The hearing was called to order at 1:30 p.m.
Staff Present: Frank Berg, Deparhnent of Safety and Inspection (DSI) - Licensing; Greg Reese,

Appeal of GMT Corporation (I,owertown Ramp) to a Certificate of Occupancy Revocation
for property at 255 Sixth Street East.
Henry Zaidan, appellant, appeared.
Ms. Moermond stated that she was confused because the C of O had been revoked for reasons that
were already in place. The conditions had not been abated by the deadline that had already been
established. She asked what his plans were to address the concerns.
Mr. Zaidan responded that he received the letter regarding the C of O. The whole structure of the
� ramp had a certified engineering report of what needed to be done in December. All items or
conditions had been discussed at the last hearing. He said that the isolated location on the upper
floor where a part of a parking stall in one area and two stalls in the other area were to be re-done.
He had lost all of his tenants because of this matter which was all over the news.
Ms. Moermond responded that this matter had already been heard and the results had already been
decided by the Council. Mr. Zaidan stated that his point was that he didn't have the cash flow to
finish the rest of the work which he agreed to do. Ms. Moermond stated that what he was saying
was that he was blaming the City for his diminished cash flow and those arguments will not be
heard.
Pvlr. Zaidan stated that he got another report from the engineers that the ramp was ok as it is and
then people and occupants where indicating that parts were falling down. Ms. Moermond
responded that she did not read this in any of the letters.
Mr. Zaidan stated that it was noted in the C of O Revocation letter quoted "The parking structure
presents a hazard to the health, safety and welfare of the occupants and the public. These conditions
expose the occupants and the public to danger or peril." He said that the engineering report did not
indicate anything like that.
Ma Moermond stated that the reason for his appeal was that he disagreed with the finding. She
requested a staff report and asked whether they had looked at the engineering report.
• Mr. Berg stated that he had not looked at the engineering report and was not aware of any
engineering report since the one in December.

Ms. Moermond asked if there was a new engineering report. Mr. Zaidan responded there was not. •
He said that from the last hearing, it mentioned those conditions in the report. Ms, Moermond said
that he had indicated there was a new report which there was not. They had discussed a work pIan
with conditions and if Yhe conditions were met, the C of O would not be revoke@. Those conditions
had not been met because he indicated he didn't ha�e the money to pay for the balance of the
repans that where required. The old orders were already dealt with in the appeal process and the
only thing left was for Mr. Zaidan to say that the conditions did not justify revocation. She found it
difficult to believe that the conditions did not justify revocation wben he had already agreed to a
work plan and was aware of those conditions.
Mr. Owens stated that the letter that was issued by Inspector Chapdelaine was simply a routine re-
issuance of a letter from January. Nothing had changed in the situation or in the text of the
correspondence.
Mr. Zaidan stated that since then, they had done the speed ramps and were finished in February.
The only item that was not done was the pazking location in different areas.
Ms. Moermond asked whether the appellant had met the terms. Mr. Riddering stated that they had
and it was only the critical up and down ramps which were in danger of failure that had been
repaired. The only remaining items that were not completed were items that Mr. Zaidan's attomey
said would be completed by June 15.
Ms. Moermond asked Mr. Berg to look at the set of recommendarions that went to the City Council
on February 27. She asked if there were any enforcement actions between when the CounciI heard •
this in Februazy to today.
Mr. Berg noted that the enforcement action was suspended when Mr. Zaidan's attorney, David
McGee, gave them a schedule of when the various critical items were to be repaired. There was one
item that was to have done by March 1, 2008 which was the critical ramp that needed to be done to
get to the mini ramp. The remaining items that Mr. McGee committed to having done by June 15
had nof been done.
Ms. Moermond asked when the effective date of the revocation was. Mr. Seeger responded that in
January, it was condemned upon We findings of the engineers and City staff. They lifted the
condemnafion and left the status as revoked-occupied which permitted them to have occupancy
during the period of time that the C of O was valid. His understaudittg was that it had been reaewed
once and then the work was to be done by mid-June and it was not. The June 231etter sent by
Inspector Chapdelaine was a way to show that it is coming up on his schedule of things that were
not completed.
Ms. Moermond asked what would be the effective date of ordering the building vacated since the
work was not done. Mr. Seeger responded that the decision was up to the Council.
Ms. Moermond recommended that City Council order the ramp vacated and denied the appeal on
the revocation. The ramp should be vacated if the Council agrees with the recommendation by the
close of business on Friday, July 18. �

� Mr. Seeger asked for guidance for how to achieve the Order. The current order was revoked-
occupied. He asked if they would make it revok�unoccupied or if it should go back to being
condemned because it still had not met the building officiaP s request.
Ms. Moermond stated that condemnarion would be a field find and the revocarion was what would
be in front of the Council and the zesult shouid be an order to vacate. Mr. Seeger asked that
pending the approval of the Council, the status would be revoked-unoccupied and the Certificate
could not be reinstated. Ms Moerxnond stated that it would be revoked, ordered to vacate on
Friday, July 18. The recommendations did not cover condemnation and earlier emergency action
or any other enforcement acfion in the interim. If anything were to happen, staff was fixlly
empowered to deal with it. She stated she will inform the Council that there is a SherifPs sale and
she would need additional d'uections from them.

I recommend that you deny the appeal af Mr. Zaidan on the Certificate of Occupancy revocation for the
Lowertown Parking Ramp at 255 East 6`� Street. I found that the conditions which would have allowed continued
occupancy of the ramp (established by the City Council on Febniary 27, 2008 and memorialized on May 7, 2008)
have not been met by Mr. Zaidan, Additionally, there were no communica6ons from Mr. Zaidan since that time
indicating his inability to meet the condifions, or proposing an alternative dead]ine or plan which addresses the
long-term problems. In cases such as thase, my focus is on a timely resolution of the entire problem situation
rather that the development of additional plans or alternative ways compliance can be achieved. �
Given the lack of compliance with the previous conditions and the related conrinued bad conditions in the ramp, I
recommend that the Counci] not allow the ramp to be used. However, I would recommend that an exemption be
made for that portion of the ramp which provides access and ase to the adjacent condominivm owners. Building
official staff indicates that this portion of the building is an area of less concern in the structw�e.
Notably, if Department of Safety and Inspections staff determine, based on new or worsening conditions, that
even this use presents a hazard, they contittue to be empowered to issue an emergency condemnation and order to
vacaYe.
Finally, there was confusion arising out of my office about the schednling of the matter on August 20, rather than
the previously discussed July 16, 2008. I apologize for any inconvenience this may have caused and To conFum,
the matter is scheduled for City Council Public Heazing on August 20, 2008. At that time, I will recommend that
tha Council lay the matter over to September 10, 2008 at 530 p.m, in Room 300 Council Chambers, per your
requesY as you will be out of the country.

In summary, i recommend that the Counci] deny the appeal of Mr. Zaidan on the revocations, allow the continued
occupancy of the structure - thereby granting an extension on compliance deadlines-- and the Council should
impose the conditions and attached deadlines incorporated herein.
If any of these conditions are not met according to the deadlines established, both the Fire Certificate of
Occupancy and the Certificate of Occupancy shall be revoked (denying occupancy) effective as of that
determination. It should be noted that additional enforcement actions may be undertalcen if they are consistent
with the decision, unless an emergency situation is encountered, necessitating emergency enforcement measures.
My recommendations to you on the conditions and deadlines aze the following. It is noted when my
recommendations diverge from the previous discussions, or are in addition to the items previously discussed.
• The "Critical Repairs," which were out]ined in the Department of Safety and Inspections Febnaary 6, 2008
letter to Mr. Zaidan, should be completed according to the schedule developed by DSI and David McGee (Mr.
Zaidan's attorney). These items outlined in the letter are as follows:
1. Partial Depth Repairs: Paragraph II of the 12/12/07 Ericksen Roed report identified delaminated areas
on the underside of the reinforced composite concrete slab which had reduced the service capacity of the
area by 25%. They indicated that partial depth repairs were needed. Started Aprii I, 2008 and completed
by June 15,200$.
2. Full Depth Replacement of Slabs: Paragraph III of the report identified conoded metal decking and
delamination on the underside of the reinforced composite express rams which reduced their capacity to
below the minimum code requirements. These were the most critical elements referred to above because
the approximately 2/3 of the ramp could not be reached without driving over these express ramps. Full
depth replacement of the slabs was called for. Already commenced and will be completed by March I,
2008.
3. Repair Corrosion in Web: Paragraph VI identified severe corrosion in the web at grid 8 on level 9 and
indicated the repairs which were needed on an attached sketch. StartedAprill, 2008 and completed by
June IS 2008
4. Reinforce Purlins: Paragraph VII of the Ezicksen Roed report indentified two purlins along the north
edge of ]evel 8 between grids 5 and 7 which had been cut to accommodate some utility room doors and
which was now overstressed. Reinforcements were called for. Started April 1, 2008 and completed by
June I5, 2008
• During the time prior to the repairs commencing on items 1, 3 and 4, the areas will be blocked off to prevent
cares from using these areas.

With respect to those items listed as preventative maintenance, it appears that DSI and ��cGe��gee that
the repairs should be completed within 90 days. I am recommending that the Council make July 1, 2008 a •
time-certain deadline by which these repairs need to be completed.
1. Seal Shrinkage Cracks: Pazagraph I of the Ericksen Roed report identified shrinkage cracks on the
concrete composite floor slab on levels 6 and 8 and recommended that they be sealed to reduce further
deterioration.
2. Clean and Recoat Corroded Columns: Paragraph N of the report identified corroded columns at the
base connections and recommended cleaning and recoating.
3. Ciean and Recoat Corroded Steel at Girder Beams: Pazagraph V idenfifted conoded steel at the girder
beams at all levels. Again, cleaning and recoating was recommended to reduce further corrosion.
4. Clean and Recoat Corroded Purlins: Pazagraph VI identified more corrosion at the purlins at all
supported levels which they recommended be cleaned and recoated.
Addifionally, the deparlment seems to recommend that the temporary measwes used to make safe the ramp be
addressed in a permanent fashion, and that the schedule for this shall be presented by Mr. Zaidan by Tune 2,
2008. T further recommend that these temporary fixes be made permanent by a time-certain deadline of
September I, 2009.

During the time pnor to the repairs commencing on items 1, 3
and 4, the azeas wil] be blocked offto prevent cazes from using

The items identified as "preventative maintenance" in the letter
of 2-6-OS are not the basis for the CiTy's actions against the
pazking rarnp. However, once the "Critical Repairs" are repaired
GMT will undertake these "maintenance" items within 90 days.
However, we would demand that the issuing of the certificate of
occuparicy occur upon the completion of the "Crrtical Repairs°
and not be delayed to perform maintenance as that was not the
basis of the City's action.
Upon completion of all the critical work identified by Mr.
McGee there will remain areas of significant deterioration,
particularly at other azeas of the up-down ramps, that are beyond
"maintenance" but were not identified as "critical" at this time.
In fact, if all the work identified in the February 6th letter was
completed right now there would still remain azeas of up-down
rnmps with corroded steel decking supported by temporary
wood shoring. The foilowing is a quote from the Ericksen Roed
condition survev:
Corroded metal decking and delaminated areas of the underside
of the reinforced composite express ramp wnaete slabs has
been observed and documented since 2000. The timberjoists on
steel seat angles were installed as a temporary remedial measure.
The remedial measures installed appear to be in reasonable
eondition in order to perform for a short tettn duration
(evaluated armuaily) with the exception of three loeations with
more severe corrosion and spa]]ing.
Therefore, Mr. Berg further recommends that these more serious
matters be addressed with a detailed time schedule along with
the maintenance items identified in the February 6th Ietter, and
[hat a schedule for all the remaining work be submitted for
further review and approvai by June 2, 2008.

Dear Ms. Moermond;
We are in receipt of Ms. Mai Vang's letter of July 17, 2008, advising us of
your decision to recommend to the City Counsel the °dosure" of our parking
ramp, above the 4"' level. According to our understanding, the first and �
second hearings were to determine if our ramp is safe or not.
In your above mentioned Ietter, you mention that your decision was based
on our not implementing the Memo of February 27"', 2008; but does not
address the safety issue of the ramp.
Todate, we have sent you two letters from the'�inspection campany" (on
whose ariginal report LIEP, and yourself, based your decision to close the
ramp in January, and again in June). Both (etters state that the ramp is
°Sa#e for occupancy". They a�so state that some repairs are needed to
reinforce some af the parking stalls (and not the whole ramp), as well as
suggested some maintenance items we should look into.
The Inspection Company, Ericksen, Rced, and Associates, lnc., actually spent two
mor�ths inspecting and testing the ramp before issuing the original report, their second,
and third!
We therefore don't understand why you, and LiEP, are insisting on ciosing a
��safe" ramp?
In his last press release, Mayor Chris Coleman mentions "Retain
businesses and help them expand .. " In that tone, we request that you
review your decision to unnecessarily close our ramp and enable �s survive
this down tum in the economy. �

As per our te{ephone conversation of this morning please find attached the
"NOl OF CERTIFICATE OF OCCUPANCY REVOCATION 255 EA5T 6
STREET REF: # 16344". Riso attached are two invoices from Aduddeil
Restoration and Waterprooflng, Inc. for the wo�k completed in ]anuary and
March of this year.
This notice of revocation reached us last Thursday in the PM, with no advance
rtotice. This in spite of the fact that we had met with CiCy Inspectors Frank
• Berg; Tom Riddering; and their Director, Robert Kessler, on May 16�'� at the
Ramp, to show them the work a4ready completed and discuss our inab+lity to
complete the "extra" work they required. This extra work was not found to be
necessary at this time by "Ericksen Roed & Rssociates, 5tructurai Engineers".
Attached please find their report. Todate, we have not received their repty, or
response, to that meeting.
The same action was taken in January, after presenting our Annual
Engineering Report in December. Without discussing the report with us, we
received a Condemnation Letter from the inspectors effective the same day!
Then they proceeded to give highly negative interview to the press and N
about our faci{ity. This action resu{ted in immediate loss of 90% of our
parkers, as well as the foss of our financing. Ramifications from their actions
have resulted in foreciosure action being taken againsC the property, due to
the sudden unavailability of any revenues.
Needfess to say, most of the parkers that feft our ramp due to the negative
reports, are now parking in the previousfy unfilled "City Ramps"; at "below
market rates". As the City does not pay Real Estate Taxes they can reduce
their prices as they wish; causing great prejudice to private ramQs.
Since )anuary we have managed to regain about 70 parkers, at the same
"beiow market rates" of the City. If this new "Revocation" is not removed
• immediately we will again lose our new parkers. And if this ruthless action
reaches the Press...
