WEREAS, In the assessment of benefits, cost, and expenses arising from
the improving of Lafond ,Avenue from Como Avenue to Rice Street, ratified by
the Council on May 11, 1960, by Resolution C.F. 197080, an assessment in the
sum of $420.00 was levied on apcount of said improvement against Lot 4, Block
17, (subject to Lafond Avenue), and the further sum of $420.00 was levied
against Lot 6, Block 17, (subject to Lafond Avenue), all in Morin's Enlargement
of Lafondts Addition to St. Pail;.and
WHEREAS, The record shows that said lots were sold to Fred L. Hensel by
the City of Saint Paul on Junes 24, 1959, said date of sale being a year ,after
the completion of said improvement and ten months prior to the ratification
of the assessment therefor; and
WHEREAS, The Corporation Counsel is of the opinion that in the sale of
said lots to the highest bidder in competitive bidding after the street im-
provements were completed, the!eity was compensated for the full value of
the two lots, including the benefits accruing to the lots by reason of the
improvement, and no further assessment can be levied against said lots for
said improvement; I
THEREFORE BE IT RESOLVED That the assessments totaling $840.00 erroneously
charged be appropriated from Municipal State Aid Suspense Fund and credited
to Assessments Receivable and applied on Lots 4 and 6, Block 17, Morints
Enlargement of L"afondts Addition to St. Paul. -
