RESOLVED, that upon appeal of Minnesota State Building
Corporation from the decision of the Commissioner of Parks and
Recreation and Public Buildings, and upon the favorable recommendation
of the Board of Zoning, the commercial use authorized on a portion of
the following described real property:
Lots 13, 14, 15 and 16, Block 64, West St. Paul (also known
as West St. Paul Proper) except the south on§ (1) foot
thereof; and except that part of Lot 13 described as
'follows: Commencing at a point where the line between
Lots 13 and 14 intersects the southerly line of Concord
Street; thence south on said division line 120 feet;
thence west at right angles to said division line 50
feet to division line between Lots 12 and 13 in said
Block 64; thence north on the division line between
Lots 12 and 13 to the southwesterly line of Concord
Street; thence southeasterly on the southwesterly line
of Concord Street to place of commencement of excepted
tract, according to the plat thereof on file and of
record in the office of the Register of Deeds in and for
Ramsey County, Minnesota, located at the southwest corner

is hereby extended to the entire site , and permission is hereby given

Dear Madam:
This is in the matter of the appeal of the Minnesota State Building Corpor-
ation for the extension of a commercial use permitted.on a portion of a
tract to extend to the entire site on property located at the southwest
corner of South Robert and Concord Streets. The legal description of the
property is attached.
Lots 13 and 14 are presently occupied with multi - family residential structures
which front on Concord Street. Until recent years, Lots 15 and 16 were devel-
oped with a flower and greenhouse business which has now been removed. They
,are presently vacant. The applicant has submitted a plot plan indicating
an interest in developing this property for a motel and restaurant business.
This property is an irregularly shaped tract of land with a frontage of 280.4
feet along Concord Street and 119.13 feet along Robert Street and a total
area of approximately 43,240 square feet (about one acre). This property is
at the street level of Concord Street to a depth of approximately fifty feet,
its elevation then rises approximately 12 feet to a plateau of about fifty
feet in width, and then increases at a steep slope to the south.
The Concord street frontage is now classified commercial to a depth of
100 feet, and the remaining portion carries a classification of "B" residence.
In order to use the entire site for commercial purposes, it is necessary to
secure Council approval under Chapter 64.03, par. "a ".
North across Concord Street, and east across Robert Street are commercial
activities; west and adjoining is the Riverview Commercial club which fronts
on Concord Street; south and adjoining at the top of the bluff, is the Wilder
Foundation properties now being developed for nursing home purpose. Field
investigation discloses no objection to the extension of the commercial use.
The proposed land use plan indicates that this property could be used in its
entirety for commercial purposes.
In consideration of the above factors, the Board of Zoning recommends the
granting of the appeal to extend the commercial use permitted on a portion
of the above described property to extend to the entire site.

The undersigned does hereby submit a petition to the Council of the City
of Saint Paul, Minnesota, to extend the zoning for commercial purposes for the
entire real estate hereinafter described, and respectfully submits the following
information:

2. The legal description of the property involved is:

land is now vacant.
5. The proposed use of said property by a prospective purchaser thereof is
stated as being a luxury type motel. That your petitioner herein has
entered into an earnest money contract for the sale of said premises
with said person and that said contract is contingent upon your petitioner
obtaining an extension of the zoning of all of said property for com-
mercial purposes.

6. The purpose of this appeal is to have the commercial zoning of a portion
of said property extended to the entire property.
7. That this appeal is needed for the proper and early development of this
property for its highest and best use. That nearly all of the property
in the area is now being used for commercial purposes and that the
granting of this application would benefit the entire immediate area.
8. That this appeal is taken under Section 64.03 a of the zoning code of
the City of Saint Paul, Minnesota, which provides as follows:
ItWhere a use district boundary line divides a lot in a single
ownership permit a use authorized on either portion of such
lot to extend to the entire lot's.
9. That submitted herewith are two copies of a survey of said premises
which disclose the property lines and dimensions.
10. That the proposed grades in relation to streets, location and size of
proposed buildings, type of proposed use, and area of proposed off -
street parking will all conform with the requirements of the various
ordinances regulating the same now in effect in the City of St.Paul,
Minnesota.
