peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclu-
sive of the Saint Paul Legislative Code, pertainingtD Use Districts
Height Districts and Rezoning of certain properties in the City of
Saint Paul, as amended, be and the same is hereby further amended
so as to rezone the following described property from "A"
Residence District to Commercial District:
Lots 1 and 2. Block 1, Birmingham Park,
according to the plat thereof on file
and of record in the office of the
Register of Deeds in and for Rams
County, Minnesota, located at the' south-
west corner of Case and White Bear Avenues.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
public peace, health ,and safety.
Section 3. This ordinance shall take effect and be in
force upon its. passage, approval and publication.

Dear Madam:
This is in the matter of the petition of Frances A. Lalla to rezone from "A"
residence to commercial property located at the southwest corner of Case
and White Bear Avenues. The property is described as Lot 1 and 2, Block 1,
Birmingham Park. The zoning is "'A" residence and has been since the enact -
ment of the Zoning ordinance in 1922.
On April 22,'1960, the Commissioner of Finance reported the petition sufficient
with the owners of 9 of a possible 13 (69 %) tracts of land within the required
100 foot radius having signed the petition. The northeasterly portion of this
tract was developed in 1915 with a store building. This store was established
as'a legal use, but since the enactment of the Zoning Ordinance in 1922, it has
been and presently is a non - conforming use. The building occupies approximately
15% of the site. The first floor of the store building is being used for
commercial purposes, and the second floor for residential purposes. The
applicant proposes to develop the remaining portion of this property with a
small dairy ice cream store and off - street parking to serve the existing and
proposed commercial uses.
The property under consideration has a frontage along Case Avenue of 76.55
feet and a frontage of 100 feet along White Bear Avenue, resulting in an area
of 7,655 square feet. Directly west and adjoining is a single - family residence
which fronts on Case Avenue, farther west are four recently constructed 2j story
apartment buildings which also front on Case Avenue; south and across a public
alley is commercially zoned property which is vacant except for a billboard;
east across White Bear Avenue at the southeast corner of Case and White Bear
Avenues is a Masonic Lodge building; diagonally across the same'intersection
is a single - family residence which fronts on Case Avenue; north'and across
Case Avenue is the Ames school grounds. Field investigation discloses that
the surrounding area is predominately residential in character. The proposed
land use plan indicates that the highest and best use of this property would
be for single and two - family residential use.
The Board of Zoning considered this matter at their meeting on June 14, 1960,
and recommends the granting of the . petition to rezone the above described
property from "A" residence to commercial.
