I .j RESOLVED, That the proper City officials, are hereby authorized and instructed to enter into an agreement between the City of St. Paul and the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, under which agreement, along with other provisions, the'Railroad Company agrees to contribute $92,951, payable in two annual installments to,the City of St. Paul, in connection with the construction of an overhead grade separation structure which will carry Hemline Avenue across the railroad tracks and across the Short Line Road highway between Selby and Ashland Avenues in the City of St. Paul, the estimated cost of the bridge project, with approaches and interchange connections, being approximately $460,000, the Railroad Company further agreeing to grant to the City of St. Paul an easement for highway purposes on a portion of its right of way between Hemline Avenue and Lexington Avenue, subject to compensation to the Railroad Company for such right of way acquired by the City under condemnation proceedings as provided by the City Charter and State law, the City share of the cost of the project being payable from Bond Fund 200, Projects ST -9 and ST -29, and from Minnesota State Aid Project No. 145; and be it FURTHER RESOLVED, That the Commissioner of Public Works is hereby authorized to apply to the Minnesota Railroad and Warehouse Commission for approval of the plans and specifications for the construction of the aforementioned overhead grade separation structure.
