Dear Sir:
This is in the matter of the appeal of Mr. and Mrs. Victor A. Newcomb to
establish a 12 foot building line on the west 20 feet of the east 45 feet of
-Lot 11, Block 5, Phalen•Heights Addition, which is located on the north side
of East Hawthorne Avenue between Duluth Street and Phalen Park. The property
is zoned `WI residence and has been since the adoption of the Ordinance in 1922.
The property is developed with a single - family residence constructed in 1923.
This is a triangular tract of land with a total area of approximately 4,358
square feet, and has a frontage of 83.75 feet along East Hawthorne Avenue and
extends along the west property line to a depth of 104.08 feet. The lot is
not served by a public alley, and due to its irregular shape, a garage cannot
be built on the rear of this lot. The only apparent location for a garage would
be to attach it to the existing residence which'would require breaking the Haw-
thorne Avenue building line. The present building line along,Hawthorne Avenue
established by three residences built prior to the enactment of the Zoning
Ordinance, is 22 feet. The applicant is requesting a building line of 12 feet.
All six of the property owners to the west in this block have signed a petition
agreeing to the proposed building line change.'
Phalen Park adjoins the property on the north and east; south across East
Hawthorne Avenue are single - family residences fronting along East Hawthorne
Avenue; west and adjoining are six single- family residences fronting on East.
Hawthorne Avenue. -
Field investigation discloses that the granting of this building line change
.would,put the proposed garage some ten feet closer to Hawthorne Avenue than
the existing residences in the block. In the opinion4of the staff, this change
would establish a very undesirable precedent, would deviate from the purpose
and intent of the Ordinance, and would create a condition which is undesirable
for the residences to the west.
The Board of Zoning considered this appeal at their meeting'on October 22, 1959,
and recommend the granting of a ten foot building line on the west 20 feet of
the east 45 feet of Lot 11, Block 5, Phalen Heights Addition, subject to the
applicant retaining a four -foot clearance from Phalen Park.

We are interested in building a garage,on our property at 1215 E. Hawthorne
Ave. Block 11, Lot 5, Phalen °Heights'Park.
The lot is triangular and is adjacent to Park Property. To build said
garage we would need to place it on a line 8 feet from the side walk in order
to have the garage come within only 4 feet of Park property. This is the last
piece of property on a dead -end street.

We called Mr. Pearson the Building Inspector and he came out to check the
posibility of where we could build a garage. Since our lot does not extend
to the alley there is no way that we can build in the back yard. So the only
place we can build is to the side and front of our property. Mr. Pearson
has since talked to Mr. Alfred Schroder, City Architect about how close to the
Park Property we could build the garage and was told it still would have to be
4 feet from the property line.
Since talking to Mr. Pearson We have had the lot resurveyed by Mr. Wolfgram
and a Blue Print made of the proposed garage, however he has drawn the plans
for the garage to coarse only 6 inches from the Park Property on one side and
12 feet from the side walk. But if we must build 4 feet from the Park Property
then we would have to extend the garage 4 feet closer to the side walk or to
within 8 feet of walk.
We are enclosing a copy of the Blue Print so you can see just what our
problem is. When Mr. Pearson the Building Inspector was here we gave him a
copy of the Blue Prints.
We have measured several of the houses in the.block as to their distance
from the side walk and find them to be as follows: The corner house facing
Duluth St is 22' 1011 from side walk, 1197 Hawthorne is 211 711, 1185 is 22' 811,
1205 is 211 8" and our place 1215 Hawthorne is 241. No two $oases are the same
distance from the side walk.
We would appreciate an early consideration of our problem as we would like
to build a garage this Fall.

Regarding the petition circulated by Mr. & Mrs. Newcombe, /V15
East Hawthorne Avenue, Saint Paul, Minnesota, whereby they request per-
mission from the City of Saint Paul to erect, at that address, a garage
to be located twelve (12) feet back from their front property line.
My name is Francis F. Franta, and I and Lucille A. Franta are the
owners of the property known as 1185 East Hawthorne Avenue, Saint Paul,
Minnesota.
We signed the said petition on the understanding that its intention
was that, in the case of the Newcombes and limited to them, an exception
would be made from the now existing building requirements, in order to
permit them but no other property owners to erect a garage as therein
requested. It now appears from the wording of notices received by
certain property owners in the area that the said petition actually pro-
poses that a new twelve (12) foot building line be established, effective
for the "entire block within which the Newcombe property is located.
We therefore hereby withdraw our signature from said petition, and
further state that we object to the establishment of a new building line,
for the reason that, in,our judgement, such action would tend to devalue
properties in the area.
