Dear Sir:
This i in the matter of the appeal of Roger and Elsie Reichel to establish
a oot biilding,lirie on property located on the southeast corner of Payne
and Idaho Avenues. The property is described as Lot 19 and the north 25
feet of Lot 18, Block 2, Uftongrove Plat 3. The zoning is "A" Residence and
has been since the adoption of the Ordinance in 1922.
The site is presently "vacant, and the applicant proposes to erect a single -
family residence with a set back of 25 feet from Payne Avenue. Presently,
the set back from Payne Avenue, as established by two residences erected
prior to the establishment of the Zoning Code in 1922, is 37 feet. The pro-
perty under consideration has a frontage of 60.82 feet along Payne Avenue, and l
113.8 feet along Idaho Avenue, resulting in a total area of approximately
6,921 square feet.
North across Idaho Avenue is a single - family residence fronting on Payne
Avenue; south and adjoining is a single - family residence fronting on Payne
Avenue; east and across an unimproved alley is a single- family residence
fronting on Idaho Avenue; west across Payne Avenue are one and two - family
residences fronting on Payne Avenue. The owner has circulated a letter to
the property owners in the block between Idaho and Iowa Avenues, of which
there are only two besides the petitioner, 'asking consent to the proposed
25 foot set back. The owner directly adjacent opposes the proposal, the
other owner consented.
Field investigation discloses that a 25 foot building line would create a
hardship on the property owner directly to the south as the new building
would protrude 12 feet in front of his residence. Due to the shallowness
of this lot, and the established building line of 37 feet, it is the opinion
of the staff that a 30 foot building line would be the limit of any relaxation
made. This would be a compromise for both parties.
The Board of Zoning considered this matter at their meeting on October 22,
1959, and they recommend the granting of the requested 25 foot set back on
the above described property in accordance with plans submitted at that
time.
