WE3EREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a single story, wood frame, single family dwelling and its single stall, wood
frame, detached garage located on property hereinafter referred to as the "Subject Property" and
commonly known as 904 YORK AVENUE. This property is legally described as follows, to

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on ar before August 18, 2008, the
following are the now known interested or responsible parties for the Subject Property: Juan and
Irma Calderon, 1170 Hillcrest Dr, Woodbury, MN 55125; Peterson, Fram & Bergman, 55 E. S
St., Sulte &00, St. Paul, MN 55101; 7eff Detloff, 11200 W. 78`� St., Eden Prairie, MN 55344;
Federal Natl Mortgage AssnlFannie Mae Internatnl Plaza II, 14221 Da11as Pkwy, Suite 1000,
Dallas, TX 75254; Payne Phalen District 5 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated March 25, 2009; and
WHEREAS, this order informed the then lalown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by Apri124, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREA5, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, July 14, 2009 to hear testimony and evidence, and after receiving
testimony and evidence, made the zecommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicabie codes and ordinances, or in the alternative by
demolishing and removing the sriucture in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fdteen (15) days after
the date of the Council Hearing; and
WFIEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
August 5, 2009 and the tesrimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 904 YORK AVENUE.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Properiy which declazes it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparhnent of Safety and
Inspections, VacantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safery and weifare and remove its

blighting influence on the community by rehabilitating ttus shucture and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with a11 applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed witbin
fdteen (15) days after the date of the Council Hearing.
If the above conective action is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. Tn the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If a11 personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
107 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
108 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family with a detached one-stal]
garage on a lot of 3,920 square feet.
According to our files, it has been a vacant building since May 5, 2008.
The current property owner is Federal Natl Mortgage Assn(Fannie Mae Internatni Plaza II, per
AMANDA and Ramsey County property records.
The city has had to board this building to secure it from trespass.
There have been ten ( I 0) SUMMARY ABATEMENT NOTICES since 2008.
There have been six (6) WORK ORDERS issued for:
- Boarding
- Improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
On February 25, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on March 25, 2009 with a compliance date of
April 24, 2009. As of this date tkus property remains in a conditaon which comprises a nuisance
as defined by the legislative code.
The Vacant Building registraYion fees are paid. (20D8 went to assessment on 8-21-08; 2009 due
5-6-P9, assessed 6-1-09 pending 90 days until 7-I-09).
Taxation has placed an estimated market value of $15,7oQ on the land and $ 58,300 on the
building.
As of July 6, 2009, a Code Compliance Inspection has not been completed.
As of July 6, 2009, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $30,000 to $40,000.
The estimated cost to Demolish is $8,000 to $10,00Q.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violafion of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On February 25, 2009, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at tbis time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Buiiding (651)266-9090. That inspection will idenrify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) perfarmance
bond with the Building Inspecrion and Design Office before any permits are
issued, except for a demolifion pernut.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance ar a Certificate of Occupancy has been issued.
Tlus is a single story, wood frame, single family dwelling and its single stall, wood
frame, detached garage.
Interior
1. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Lack of Electricity. Immediately restore electrical service. Failure to provide
proper electrical service will result in these premises being declared Unfit for
Human Habitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension cord wiring is not permitted while
the power is off.
Lack of Natural Gas Service. Immediately restore natural gas service. Failure
to provide natural gas service will result in these premises being declared
Unfit for Human Habitation and ordered vacated for lack of this basic facility.
4. The interior ceilings are defecfive. Repair all ceiling defects and finish in a
professional manner.
5. The interior wa11s are defective. Repair a11 wall defects and finish in a
professional manner.
6. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
7. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perform a C10 test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas tired
appliances requires a pe�nit.
8. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
9. SANITATION: Immediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.

maintained in a clean and sanitary condition. tisable materials must be stored
in an approved manner, so as not to constitute a nuisance.
10. DEFECTNE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
Exterior
11. Lack of Water Service. Immediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
12. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
13. The exterior wa11s andlor trim of the house andlor garage has defective,
peeled, flaked, scaled or cbalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
14. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-fight and
rodent-proof condition. Permit may be required.
15. The window andlor door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tig�t-fitting and securely fastened to the frames.
16. The windows andlor storm windows are in a state of disrepair. Replace a11
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
As owner, agent or responsible party you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by April 24, 2009 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This
inspection will idenrify speeific defects, necessazy repaars and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the

guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staff: No permits wi11 be issued
without HPC review and approval. HPC staff also can be reached by calling b51-266-9078.
As an owner ar responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. Tf you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. T'his placazd shall
not be removed without the written authorit}� of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken wiChin the time specified in tkris order, the Enforcement Officer
will notify the City Council that abatetuent action is necessary. The City Clerk will then
schedule dates £or Public Hearings before the C3ry Council at which time testimany will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the xesolution calls for abatement action the Council may either arder the City ta take tha
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide tk�at if corrective acfion

(15} days from adoption of resolution.
Reena Jackson, realtor with Fannie Mae, appeared on behalf of the property owner Federal Natl
Mortgage AssnfFannie Mae. No other parties of interest appeared.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and
one-half story, wood frame, single-family dwelling with a detached one-stall gazage on a lot of
3,920 square feet and had been vacant since May 5, 2008. A code compliance inspection had not
been done, the vacant building registration fees in the amount of $1,000 went to assessment on
August 21, 2008, and the $S,OOQ performance bond had not been posted. On Februuy 25, 2009, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on March 25, 2009 with a
compliance date of Apri124, 2009. To date, the property remain ed in a condition which comprised
a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market
value of the land to be approximately $15,700 and the building to be $58,300. Reai estate taaces
were. Code Enforcement estimates the cost to repair the building to be approximately $30,000 to
$40,000. The cost far demolirion was estimated to be approximately $8,000 to $10,000. There had
also been 10 summary abatements issued to this properiy since 2008, six of which went to work
order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse and debris, boarding, and cut tall grass and weeds. Code
Enfarcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a xeport from Ms. Spong. Ms. Spong stated that this building was built in
1885 and was a worker's cottage-style building. She noted that the porch had been early enclosed
and was intact, the windows were intact, the exterior had been stuccoed, and the interior had intact
hardwood floors. The building had not been surveyed asid was not located in any historic district.
She was unsure on the context of the neighborhood and was waivering between recommending
rehab or demolition.
Ms. Jackson stated that she was aware as of that morning that Fannie Mae had been in contact with
Sheri Pemberton to see whether the HRA would be interested in acquiring the property. She said
that property was being dumped on and they had assumed responsibility far some of the exterior
maintenance; i.e. removal of a fence and removal of some exterior bricks. She said she went by the
property every two weeks to make sure the yard was clear of debris and garbage. They had not had
the code compliance done to date and she was requesting additional time.
Ms. Moermond asked what the history was at the property. Mr. Magner responded that the last
wark order was in October 2008 for tall grass and weeds and a clean up. There had not been any
violations at the property since that time.
Ms. Moermond stated that the code compliance inspection would need to be done and needed to be
ordered by Friday, July 17, 2009. She recommended referring that matter back to the August 25
Legislative Hearing and September 2 Council Public Hearing to allow for additional time.

Mortgage Assn/Fannie Mae. Sheri Pemberton, PED, appeazed on behalf of the HRA.
Mr. Magner stated that at the hearing on July 14, the code compliance inspection was supposed to
be ordered and Ms. 7ackson was working to see if the HRA was interested in the property.
Ms. Jackson stated that there was a signed purchase agreement and Fannie Maw was deeding the
property to the HRA for $1 with the HRA assuming all responsibility for the costs of the
assessments. She said Fannie Mae had the purchase agreement and she was waiting for them to
execute it and retum it to her.
Ms. Pemberton stated that she was waiting for the executed purchase agreement and planned to do a
walk through of the property to determine whether the building should be demolished or
rehabilitated. She said they should make a decision by mid-September and if they were going to
proceed with demolition, they woutd request 60 days. ff they determined to rehabilitate the
structure, they would request 48 months to complete the rehab.
Mr. Magner responded that the code compliance had not been applied for. Ms. Pemberton
responded that the HRA would order the code compliance.
Ms. Moermond recommended granting 90 days if the HRA determined to dexnolish the building and
24 months if the HRA determined to rehabilitate the shucture. She also recommended continuing
the Council public hearing continued to October 7.
