BE IT RESOLVED, that the Council of the City of Saint Paul, based on a review of the legislative
hearing record and testimony heard at public hearing on 7uly 16, 2008 hereby memorializes its decision to
certify and approve the July 8, 2008 decision of the Legislative Hearing Officer for the following address:

UNFIT FOR HUMAN HABITATION AND
ORDER TO VACATE

Dear Sir or Madam:
The Department of Safety and Inspections, Division of Code Enforcement, has deterxnined that
the dwelling and premises at 1036 MINNEHAHA AVE W is "L3nfit for Human Habitation°. In
accordance with Saint Paul Legislative Code, Chapter 34, Section 23, the premises will be
placarded on June 10, 2008 and ordered vacated no later than June 16, 2008.
Your attention is called to the following provisions of Section 34.23, Subsection 6 entitled,
"Vacation of Structure or Unit":
"Any residential structure or residential unit which has been condemned or
placarded as unfit for human habitation shall be vacated within the time set forth in
the placard andJor order. It shall be unlawful for any person to let to any person for
human habitation any structure or unit so condemned or placarded, and no person
shall occupy the structure or unit after the date set forth in the placard and/or
notice."
THIS DWELLING SHALL NOT AGAIN BE USED FOR HUMAN HABTTATION
UNTIL WRITTEN APPROVAL IS SECURED FROM THE CITY OF SAINT PAUL;

consritute material endangerment or which threaten the peace, health, safety or welfare of the

All repairs and new installations must be made in accordance with the appropriate codes. Permit
information may be obtained from the Building Inspection and Design Section, 8 Fourth Street,
#200, Commerce Building, (651) 266-9090.
You may file an appeal to this notice by contacting the City Clerk's Office at (651) 266-8688.
Any appea7 must be made in writing witivn 10 days of the date of this notice.
It is the responsibility of the property owner to keep all buildings secured and to properly
maintain the premises at all times.

Dear Sir or Madam:
The City of Saint Paul, Deparlxnent of Deparhnent of Safety and Inspections has inspected the
above referenced properry on June 03, 2008 and has determined that the following deficiencies
exist in violation of the Saint Paul Legislative Code
Lack of Electricity. Immediately restore electrical service. Failure to provide
proper electrical service will result in these premises being declared Unfit for
Human Aabitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension cord wiring is not permitted while the
power is off.
You aze hereby notified to correct these deficiencies in accordance with the appropriate codes.
The Enforcement Officer will reinspect these premises on or after June 09, 2008, by which date
the violations noted must be corrected. Failure to correct these deficiencies may result in the
issuance of criminal charges andlor a civil lawsuit, and possible abatementlassessment by the
City. All repairs and new installations must be made in accordance with the appropriate codes.
Permits may be obtained by calling 651-266-9090.
You may file an appeal to this notice by contacting the City Clerk's Office at 651-266-8688. Any
appeal must be made in writing within 10 days of this notice. (You must submit a copy of this

1. Appeal of Jenneh Matthews to a Notice of Condemnation and Order to Vacate for property
at 1036 Minnehaha Avenue West
Ms. Moermond noted that the inspector received this meeting notice from the City Clerk's office
and the inspector did not understand that she needed to be here far the hearing. Ms. Moermnd
informed Ms. Matthews that she needs to discuss what is going on here.
Ms. Moermond questioned Ms. Matthews as to whether she lives at 1036 Minnehaha Avenue West.
Ms. Matthews answered that she is living with friends and has been out of the house since April.
Ms. Matthews has three children, ages 16, 14, and 2-1/2; they have been living elsewhere. She
explained that she had just gotten a job on Friday. Ms. Moermond asked Ms. Matthews how much
she owes in utility bills; Mr. Matthews responded $2,000. Ms. Matthews owns the property. Her
mortgage payments are current. She has been in the house since 1990 and has never before had the
power shut off.
Ms. Matthews stated she cannot understand why her house was condemned. Ms. Moermond noted
that the City ordered that the utilities be restared. Ms. Moermond queried Ms. Matthews as to when
she plans to move back into the house. Ms. Matthews answered that she will move back in when
she is able to pay the utility bill.
Ms. Moermond explained that because Ms. Matthews is not living there, the house could become a
Registered Vacant Building. She indicated that she would like to give Ms. Matthews the chance to
get the power restored. She encouraged Ms. Matthews to contact Xcel Energy to work out a
payment plan and to contact emergency assistance organizations. She suggested Ms. Matthews
should inquire about financial assistance and counseling. Ms. Moermond suggested she contact
Kay Wittgenstein, with the House Calls program, and SMRLS' representative working with shut-
offs.
Ms. Moermond stated that she will hold this at bay for some weeks on the condition that Ms.
Matthews does not occupy the property. She stressed that Ms. Matthews and her children continue
not to live there. She emphasized that Ms. Matthews contact the suggested organizations. Ms.
Moermond stated that she will set this up for another legislative hearing on July 8, 2008 at 3:00 p.m.

Ms. Moermond noted that Tnspector Booker was present; Ms. Matthews, the property owner, was
not present.
Ms. Booker stated that Kay Wittgenstein, from the House Calls, called her and stated that the
Xcel Energy has been paid. She added that she had not heard from the property owner. Ms.
Booker also stated that she had sent the placard removal letter, as the house is no longer
condexnned.
Ms. Moermond noted that the Department has removed the Notice of Condemnation and Order
to Vacate.
