THE COUNCIL OF THE CITY OF SAINT lA UL DOES ORDAIN:
Section 1. That The Zoning Code, Chapters 60 to 64 inclusive
of the Saint Paul Legislative Code, pertaining to Use Districts,
Height Districts and Rezoning of certain properties in the City of
Saint Paul, as amended, be and the same is hereby further amended

so as to rezone the following described property from "B" Residence
District to "C" Residence District:
Lots 11, 12 and 13, Block 4,.Kentucky Terrace
Addition, arbbrdirig to the plat thereof on file
end of record in the office of the Register of
Deeds in and for Ramsey County, Minnesota,
located at the northwest corner of Benson Avenue
and Rankin Street.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the.preservation of the
public peace, health and safety. ,

Section 3. This ordinance shall take effect and be in force
upon its passage, .approval and publication.

Dear Madam:
This is in the matter of the petition of Victor Bruder to reclassify
from "B" residence to "C" residence property located at the northwest
corner of Benson Avenue and Rankin Street. The property is described
as Lots 11, 12, and 13, Block 4, Kentucky Terrace Addition. -The
property is zoned "B" residence and has been since the enactment of
the Zoning Ordinance in 1922.
•On May 9, 1960, the Commissioner of Finance reported the petition
sufficient with 11 of a possible 14 owners (78.6%) of properties
within the required 100 foot radius having signed the petition.
The site is presently vacant and the applicant proposes to develop it
with a 16 unit 2J story apartment building and 16 private off - street
parking spaces. The property has a frontage of 120 feet on Benson
Avenue and 141 feet on Rankin Street, resulting in a total area of
16,920 square feet. North across an ungraded alley are two new single -
family residences fronting on W. Seventh Street; south across Benson
Avenue is the new Torit Manufacturing Company plant; east across
Rankin Street is the new Pearson Candy Company plant; west and adjoin-
ing are two single - family residences fronting on Benson Avenue.
Field investigation discloses no objection to this reclassification
as it will establish a transitional zone between the single - family
residences to the north and west and the industrial uses to the
south and east. The proposed land use plan indicates this area as
well as the properties to the west and north are best suited for
multi - residential use.
In consideration of the above factors, the Board of Zoning recommends
the granting of the petition to rezone the above described property
from "B" to "C" residence.
