WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public heazings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one and one-half, wood frame single family dwelling located on property
hereinafter referred to as the "Subject Property" and commonly known as 639 HUMBOLDT
AVENUE. This property is legally described as follows, to wit:
WEST ST PAUL BLKS 100 THRU 171 ETC S 50 FT OF N 150 FT OF E 1(2 OF BLK 122
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before May 23, 2009, the
following are the now known interested or responsible parties for the Subject Property:

Berman PA, 55 East Fifth Street, #800, St Paul, MN 55101; District 2 CC Greater East Side.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated July 20, 2009; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by August 20, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
Ciry Council on Tuesday, October 27, 2009 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabititation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 18, 2009 and the testimony and evidence including the action taken by the
Legislative Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 639 HUMBOLDT AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition haue not been conected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by cehabilitating this structure and corcecting all

4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.
** Plans for the rehabilitation of this structure must be developed within six months after the
date of the Council hearing. The proiect shall be completed within the following 18
months.

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with a11 applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
If the above conective action is not completed within this period of time Department of
Safery and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is furthex ordered, that a c.Qpy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, duplex on a lot of 7,405 square feet.
According to our files, it has been a vacant building since August 8, 2008.
The cunent property owner is Citimortgage Inc/Co Associates Financial Serv, per Ramsey
County Taac Records.
There have been four (4) SUMMARY ABATEMENT NOTICES since 2008.
There have been four (4) WORK ORDER(S) issued for:
- Improperly stored refuse, garbage and misc debris
- Boazding/securing
- Removal of tall grass and weeds
- Removal of snow and ice
On June 26, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE $UILDING was posted on July 20, 2009 with a compliance date of
August 20, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (Assessed on 8-8-09)
Tvcation has placed an estimated market value of $43,900 on the land and $126,200 on the
building.
As of June 19, 2009, a Code Compliance Inspection has been completed.
As of October 22, 2009, the $5,000.00 performance bond has not been posted.

Code Enforcement O�cers estimate the cost to repair this structure is $75,000 to $80,000.

Please be advised that this report is accurate and correct as of the date June 19, 2009. All
deficiencies identified by the City after this date must also be corrected and all codes and
ordinances must be complied with. This report is valid for 365 days from June 19, 2009.
This report may be used in lieu of a Truth in Housing Report required in St Paul Legislative
Code 189. This building must be properly secured and the property maintained at all times.
In order to sell or reoccnpy this property the following deficiencies must be corrected:

• Install tempered or safety glass in window over stair landing to code
• Repair or Replace any deteriorated window sash, broken glass, sash holders, re-putty,
etc as necessary
• Provide complete storms and screens, in good repair for all door and window openings
• Provide operable hardware at all doors and windows
• Provide thumb type deadbolts for all entry doors. Remove any surface bolts
• Repair or replace damaged doors and frames as necessary, including storm doors
• Weather seal exterior doors
• Install floor covering in bathroom and kitchen that is impervious to water
• Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See St Paul Legislative Code, Chap. 34 for
additional information).
• Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, not being carried properly, door and window
openings that are not adequately supported, etc.) aze to be reconstructed in an approved
manner

of the entrance point of the water service
• Bond around water meter with a copper wire sized for the electrical service per Article
250 of the NEC
• Provide a complete circuit directory at service panel indicaring location and use of all

• verify/install a separate 20 ampere laundry circuit and a separate 20 ampere kitchen
appliance circuit
• Install S type fuse adapters and proper size S fuses listed circuit breakers
• Verify that fuse amperage matches wire size
• Close openings in service paneUjunction box with knock out seals, breaker blanks and/or
junction boxes
• Provide one (1) light for each 200 square feet in unfinished basement. One light must be
switched on from the top of the stairs
• Replace GFCI receptacle in second floor bathroom adjacent to the sink

• Any open walls or walls that are opened as part of this project must be wired to the
standards of the 2008 NEC.

Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 3ackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to conect this
nuisance condition.

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred ar conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placazd on this property which declares it
to be a'huisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is fiuther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

A. SITE d)�SCRIP"TI�N: This two-story duplex �zth a corner tower was canstructed in 1900,
according to flte historic permits (however, according to Ramsey County tax records, it was
constructed in 1889). it is a xesfrained Quee� Anne style, brick veneered building, The frontporch,
whieh was shocvn in the 190�} Sarabom Map (lasi updated in 1946), has relatively-racently been
removed, as the exposed brick has noi since been treated. The listed builder was George Londi and
original owner tuas 1. Kuschke. The property was not identified in the 1983 Historic Sites Survey,
nor is it tocated in a natianal or local historic district. The house has two brick chimfleys. The cost
of building the house was $2,500. Information in a Ramsey County field card showed the owner
t rooms on TI�e second floor in 1948, in 1955 it was a duplex and remained that x��ay unti12001.
It was •r.oned as a single family detached in 2001, listed vaeant in 2008, and a noneonformir�g use
peimit was approved in Jurte 2009 and is currentiy zoned as RT-1 (duplex).
B. PROPOSEI2 CY3ANGES:
During the Legsslative Hearing on October 27, the Legislative hearing officer recommended a
layover to the December 16 City Council hearing so the HYC could consider this property for review
as a historic resource. A historic resource is deFined as"A property that is believed to have
historical, cultural, architeetural, archaeological or engineering significance and to meet at least ane
of the criteria for designation as a heritage preservation site or distriet as provided in thls chapter,"
Tf demoliCion is approved, CD.BG funds will be utilized for the removal ofthe "nuisance building,"

Sec. 73.05. Designation of heritage Preservation sites.
(a) Criteria. In considerino the designation of any area, place, building stnicture or similar object
in the City of Saint Paul as a heritage preservation site; the commission shall apply the following
criteria with respect to such designation:
{1) Its character, interest or value as part of the development, heritage or culturai chazacterisrics
of the City of Saint Paul, State af Minnesota, or the United States.
(2) Its location as a site of a significant histaric event.
(3) Its identification �,vith a persan or persans who significantly contributed to the culture and
development of the City of Saint Paul.
(4) Ixs embodiment of distinguishing characteristics of an architectural or engineering t}�pe or
specimen.
(5} Its identification as the work of an architect, engineer, or master 6uiider whose individual

D. FIN3�ING5
1. The property was not surveyed or identifieci during the 1983 Historic Sites Survey of Raznsey
Couniy. No images were found in a search of the MN Visual Resource database.
2. A more intensive level survey wou2d be required to determine if the buiiding would be
individually eligible for local designation or be eligible for the National Reaister, however, staff
believes That it would not be eligible as a National Register individual si1e.
3. It is always better to retain historic fabric iype buildings than it is to demolish and create a hole in
the neighborhood. 11�e rhythm and the style of houses azound the property appear to have
chviged very Iittle over flae past several decades. This property is the only one of a fe1� houses
on adjacent bloeks with brick veneer; mt�st other hauses were huilt as frame buifdings with
asbestos covering. The house is ]ocated iu tl�e rniddie of the block with ihree other hQUges, all
built between 1892 and 1913. Across the street, the entire block is taken up by a portion of
HumboIdt Secondary School, whiah was eonsYnzceed on the �ite iv 19Q9 and expanded in 1924
and 1459. Tl�e fabric of the neighborhood has remained in tacY, although has become denser due
to the e owth of the high school.
4. The integrity, or authenriciry as e�7denced by a site's location, desi�n, setting, workmanship or
association, is good because die alterations that have occuned, such as tbe removal of the front
porch, alterations to a front and rivo rear �vindou�s, and non-original u�indows and storms aze
easily reversible. Some cracking appears along brick seams and the brick has been painted;
although the original buff=eolared bricks are visible where the porch met the house and
elsewhere where paint has been worn away. There aze still design features intact on this property
like the tower on the southeast comer, stone 1en61s over the front door and windows and
decorative brick detailing. The site's locarion and setting would be considered to have good
integrity.
E. HPC RF,COIVIMEI�IDATiON: The HPC recommeuds that demolition be delayed for this site
in order for alternatives to demolition to be explored, such as mothballing or rehabi]itation.
Additional research should be conducted to better understand and gain appreciation for the unique
vernacular azchitectura] style.

Ordering the owner to remove or repair the building(s) at 639 Htunboldt Avenue within
fifteen (15) days from adoption of resolution.
The property owner of record, Citimortgage Inc/co Associates Financial Svcs, did not appear. No
other parties of interest appeazed.
Mr. Magner stated the building was a two-story, wood fraane, duplex on a lot of 7,405 square feet
and had been vacant since August 8, 2008. A code compliance inspection had been done on June
19, 2009, the vacant building registration fees in the amount of $1,000 went to assessment on
August 8, 2009, and the $5,000 perforxnance bond had not been posted. On June 26, 2009, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on July 20, 2009 with a
compliance date of August 20, 2009. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $43,900 and the building to be $126,200. Real estate
tases for 2009 were delinquent in the amount of $3,609.37. Code Enforcement estimates the cost to
repair the building to be approximately $75,000 to $80,000. The cost for demolition was estimated
to be approximately $8,000 to $10,000. There had also been four sununary abatements issued to
this property since 2008, four of which went to work order: to secure the building and the City had
to board the building to secure it from trespass, remove improperly stored refuse and debris, cut tall
grass and weeds, and remove snow and ice. Code Enforcement recommends the building be
repaired or removed within 1 S days. Mr. Magner said he had no contact from the owners on what
their plans were for this property. He presented photographs.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1900 and was a Queen Anne-style building with painted brick. She said it was a substantial house
on the block, had a corner tower, stone window sills, and the exterior brick deterioration was very
minimal; however, the front and side porch had been removed. While the building itself did not
have any potential as a historic resource to the neighborhood, she strongly encouraged rehab.
Ms. Moermond asked Ms. Spong whether she believed this should be forwarded to the HPC for a
recommendation. Ms. Spong responded affirmatively and said t1�e next meeting this could be
scheduled was November 19.
Ms. Moermond recommended referring this property to the HPC for review and that the Council
public hearing be continued to December 16.
