REA�bepartment of Safety and Inspections has requested the City Council to
hold public earings to consider the advisability and necessity of ordering the repair or wrecking
and removal o a two story, wood frame dwelling located on property hereinafter referred to as
the "Subject Pro rty" and commonly known as 22 DOUGLAS STREET. This property is
legally described a ollows, to wit:

WHEREAS, based up the records in the Ramsey County Recorder's Office and
information obtained by Depart ent of Safety and Inspections on or before Apri12, 2007, the
following are the now known inte sted or responsible parties for the Subject Property: Housing
And Redev Auth/Of The City Of St aul MN, 25 4` Street W, Suite 1400, St. Paul, MN 55102;
West Seventh/Fort Road Federation.
WHEREAS, Department of Safet and Inspections has served in accordance with the
pxovisions of Chaptex 45 of the Saint Paul gislative Code an ordex identified as an "Order to
Abate Nuisance Building(s)" dated January 2008; and
WHEREAS, this order informed the then own interested ar responsible parties that the
structure located on the Subject Property is a nuisa e building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested responsible parties that they must repair
or demolish the structure located on the Subject Property y February 1, 2008; and
WHEREAS, the enforcement officer has posted a pla rd on the Subject Property
declaring this building(s) to constitute a nuisance condition; su 'ect to demolition; and
WHEREAS, this nuisance condition has not been correcte d Department of Safety
and Inspections requested that the City Clerk schedule public hearin before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; d
WHEREAS, the interested and responsible parties have been serv notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the ime, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held befare the Legislative Hearing Officer o the Saint Paul
City Council on Tuesday, March 25 and Apri18, 2008 to hear testimony and evi ence, and
after receiving testimony and evidence, made the recommendation to approve the re uest to

community by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The demolition of the structure to be completed within fifteen (15) days after

April 16, 200 and the testimony and evidence including the action taken by the Legislative
Hearing Officer as considered by the Council; now therefore
BE IT RESOI4,VED, that based upon the testimony and evidence presented at the above
referenced public hean'3�gs, the Saint Paul City Council hereby adopts the following Findings and

period. If all personal p erty is not removed, it shall be considered to be abandoned
and the City of Saint Paul all remove and dispose of such property as provided by law.
4. It is fiuther ordered, that a cop of this resolution be mailed to the owners and interested
parties in accordance with Chapt 45 of the Saint Paul Legislative Code.

The building is a two story, wood frame, single-family dwelling on a lot of 9,148 square feet.
According to our files, it has been a vacant building since September 21, 2006.
The cunent property owner is The Housing and Redevelopment Authority (HRA) of the City of
Saint Paul, per AMANDA and Ramsey county property records.
(No Boardings / No Summary Abatements / No Work Orders issued.)
On December 12, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on January 2, 2008 with a compliance date of
February 1, 2008. As of this date tt�is property remains in a condition which comprises a
nuisance as defined by the legislative code.

and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame dwelling.

4. There are numerous missing outlet/switch cover plates.

Order
Repair the structure to a habitable condition. This structure is a registered vacant
building tkaat must have a Code Compliance Certificate before the structure may
be occupied. Obtain a Code Compliance Certificate from the Departsnent of
Safety and Inspections. You may contact Jim Seeger at D.S.I., 651-266-9016, for
a code compliance inspection, permits, and issuance of Code Compliance
Certificate. Under Chapter 33.03 of the SainY Paul Legislative Code, failure to

obtain a Code Compliance Certificate before occupying the structure may result
in issuance of criminal summons.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by February 1, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, mcluding admmistrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct Yhis nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enfarcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to posf a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the Ciry Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolurion calls for abatement acrion the Council may either order the City to take the
abatement action ar fix a time within which this nuisance must be abated in accardance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, inciuding administrative costs will be assessed against the property as a special
assessment in accordance with law.

The property owner of record, Housing and Redevelopment Authority (HRA), did not appear.
Betty Moran appeared on behalf of the West Seventh/Fort Road Federation.
Mr. Magner stated the building was a two-story, wood frame, single-family dwelling on a lot of
9,148 square feet and had been vacant since September 21, 2006. A code compliance inspection
had not been done, the vacant building registration fees were delinquent in the amount of $625, and
the $5,000 performance bond had not been posted. On December 12, 2007, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on January 2, 2008 with a compliance date of
February 1, 2008. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land
to be approximately $64,800 and the building to be $142,700. Real estate tases were current. Code
Enforcement estimates the cost to repair the building to be more than $75,000. The cost for
demolition was estimated to be approximately $8,229 to $11,229. There had been no summary
abatements issued to this property; however, priar to the HRA's ownership, there were a number of
sutiunary abatement and work orders issued to this property and it was considered a"problem
property" in the neighborhood. Code Enfarcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1885 and was an early Victorian-style house. It had been inventoried as part of the 1983 survey and
the form indicates that it is a"simple, early Victorian house." The integrity was considered good as
it had original windows, the trim and siding were exposed; however, the front porch had been
enclosed. She believed that this structure helped to support 16 Douglas and she was concerned that
if the building were demolished, 16 Douglas would be sitting on its "own little island." She stated
that they had not received the SHIPO form yet, however, she believed they would recommend the
property be surveyed for national historic designation.
Ms. Moermond asked Mr. Magner whether he had any communication from the HRA as to any
plans far this building. Mr. Magner stated that it was his understanding that the HRA was selling
the property to the West 7th/Fort Road Federation.
Ms. Moran stated this property had been an on-going problem for the past 15 to 20 years. The
woman who lived at this house had inherited the property from her parents. She said that this was a
lrnown drug bouse with activities ranging from cocaine to meth. It was her understanding that the
house had been a meth lab and she believed a survey of the interior needed to be done to assess the
contamination and damage that had been done. As far as the exterior of the house, there was a lot
of rotting wood. The Federation did intend to purchase the property and she was requesting the
time to be able to survey the inside and to determine what was best for the redevelopment of this
neighborhood.
Ms. Moermond asked when they anticipated they would acquire the property. Ms. Moran stated
that funds had now been released from Invest St. Paul and she anticipated that they would be
purchasing the property at any time. At the present time, they wanted to move a brick house that
was located on Smith Avenue and they needed to determine where to put this house.

Mr. Magner stated that there was a vacant parcel at 20 Douglas; however, the lot was not wide
enough so 22 would need to be demolished to accommodate the size of the house.
Ms. Moermond stated that since the vacant building registration form was not on file, she would
require that there be a contact listed either through HRA or the Federation. A code compliance
inspection would also need to be done and there were specific requirements on abating a meth lab
that also would need to be done.
Mr. Magner stated that if ineth had been manufactured in this building the house would need to be
sampled by an independent contractor which was rather costly. If the house tested positive far
meth, the Minnesota Department guidelines for clean up would need be followed. Anything in
material fabric would need to be disposed of and if any hazd surfaces could not be cleaned, the
entire house may need to be gutted.
Ms. Moermond reviewed the order to abate and had concern regarding item #9--unapproved post
and beam assembly. She asked Mr. Magner what this meant. Mr. Magner responded that it was a
structural support in the basement.
Ms. Moermond stated that if the recommendation was to allow the building to remain vacant until
such time as the rehab could begin, the building would need to stabilized in the interim.
Specifically, this would include the leaking roof being repaired and the post and beam assembly in
the basement being repaired. She stated that she would need to contact the HRA to see what their
plans were for this property and how to approach a rehabilitation plan. If it is discovered that the
damage caused by the manufacturing of ineth in the building is cost prohibitive to a rehab, they
could decide at that time that the building be demolished.

Mr. Ma�er stated that at the hearing on March 25, the vacant building fees had not been paid, the
registration form had not been submitted, the bond had not been posted, and a code compliance
inspection had not been done. It was also recommended that a plan be formed to determine how to
stabilize the building. To date, he had received nothing.
Ms. Spong stated that the 106 form from SHIPO had not been retumed yet. She recommended
waiting until they receive SHIPO's recommendation on this property before making a decision to
demolish the building.

Ms. Moermond stated that at the April 14 City Council Public Hearing, she will recommend
referring this matter back to the Apri129 Legislative Hearing and May 7 Council Public Hearing.

Ms. Spong stated that the SHIPO form had been returned on March 6; however, she never received
a copy of the letter. The recommendation was that this property would not be eligible for national
historic designation. She had informed them that several properties on Douglas had been surveyed
and were recommended for further survey work. She again expressed concern that 16 Douglas
would basically be an"island by itself."
Betty Moran, West Seventh/Fort Road Federation, stated that since the property had been a former
meth lab, they were requesting the building be demolished.
Ms. Moermond stated that since there was no historical significance to the property and the HRA
had not come forwazd with any plans for this property, she recommended the building be removed
within 15 days with no option for repairs.
