RESOLUTION
1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two story, wood frame dwelling located on property hereinafter referred to as
4 the "Subject Property" and commonly laiown as 903 BURR STREET. This property is legally
5 described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recarder's Office and
information obtained by Departxnent of Safety and Inspections on or before January 7, 2008, the
following are the now known interested or responsible parties far the Subject Property: Dr.
Gabriel Peal c/o A1 Ireland, 2229 Charles St N. St. Paul, MN 55109; Dr. Gabriel Peal, 19 Talais
Dr, Little Rock, AR 72223; First Franklin, 2150 N. 1 St, San Jose, CA 95131; Payne Phalen
District 5 Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with tke
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated April 16, 2008; and
WHEREAS, this arder informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by May 16, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
deciaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, July 8, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (1� days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
August 6, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul Caty Council hereby adopts the following Findings and
Order concerning the Subject Property at 903 BURR STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolirion.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

safe and not detrimental to the public peace, health, safety and welfare and remove its

2. If the above corrective action is not completed within this period of time Department of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The building is a two story, wood frame, single-family dwelling on a lot of 6,534 square feet.
According to our files, it has been a vacant building since May 1, 2007.
The current property owner is Dr. Gabriel Peal, per AMANDA and Ramsey counry properry
records.
The city has had to board this building to secure it from trespass.
There have been ten (10) SUMMARY ABATEMENT NOTICES since 2007.
There have been ten (10) WORK ORDERS issued for:
- Removal of improperly stored tefuse
- Removal of tall grass and weeds
- Bcarding
On March 20, 2008, an inspection of the building was conducted, a list of deficiencies wYuch
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on April 16, 2008 with a compliance date of
May 16, 2008. As of this date this property remains in a condition which comprises a
nu3sance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $1,000.OQ.
Taxation has placed an estimated market value of $40,000 on the land and $100,000 on the
building.
As of April 8, 2008, a Code Compliance inspection has been completed.
As of April 3, 2008, the $5,000.00 performance bond t�as been posted.

Code Enforcement Officers estimate the cost to repair this structure is $70,000 to $80,000.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On March 20, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspecrion must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspecrion will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy untal such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

ORDER:
Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance
Certificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Department of Safety and Inspections. You may contact Jim
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of Code Compliance Certificate. Under Chapter 33.03 of the Saint Paul
Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal siunmonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by May 16, 2008 the Deparhnent of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property talces as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete

The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the Ciry. `I`his placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. 'I'he department is further required to file a copy of this "Order
to Abate" with the Ciry Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will nofify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolufion calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and prov9de that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrarive costs will be assessed against the property as a speciai
assessment in accordance with law.

Pursuant to your request the above-referenced property was inspected and the following report is
submitted:
BUILDING
1. Front landing is too low. Maximum 7 3/4" from front landing to floor in house.
2. Install handrail on front steps to code.
3. Repair fence or remove.
4. Clean basement of all mold and mildew and have tested by a testing lab. Submit report
to City DSI deparhnent.
5. Replace lower basement stairs to code.
6. Remove all rotted and moldy materials from basement.
7. Install ventilation for second floor bath to code. Requires ventilation permit.
8. Install handrail on rear step to back door.
9. Insure basement cellar floor is even, is cleanable, and all holes are filled.
10. Install hand and guardrails on all stairways and steps, including basement, as per attachment.
11. Install plinth blocks under posts in basement.
12. Tuck Point interior/exterior foundation.
13. Install tempered glass in window on stair landing to code.
14. Provide thumb type dead bolts for all enh doors. Remove any surface bolts.
15. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
16. Provide complete storms and screens, and in good repair for ail door and window openings.
17. Repair walls and ceilings throughout, as necessary.
18. Re-Ievel shucture as much as is practical.
19. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).

ELECTRICAL
1. Ground the electrical service to the water service within 5'of the entrance point of the water service.
2. Provide a complete circuit directory at service panel.
3. Verify that circuit breaker amperage matches wire size. Install 15 amp breaker on #14 wire.
4. Ground bathroom light in basement, first and second floor bathrooms and disconnect receptacle
on fixture.
5. Remove all card wiring in basement.
6. Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers and plates.
7. Check all 3-wire outlets for proper polarity and verify ground.
8. Remove any 3-wire ungrounded outlets, and replace with 2-wire, or ground 3-wire to code.
9. Throughout building, install outlets and light fixtures, as specified in Bulletin 80-1.
10. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and other smoke
detectors as required by the IRC.
11. All electrical work must be done by a licensed electrical contractor under an electrical permit.
12. Any open walls or walls that are open as part of this project must be wired to the standards of the
2005 NEC.
13. New bedroom outlets need to be on an AFCI breaker.
PLUMBING
All plumbing work requires permit(s) and must be done by a plusnbing contractor licensed in
Saint Paul.
Basement:
1. Water heater is not fired and not in service.

Felicia Tolbert-Ireland appeazed and stated that she was appearing on behalf of her cousin, Dr.
Gabriel Peal, the properiy owner.
Mr. Ma�ner stated the building was a two-story, wood frame, single-family dwelling on a lot of
6,534 square feet and had been vacant since May 1, 2007. A code compliance inspection had been
done on Apri18, 2008, the vacant building registration fees were delinquent in the amount of
$1,000, and the $5,000 performance bond had been posted on Apri13, 2008. On March 20, 2008,
an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on April 16, 2008 with
a compiiance date of May 16, 2008. To date, the property remained in a condition which comprised
a nuisance as defined by the Legislative Code. Ramsey County Tazation estimated the market
value of the land to be approximately $40,000 and the building to be $100,000. Real estate taaces
were current. Code Enforcement estimates the cost to repair the building to be approximately
$70,000 to $80,000. The cost for demolition was estimated to be approximately $8,900 to $11,900.
There had also been 10 snmmary abatements issued to this property since 2007, 10 of which went to
work order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse, boarding, and cut tall grass and weeds. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1899 and was a Victorian-style building. There was a loss of integrity with the siding been covered,
the porch had been removed, and the windows on the first floor had been altered. The building did
not have any historic value; however, it was on a corner lot and there were many important
properties in close proximity. It was also located on a contiguous block face and she expressed
concem if the house were demolished, it would create a negative impact on the neaghborhood.
Ms. Ireland stated that she had suggested to her cousin that he purchase this property because it was
Section 8, it appeared to be in good condition, and would be a good source of steady revenue. The
tenant who was living there when Dr. Peal purchased the property had five kids and she kept the
house terribly filthy. She had lured people to maintain the property which included mowing the
lawn, shoveling the snow, and keeping everything clean. She claimed that they had put too much
money into the house already and she didn't believe anything was wrong with the building. She did
not want to put in an addirional $70,000 into repairs that the City estimated the cost to be. She had
also spent $5,000 to pay the bond. If the City wanted to demolish the building, that was fine.
Ms. Moermond stated that the property was not being maintained in that the City had issued 10
surmnary abatement orders all of which went to work order. She suggested that she and Dr. Peal
consuit an attorney on this matter. In order to grant fime to make the repairs, she would require the
following conditions be met by July 29: 1) the property must be maintained; 2) the vacant building
registration fees in the amount of $1,000 needed to be paid; 3) a work plan needed to be done in
accordance with the code compliance inspection; and 4) financial documentarion indicating the
funding to complete the repairs. Ms. Moermond also suggested that they could sell the property to
someone who was capable of doing the rehab. Since the bond had been posted in April and there

was only three months left to complete the repairs under th bond, she asked M Magner what the

Mr. Magner responded that generally, if a short axnount of rime had gone by from the tune the bond
was posted and the Council then recommended the building be demolished, the owner needed to
make a written request to have the bond returned. In this particular case, since three months had
gone by and nothing had been done to make repairs, he believed the Department would keep the
bond unless language was included in the resolution specifically requesting the bond be returned.
He pointed out that since Dr. Peal had purchased the property in 2006, the City has done 23 work
orders on the property. He believed tkris was an exorbitant amount of City services to one
individual property at the expense of the taspayers. The property was also illegally occupied and
there was one complaint of a dog biting someone. Mr. Magner also stated that he had received two
phone calls concerning this property; one being from the mortgage company and one from the
security company, wanting to know what needed to be done. He indicated to them that they would
need to obtain a copy of the code compliance inspection, pay the vacant building fees, and obtain
the necessazy permits to do the work.
