2 BE IT RESOLVED that, upon the petition of Jon Chytracek as documented in Public Works
3 Technical Services, Vacation File Number ll-2008, the pubfic right-of-way hereinafter
4 described, as follows and as depicted on attached map Exhibit A, is hereby vacated and
5 discontinued as public property, and subject to the herein stated objections, the easements within
6 said public right-of-way are hereby released:

The east and west 23.0 feet of Clark Street south of the easbwest alley in
blocks 2 and 3, Van Slyke and Lewis Rea�'rangement of Humbirds Addition
to Saint Paul, north of Jessamine Avenue.
This vacation shall be subject to the terms and condition o£ Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
That the petitioners, their successors and assigns shall pay $600.OQ as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That the petitioner, their successors or assigns, shall retain a sewer easement, as described,
for the City of Saint Paul, Department of Public Works within the above described area to
be vacated: In the east 23.0 feet of Clazk Street, the west 15.0 feet will remain a sewer
easement; in the west 23.0 feet of Clark Street, the east 5.0 feet will remain a sewer
easement. The following conditions pertain to the retained sewer easements:
a. That a permanent utility easement shall be retained on, over, under and across the
vacated area on behalf of the City of Saint Paul, Department of Public Works to
reserve the right of the City to maintain and operate any sewer in or upon said
easement and to enter upon said easement or any portion thereof at any time and from
time to time, for the purposes of future construction, reconstruction, inspection,
maintenance, or repair of the same or, any part thereof. Said utility easement shall be
subject to the following conditions:
b. l�TO buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects_which may prohibit normai access to utility facilities for
maintenance purposes will be permitted within the easement area.
c. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be aliowed by obtaining written permission

petitioner, its successors and assigns in the event the City exercises its reserved
easement riahts.
d. Should it be necessary that the peritioner's works or improvements be removed or
damaged as a result of the Department of Public Works operations, all removal,
replacement or modification costs shall be borne solely by the petitioner.
e. No change from the existing grade within the easement uea shall be permitted
without written pemussion from the Department of Public Works Sewer Division.
£ No change in surfacing within the easemenC area shall be pernutted without written
pemussion from the Department of Public Works Sewer Division.
g. The petitioner, its successors and assigns shall fully indemnify, defend, and save
harmless the City of 3aint Paul, its officers, agents, employees, and servants from all
suits, actions, or claims which shail arise from any injuries ar damages received or
sustained by any break in any service pipe or connection in said reserved easement
azising aut of or resulting from any action or negligence of the petitioner, its
employees, agents, or business invitees.
That an easement shall be retained on behalf of Comcast, a Pennsylvania Corporation, for
existing facilities. The petitioner or its successor shall provide new easements if required
and the petitioner or its successor shall assume all costs of relocating faciliries to the new
easements.
4. That an easement shall be retained on behalf of Qwest Communications, a Delaware
Corporation, for existing facilities. The petitioner or its successor shall provide new
easements if required and the petitioner or its successor shall assume all costs of
relocaring facilities to the new easements.
5. That the petitioner, their successors and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any character brought as a result of injuries ar damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
6. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file wiCh Public Works, City Real Estate, an acceptance in writing of the
conditions of this resolution and shall, within the period specified in the terxns and
condiUOns of this resolution, comply in all respects with these terms and conditions.

The Ciry Clerk has referred tn this office for recommendation the petition of ]ohn Chytracek to vacate part of Clark Street as it abuts
his property and that of his neighbor to the west, per the attached map.
As indicated, this inquiry pertains to the vacation of City right-of-way only; utility easements may remain in place even if street
usage is removed. Utilities, please note that a 20 opening will remain. If your faci{ities tie within tlfe 20, you neednt
spec�cally reWin an easement.
The purpose of this vacation is to aliow the property owner to expand his parcel into platted right-of-way in the same configuration
as the properties to [he north oP his.
Will you please advise me of any conterns you may have regarding this proposed vacation as soon as possible. I would like to
receive your comments before July 3, 200Sso I can prepare a report to the Gty Council on this matter

RE: Public Works Vacation �le No11-2008 (Vacate part of Clark St.)
I recommend a public hearing before the City Council be held on Au¢ust 20, 2008
to consider the petirion of John Chytracek.
This petition is to vacate the east and west 23' of Clark Street as it abuts the two lots
north of Jessamine Avenue.
The purpose of this vacation is to grant private ownership of right-of-way used and
maintained by abutting owners. There is no building proposed within the vacated
areas.
This property is located in City Council Ward 5, Planning Dislrict 5.
