The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, December 2, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 180 WINONA STREET EAST. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies ar to demolish and remove the building(s). .� 7 That the deficiencies causing this nuisance condition have not been corrected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Deparhnent of Safety and Inspections, VacantlNuisanceBuildings. The demolition and removal of the shucture must be completed within fifteen (15) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this struchxre, fill the site and chazge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 oFthe Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since March 9, 2009. The current property owner is Jerry Gasperlin, per STAMP. There has been one (1) SUMMARY ABATEMENT NOTICE since 2009. There has been one (1) WORK ORDER issued for: - Improperly stored refuse, garbage and misc debris On June 16, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on July 22, 2009 with a compliance date of August 24, 2009. Failure to provide water service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. 18. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 19. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by August 24, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 7ackson Street, Suite 220, St Paul (651)266-8989. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. If this building is located in a historic district ox site (noted above, just below the praperty address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and desigi review application and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. The property shall not be sold, transferred or conveyed in any manner Suly 22, 2009 180 WINONA ST E page 4 09-1333� until the Nuisance Conditions have been abated and the Certificate of Code Compliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placard on this property wluch declares it to be a"nuisance condirion", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, including administrative costs will be assessed against the property as a special assessment in accordance with law. The property owner of record, 7erry Gasperlin, did not appear. No other parties of interest appeared. Mr. Magner stated the buflding was a one story, wood frame, single-family dwelling with a detached two stall garage on a lot of 5,227 square feet and had been vacant since Mazch 9, 2009. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,000 went to assessment on Apri129, 2009, and the $5,000 performance bond had not been posted. On June 16, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on July 22, 2009 with a compliance date of August 24, 2009. To date, the property remained in a condition which comprised a nuisance as defaned by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $32,200 and the building to be $61,700. Real estate ta:ces were current. Code Enforcement esrimates the cost to repair the building to be approximately $75,000 to $85,000. The cost for demolition was estimated to be approximately $8,000 to $10,000. There was one suminary abatement order issued to this property since 2009 which went to work arder: remove improperly stored refuse and debris. Mr. Magner stated that it was the property owner's intention to demolish the building themselves and had already begun the process. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that the building was built in 1895 and was a worker's cottage-style building which had a brick veneer exterior. She said it had not been surveyed and she did not believe demolition would have an adverse effect on the neighborhood. Ms. Moermond stated that since the owner intended to remove the building kumself, she recommended it be removed within 15 days with no option for repair.
