RESOLVED, that Aagard Building Company be permitted to install and
operate a 48 -car off - street private parking lot in conjunction with four
proposed 12 -unit apartment buildings at the southeast corner of Ruth Street
and U. S. Highway No. 12, on Lot 19 Block 5, Scenic Hills Addition, in accord-
ance with plans approved October 22, 1959, and subject to compliance with the
provisions of all ordinances governing the operation of parking lots and to
the further condition that sidewalks abutting said premises be kept clean and
free of ice and snow at all times.

Dear Sir:
This is in the matter of the application of the Aagard'Building Company for a
48 car private parking,lot in conjunction with'four 12 -unit apartment buildings
on,property located onuthe southeast corner of Ruth Street and U. S. Highway No.
12. The property is described'as Lot 1, Block 5, Scenic Hills Addition.
On May 30, 1953, the City Council rezoned this property from "A" residence to
Commercial for the purpose of developing the site with a neighborhood shopping
center which never materialized. The site is presently vacant and the applicant
proposes to develop this tract ultimately with nine 12 -unit 2J story brick - veneer
apartment buildings with sufficient off-street parking accessory thereto. Plans
for this proposed development have been given this office. fnasmuch as Chapter
4.04, paragraphs lland 12 of the Building Code prohibits the applicant from
developing this tract with nine buildings as•ultimately proposed because two of
the buildings do not front on a public street as required under this chapter,
the applicant has reduced his application to provide 48 parking spaces accessory
to four buildings at this time. The proposed development of nine buildings
meets the recommended standards for building ground coverage and density for
this type development.
The property under consideration is an irregularly shaped tract-of land having
frontage on both Ruth and Pedersen Streets,' and also along U.S.Highway No. 12
which will eventually be fenced at this point, prohibiting access to this property
from the highway. The area proposed for apartment development has an area of
approximately 113,286 square feet. :The Minnesota Highway Department, at some
future date, proposes to acquire the northerly portion of this lot, as platted,
for right -of -way needs in connection with the Interstate Freeway. This portion
has not been included in the applicant's proposed plot plan and development.
South and adjoining are single - family residences now under construction which
front on Suburban Avenue to the south; west across Ruth Street is vacant land
which is zoned commercial; north and across U. S. Highway No. 12 is vacant land,
also zoned commercial; east and across Pedersen Street are single family resi-
dences fronting on U. S. Highway No. 12.
The Traffic Engineer has approved the plan which meets the standards for this
type of facility. Field investigation discloses that this area should not have
been zoned commercial in 1953.
In consideration of the above factors, the Board of Zoning recommends the gra t-
ang of this application for a 48 car private parking lot on the above describ
property in accordance with plans approved October 22, 1959.,
