the Commissioner of Public Utilities
and the Corporation Counsel, in the

RESOLVED, by the Council of the City of Saint Paul, upon
due consideration of the report and recommendations of the Commissioner
of Public Utilities and the Corporation Counsel, in the premises, that
the proposed Stipulation by and between the Plaintiff, the Defendants,
and the Intervenor in that certain pending Ramsey County, Minnesota,
District Court case entitled Northern States Power Company, Plaintiff,
vs. City of Saint Paul, et -al., Defendants, and Dan Gephart, Intervenor,
providing for the full and final compromise and settlement of all
controversies by and between said parties involved in said action,
imposing upon said Plaintiff the obligation to make refunds of increased
charges for natural gas supplied within the City of Saint Paul by said
Plaintiff to its consumers, based upon the three separate increases in
said Plaintiff1s purchase cost of natural gas from Northern Natural
Gas Company, mentioned in said Stipulation, and passed on by said
Plaintiff by way of increased rates to its said consumers as and to the
extent that such refunds shall be ordered-and required by federal Power
Commission or by a court of competent jurisdiction, hereby ie approved
and authorized, and the Corporation Counsel hereby is authorized and
directed to execute said proposed Stipulation, in said pending civil
action, in behalf of the City of Saint Paul, et al., Defendants; and be it
FURTHER. RESOLVED 'that the proposed Order of said District Court,
'pursuant to said Stipulation, providing, among other things, for the
dismissal of .,,said civil action, hereby is approved, and the Corporation
Counsel hereby is authorized, in behalf of said Defendants, in said action,
to assent to the entry of the same, together with final judgment in
accordance with said Stipulation and Order.
