1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hoid public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame dwelling and its attached, two stall, with
4 loft garage located on properiy hereinafter referred to as the "Subject Properiy" and commonly
5 known as 992 FRONT AVENUE. This properiy is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before January 7, 2008, the
following are the now known interested or responsible parties for the Subject Property: Equity
One Inc, c/o Populaz Mortgage Servicing, Inc, 121 Woodcrest Rd, Cherry Hill, NJ 08003;
Peterson, Fram & Bergman, 55 E. S St, Suite 800, St. Paul, MN 55101; Tim Forde, 900
Winthrop St. S, St. Paul, MN 55119; District 6 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated April 18, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by May 18, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, July 8, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

WAEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
August 6, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 992 FRONT AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lalown
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparhnent of Safety and
Inspections, VacantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that tkae notification requirements of Chapter 45 have been fulfilled.

fifteen (1S7 days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of tune Department of
Safety and Inspections is hereby auihozized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this tame
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The building is a one and one-half story, wood frame, multi-use dwelling on a lot of 4,792 square
feet.
According to our fi1es, it has been a vacant building since March 26, 2007.
The current property owner is Equity One, Inc. clo Popular Mortgage Servicing, Inc., per
AMANDA and Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been four (4) SiJMMARY ABATEMENT NOTICES since 2007.
There have been three (3) WORK ORDERS issued for:
- Removal of improperly stored refuse
On March 11, 2Q08, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BITILDING was posted on April 18, 2008 with a compliance date of May
18, 2008. As of this date this property remains in a condirion which comprises a nuisance as
defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $1,000.00.
Taxation has placed an estimated market value of $37,800 on the land and $21�,400 on the
building.
As of July 7, 2008, a Code Compliance inspection has not been completed.
As of 3uly 7, 2008, the $5,000.00 performance bond has not been posted,
Real Estate tases are current.
Code Enfarcement Officers estimate the cost to repair this structure is $50,000 to $60,000. The
estixnated cost to Demolish is $11,380 to $15,380.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure witlun fifteen (15) days, ifnot the resolution authorizes the
Division of Code Enfarcement to demolish and assess the costs to the property.

The VacantlNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
992 FRONT AVE
and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On March 11, 2008, a Building Deficiency Inspection Report was compiled and the following
condirions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify speci£c defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($S,OOO.QO) performance
bond with the Bnilding Inspection and Design Office before any permits are
issued, except for a demolition permit.

1. The chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
2. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
3. The exterior walls andlor trim of the house andfor garage has defective,
peeled, flaked, scaled ar chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
4. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
The exterior walls of the house and/or garage are defecrive. Repair all holes,
breaks,loose or rotting siding, to a professional state of maintenance.
6. 5TORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
7. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for ail openabie windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make a11 necessaiy repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
Interior
9. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering wkuch is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
10. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perform a CfQ test on the heating

11. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
12. 'I`he interior ceilings are defective. Repair a]1 ceiling defects and finish in a
professional manner.
l3. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
14. SANITATION: Ymmediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.
The Saint Paul Legislative Code requlres all exterior property areas to be
maintained in a clean and sanitary cond'ation. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
15. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectars in accordance with the attached
requirement, within 24 hours.
16. There is evidence of a rodent infestation. Tinmediately exterminate and
eliminate all rodents from the enrire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to preve�t re-infestation. Immediately remove any dead rodents from
the premises.
17. The stairs have missing or defective handrails. Provide a11 interior and
exterior stairways and steps of inore that three (3) risers with handrails which
are grippable and installed 34" to 38" above the nose of the stair treads.
18. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by May 18, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begn a substanriai abatement process to
demolish and remove the buiidittg(s). The costs of this acrion, including administrative wsts
and demolition costs will be assessed against the property taYes as a special assessment in
accordance with law,

responsibility for this properiy, you must within seven (7) days, nofify tl�e Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condirion", subject to demolition and removal by the City. This placard shall
not be removed wathout the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective acrion is not taken within the time specified in tYus order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a fime within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Pau1 Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
acrion, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

The property owner of record, Equity One Inc. c/o Popular Mortgage Servicing, Inc., did not
appear. Truman Higenbothan appeazed and stated that he was interested in purchasing the pzoperty.
Jim Koran, 988 Front Avenue, appeared and stated that he lived next to this property and wanted to
see it demolished.
Mr. Magner stated the building was a one and one-half story, wood frame, multi-use dwelling on a
lot of 4,792 squaze feet and had been vacant since Mazch 26, 2007. A code compliance inspection
had not been done, the vacant building registration fees were delinquent in the amount of $1,000,
and the $5,000 performance bond had not been posted. On March 11, 2008, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on April 18, 2008 with a compliance date of May
18, 2008. To date, the property remained in a condition which comprised a nuisance as defined by
the Legislative Code. Ramsey County Tasation estimated the mazket value of the land to be
approximately $37,800 and the building to be $217,400. Real estate tases were cunent. Code
Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The
cost for demolition was estimated to be approximately $11,380 to $15,380. There had also been
four suminary abatements issued to this property since 2007, three of which went to work order: to
secure the building and the City had to board the building to secure it from trespass, remove
improperly stored refuse. Code Enforcement recommends the building be repaired or removed
within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond stated that in reviewing the photos, she could see evidence of food, evidence of a
beer party, and cleaning products. She asked whether this property had been subjected to squatters
and other illegal activity. Mr. Magner responded that they had received several complaints from the
neighbors that there was iliegal occupancy of the property. The police also had to intervene to
remove the former occupants of the property as well as other behavioral issues. This property had
caused a lot of strife in the neighborhood.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a 1951
rambler-style house. There were some vacancies on the block and it was located near Calvary
Cemetery. She did not believe demolirion would have an adverse effect on the neighborhood.
Mr. Higenbothan wanted to know who owned the property. Ms. Moermond stated that the only
information that the City had was the listed parties of record with Ramsey County. She gave him
the notice of the public hearings that listed the contact information. She explained that in this
process, since it was a Category III vacant building, he would need to complete the registered
vacant form, pay the vacant building fee in the amount of $1,000, pay the $5,000 performance bond,
he would need to maintain the property, he would need to have a code compliance inspection, he
would need to provide a work plan, and provide financial documentation that he had the $50,000
that the City estimated the cost of the repairs. He would also need to have a signed purchase
agreement.
Mr. Koran stated that he lived next to this property and he wanted to see the building demolished. It
was his understanding that someone wanted to purchase the property which he was highly opposed
to as he believed the property would continue to be a problem in the neighborhood. He also wanted

Mr. Higenbothan responded that he had a landscape design business and wanted to run his business
from the lower unit and live in the upper part of the house.
Ms. Moermond stated that since this had been a long-term problem property, she would require all
condirions as stated above be met by Monday, July 28. If all the conditions were met, she would
recommend continuing the legislative hearing to July 29; however, she would not consider delaying
the August 6 Council Public Hearing.
Mr. Higenbothan called Mai V ang a8er the hearing and indicated that he had looked at the property
and was not interested in purchasing this property.

We aze writing to you to voice our concerns over the property that is located directly
across the alley from us. The address of this property is 992 Front Street, St. Paul, MN
55103.
Since the last owner took ownership in 1996, this has become a neighborhood eyesore.
We have experienced a repetitive cycle of problems with the owner. There haue been
numerous times that we were unable to get in or out of our garage due to the amount of
vehicles and trash that were behind the property in the alley. The owner allowed people
of ill repute to stay and live there. The building as it stands currently needs repair and is
a health hazard.
Furthermore, this property in its current state is bringing down the property values in the
neighborhood.
We are asking that the structure be demolished and the land be put up for sale. We are
concerned that with the state the structure is in cunently, any purchaser will repeat the
cycle of destruction.
