O'Connell City Clerk Building Dear Madam: OF SAINT PAUL SAINT PAUL 1, MINNESOTA June 13, 1960 This is in the matter of Ralph Fitzsimons petitioning to reclassify certain property from "B" residence district to a commercial district. This property is located at the northwest corner of Western and Fuller Avenues and is described as Lot 3, Block 6, Mackubin and Marshall's Addition. The zoning classification of this property has been "B" residence since the enactment of the Zoning Ordinance in 1922. The property was developed in 1884 with a two -story frame store building,the first floor being used for retail purposes and the second floor for residential use. Although the first floor retail use of this building is a non - conforming use, the Zoning Code permits the continuance of a similar non - conforming use. It is the intention of the petitioner to establish a one -man saw filing busi- ness on the first floor of this structure which is presently unoccupied. The Board of Zoning at their regular meeting on June 2 determined the reclassification of this property unnecessary for the purpose of con- ducting Chid use, and therefore recommends that the petitioner be per- mitted to withdraw his petition, and that the filing fee be refunded. s Sincerely, C� H.
