10-1041 Council File # 10-1041 Green Sheet # 3116250 RESOLUTION � S .-CITY OF SAINT PAUL, MINNESOTA Presented by ✓ � ti. i � '` 1 WHEREAS, Department of Safety and Inspections has requested the City Council to 2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking 3 and removal of a one and one-half story, wood frame, single family home and detached, one 4 stall, wood frame, garage located on property hereinafter referred to as the "Subject Property" 5 and commonly known as 365 BURGESS STREET. This property is legally described as 6 follows, to wit: 7 8 Robert A Smiths Rearran gem Lot 12 Blk 4 9 10 WHEREAS, based upon the records in the Ramsey County Recorder's Office and 11 information obtained by Department of Safety and Inspections on or before March 16, 2010, the 12 following are the now known interested or responsible parties for the Subject Property: Wells 13 Fargo Bank NA, Foreclosure Dept Mac 7801 013, 3476 Stateview Blvd, Fort Mill SC 29715.- 14 7203; Reiter & Schiller, PA, Attorneys at Law, The Academy Professional Building, 25 N. Dale 15 Street, St. Paul, MN 55102; District 6 Planning Council; and 16 17 WHEREAS, Department of Safety and Inspections has notified the known interested or 18 responsible parties of the "Order to Abate Nuisance Building(s)" dated June 8, 2010 as provided 19 for in Chapter 45 of the Saint Paul Legislative Code; and 20 21 WHEREAS, this order informed the then known interested or responsible parties that the 22 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and 23 24 WHEREAS, this order informed the interested or responsible parties that they must repair 25 or demolish the structure located on the Subject Property by July 12, 2010; and 26 27 WHEREAS, the enforcement officer has posted a placard on the Subject Property 28 declaring this building(s) to constitute a nuisance condition; subject to demolition; and 29 30 WHEREAS, this nuisance condition has not been corrected and Department of Safety 31 and Inspections requested that the City Clerk schedule public hearings before the Legislative 32 Hearing Officer of the City Council and the Saint Paul City Council; and 33 34 WHEREAS, the interested and responsible parties have been served notice in accordance 35 with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and 36 purpose of the public hearings; and 37 38 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul 39 City Council on Tuesday, August 24, 2010 to hear testimony and evidence, and after receiving 40 testimony and evidence, made the recommendation to approve the request to order the interested 10-1041 41 or responsible parties to make the Subject Property safe and not detrimental to the public peace, 42 health, safety and welfare and remove its blighting influence on the community by demolishing 43 and removing the structure in accordance with all applicable codes and ordinances. The 44 demolition of the structure to be completed within fifteen (15) days after the date of the Council 45 Hearing; and 46 47 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, 48 September 15, 2010 and the testimony and evidence including the action taken by the 49 Legislative Hearing Officer was considered by the Council. 50 51 NOW THEREFORE BE IT RESOLVED, that based upon the testimony and evidence 52 presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the 53 following Findings and Order concerning the Subject Property at 365 BURGESS STREET 54 55 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul 56 Legislative Code, Chapter 45. 57 58 2. That the costs of demolition and removal of this building(s) is estimated to exceed 59 five thousand dollars ($5,000.00). 60 61 3. That there now exists and has existed multiple Housing or Building code 62 violations at the Subject Property. 63 64 4. That an Order to Abate Nuisance Building(s) was sent to the then known 65 responsible parties to correct the deficiencies or to demolish and remove the 66 building(s). 67 68 5. That the deficiencies causing this nuisance condition have not been corrected. 69 70 6. That Department of Safety and Inspections has posted a placard on the Subject 71 Property which declares it to be a nuisance condition subject to demolition. 72 73 7. That this building has been routinely monitored by Department of Safety and 74 Inspections, Vacant/Nuisance Buildings. 75 76 8. That the known interested parties and owners are as previously stated in this 77 resolution and that the notification requirements of Chapter 45 have been fulfilled. 78 79 ORDER 80 81 The Saint Paul City Council hereby makes the following order: 82 83 1. The above referenced interested or responsible parties shall make the Subject Property 84 safe and not detrimental to the public peace, health, safety and welfare and remove its 10-1041 85 blighting influence on the community by demolishing and removing the structure in 86 accordance with all applicable codes and ordinances. The demolition and removal of the 87 structure must be completed within fifteen (15) days after the date of the Council 88 Hearing. 89 90 2. If the above corrective action is not completed within this period of time Department of 91 Safety and Inspections is hereby authorized to take whatever steps are necessary to 92 demolish and remove this structure, fill the site and charge the costs incurred against the 93 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative 94 Code. 95 96 3. In the event the building is to be demolished and removed by the City of Saint Paul, all 97 personal property or fixtures of any kind which interfere with the demolition and removal 98 shall be removed from the property by the responsible parties by the end of this time 99 period. If all personal property is not removed, it shall be considered to be abandoned 100 and the City of Saint Paul shall remove and dispose of such property as provided by law. 101 102 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested 103 parties in accordance with Chapter 45 of the Saint Paul Legislative Code. Ordering the owner to remove or repair the building(s) at 365 Burgess Street within fifteen (15) days from adoption of resolution. The property owner of record, Wells Fargo Bank N.A., did not appear. No other parties of interest appeared. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated that the building was a one and one-half story, wood frame, single- family dwelling and a detached one stall garage on a lot of 5,227 square feet and had been vacant since October 2, 2008. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,100 went to assessment on November 2, 2009, and the $5,000 performance bond had not been posted. On May 18, 2010, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 8, 2010 with a compliance date of July 28, 2010. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $17,700 and the building to be $52,600. Real estate taxes aze current. Code Enforcement estimates the cost to repair the building to exceed $65,000. The cost for demolition was estimated to be approximately $9,000 to $11,000. There had also been four summary abatements issued to this property since 2008, resulting in six work orders for removal of improperly stored refuse and debris, cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends the building be removed within fifteen (15) days. Mr. Magner presented photographs of the property. Mr. Magner comments that the photos reveal mold and exterior water damage. Ms. Moermond asks for a report from Ms. Spong. Ms. Spong reported that the structure was built in 1910 in a"worker's cottage" style. Ms. Spong reviewed photos and commented that block had good rhythm, but not much information on area. Ms. Moermond commented that structure housed an old claw foot style bath tub, but water damage was apparent, and that some walls would need fixing or replacement. Ms. Spong added that asbestos shingles were visible. Ms. Spong offered that demolition would not have an adverse effect. Ms. Spong describes housing on the block, and shows Ms. Moermond Sandborn Insurance map. Ms. Moermond asks Ms. Vang to e-mail HR.A, to see if there is any spark of interest in the property. All repairs must be in accordance with appropriate codes. The exterior walls and/or trim of the house has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 3. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. 4. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. 5. The exterior walls of the house are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. 6. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 7. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. 8. Concrete front steps pulling away from the house. Interior 1. Severe water damage on walls and ceilings 2. Evidence of mold throughout the house 3. Exposed electrical wiring. 4. Copper piping has been stripped. 5. Open plumbing. 6. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 7. Infestation of Cockroaches. Exterminate and eliminate all cockroaches throughout the entire building. Provide this office with a copy of the extermination report from a licensed professional Pest Control Operator, and follow their recommendations to eradicate these pests. 8. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perform a C/0 test on the heating plant. Provide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 10. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 11. The interior walls are defective. Repair all wall defects and finish in a professional manner. 12. There is evidence of a rodent infestation. Immediately exterminate and eliminate all rodents from the entire building. Remove rodent harborages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestation. Immediately remove any dead rodents from the premises. 13. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. ' As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by July 12, 2010 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s).
