mr.
Seeger had been unable to contact Mr. Fung to schedule the inspection. Mr. Magner called Mr.
Seeger and an inspection appointment was made for September 10 at 11:00 am.
Ms. Moermond stated that she received a letter from the Bank of America stating that there was
$66,000 in the account associated with the property. She asked Mr. Fung to provide a letter
stating that he intended to dedicate the full amount to the rehabilitation of this property.
Ms. Moermond stated that the property had been a significant problem in the neighborhood and
that converting the house from a three-unit to a duplex ar single-family home would help. Other
critical improvements would be providing adequate parking (ideally off-street), nice landscaping
and consistency in managemenVownership. She said that the lease should include tenant-
screening and eviction provisions.
Mr. Magner said that on September 4, an inspector found bags of bottles and cans outside of the
house and that a summary abatement order had been issued with a compliance date of September
11. Mr. Hiu stated that the property had been cleaned.
Ms. Moermond stated that it was unfortunate that Mr. Fung had not been made aware at the time
he purchased the property that the property was slated for demolition. She said she would like to
see the property rehabbed and felt that Mr. Fung and Mr. Hiu should be able to accomplish this.
Ms. Moermond stated that she would recommend to the City Council that the hearing on this
properiy be conrinued from September 10 to October 15. She asked that Mr. Fung to submit a
work plan by the end of the business on October 6.
Mr. Fung stated that he has a second property at 1014 Euclid and had a meeting scheduled there
at 10:00 am on September 10. Mr Magner responded that 1014 Euclid was a Category 2 Vacant
Building and that a code compliance had not been applied for. His records did not indicate that a
meeting had been scheduled for that property.
Ms. Moermond stated that since the Euclid property was also a registered vacant building with
code violarions, a code compliance inspection would have to be applied for.
