This petition was filed with•the City Clerk on August 5, 1959 and the required filing fee =.was paid. It is now apparent that this petition cannot be set for a bearing by the City Council within the ninety day period established in Section 64.06 of the Zoning Code. It is, therefore, recommended that the City Council authorize '' the applicant to withdraw his application and refund his filing fee.
