08-884Council File # Q — g Green Sheet # 3DSS1S1 Presented by 1 WHEREAS, the City of Maplewood ("Maplewood") is undertaking the reconstruction of the 2 intersection of Highway 61, Parkway Drive and Frost Avenue, which includes the construction of a pedestrian 3 trail connection between said intersection and the state-owned Gateway Trail; and 4 5 WHEREAS, the City of Saint Paul ("City") owns park land at the northeast corner of Highway 61 and 6 Frost Avenue (the "Property"), as shown on the attached E�ibit A; and 7 8 WHEREAS, Maplewood is requesting easements from the City to permit the construction and ongoing 9 maintenance of a pedestrian trail and related storm sewer drainage structure ("the Improvements") on the 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Property; and WHEREAS, the City has determined that construction of the Improvements on the Properry would not constitute a disposal ar diversion of park land under the provisions of Chapter 13.1 Al of the Saint Paul City Charter; and WHEREAS, the City has agreed to grant Maplewood a Temporary Construction Easement and Permanent Trail, Drainage and Utility Easement for the construction of maintenance of said Improvements, attached hereto as Exhibits B and C, respectively; and WIIEREAS, the Acting Valuation & Assessments Engineer has cCetermined that the cost of the Improvements that benefit the Properry equals or exceeds the fair market value of the proposed easements requested by Maplewood; now, therefore be it RESOLVED, by the Council of the City of Saint Paul, that the proper city officials are hereby authorized and directed to grant a Temporary Construction Easement and Permanent Trail, Drainage and Utility Easement to the City of Maplewood, in a form and content substantially as set forth in E�ibits�3 'and C attached hereto; and to record said permanent easement with Ramsey County. The City of Maplewood is making improvements to an intersection and surrounding property at Highway 61 and Frost Avenue in Maplewood. Included in the improvements is the construction of a pedestrian traii connection from the intersection to the state- owned Gateway Trail. The City of Saint Pau] owns a portion of the properry on which the trail would be located. Maplewood desires easements for tha[ trail and a related stormwater drain and pipe. There is no compensation for the easements, as the value of the improvements benefiting the City of Saint Paul property eacceeds the valne of the easeempts.
