DeCourcy, by request — Whereas, Paul Panagiotopoulus, an ern �ye of the Department of Public of the September S1, 1958, in an automobile accident while engaged in the performance of his duties for the City has Department incurred timed cal expenses in the amount of $97.50 therefor, and *he ernnln7e, by reason of said injury, . -�, -P tk, __op=iod IL N19466 WHEREAS, Paul Panagiotopoulus, an employe of the Department of Public Safety of the City of Saint Paul, was injured on September 1, 1958, in an automobile accident while engaged in the performance of his duties for the Department of Public Safety, and the City has incurred medical expenses in the amount of $97.50 therefor, and the employe, by reason of said injury, was disabled for work for a period of time, being paid salary in the amount of $389.10 therefor; and WHEREAS, a settlement has been negotiated by the parties in the total amount of $100, including any amount tb! which the City would be subrogated for medical expenses and salary paid to the employe; and WHEREAS, in view of the seriousness of employe's injuries and the amount of the total settlement, the Office of the Corporation Counsel has recommended the acceptance of $34.00, which has been offered to the City through David E. Marsden, attorney representing the employe, in full settlement of its claim for damage to its property and for medical expenses and salary paid to Paul Panagiotopoulus as a result of said accident; and WHEREAS, a claim has been presented by the non - driving owner of the other car involved in the aforementioned accident in the amount of $385.00 by the Anchor Casualty Company and Clifford Polski covering damage sustained by this car in the aforementioned accident; and WHEREAS, all parties are desirous of effecting a settlement and compromise which is deemed in the best interests of all concerned, now, therefore, be it RESOLVED, That the proper City officers, pursuant to Section 418.11, Minnesota Statutes 1941, and upon delivery to the Corporation Counsel of a release in a form approved by him, are authorized and directed to pay from the Judgment COUNCILMEN Yeas Nays DeCourcy Holland Martinson Peterson Rosen Winkel Mr. President, Dillon 5M 7 -59 ,8 In Favor A gainst Adopted by the Council 19 Approved 19 Mayor l�. COUNCIL FILE and Compromise Fund the sum of $300.00 to Anchor Casualty Company and Clifford Polski, in full payment and satisfaction of any and all damages sustained by said Anchor Casualty Company and Clifford Polski, in the accident on the first day of September, 1958, with Paul Panagiotopoulus, a policeman, while in the performance of his official duties; and be it FURTHER RESOLVED, That the proper City officers are hereby authorized and directed to execute the necessary releases and to accept the sum of $34.00 in full payment and settlement of the City's claim in the matter of its injured employe Paul Panagiotopoulus, for medical expenses and salary expense arising as a result of said accident of September 1, 1958, and that said sum of $34.00 shall be credited as follows: $17.00 to Fund 31 -G1 -A and $17.00 to Fund 7 -C -1.
