08-789Council Fi1e #� Green 5heet # U RESOLUTION OF SAINT PAUL, MINNESOTA Presented by �9 1 WHEREAS, Melushad Parsakalleh has submitted an application on behaif of the St. Paul Caty 2 HalURamsey County Courthouse at 15 W. Kellogg blvd. for an exception to the general hours of operation 3 for the pedestrian skyway system. That application requests an exceprion to the general hours of operation 4 for the portion of the skyway leading from bridge # 32, allowing the building to have the hours of 7:00 5 a.m. to 5:00 p.m., Monday through Friday except legal holidays; and 6 7 WHEREA5, Chapter 14011(b) of the Saint Paul Legisiative Code give the Council the power to 8 grant such exceptions; and 9 10 WHEREAS, the St. Paul City Ha1URamsey County Courthouse is a destination point within the l 1 pedestrian skyway system and does not lead to other buildings, residences or retail businesses; and 12 13 WFIBREAS, any person entering the St. Paul City HalURamsey County Courthouse must first pass 14 through security which includes a metal detector and/or photo identification; and 15 16 WHEREAS, the offices within the buiiding are closed outside of the proposed hours, however, 17 there are public meetings that take place within the building after office hours; and 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 WI3EREAS, the Council may reconsider the exception to the general hours if the circumstances change; and WI�EREAS, the Skyway Advisory Committee considered this application and recommended approval subject to the condition that "the skyway must remain open 30 minutes after the end of any public meering held at the City HalllCourthouse"; and WHEREAS, the Council held a public hearing on the application for an exception on July 16, 2008 at which time the Council heard a recommendation from the Department of Safety and Inspecrions, the applicant was given an opportunity to speak, and public testimony was allowed; now therefore be it RESOLVED, that the Council hereby finds that the proposed hours of operation are reasonable far the above-stated reasons and approves the alternate hours of �:00 am. to 5:00 p.m., Monday through Rriday except all legal holidays with the following condition: 34 35 36 37 38 Andbeit 39 40 41 • The doors to and from skyway bridge number 32 must be equipped with a device that aliows egress into the skyway system from the building for the public for thirty (30) minutes after any public meeting. �� -�g� 42 FURTHER RESOLVED, that the above condition must be met within 60 days. If the building 43 cannot meet the condition within 60 days, then a representative must appear before the Council to explain 44 why such a condifion, has not been met and offer alternatives to the above condition to the Council; and be 45 it 46 � 47 FINALLY RESOLVED, that the Council may reconsider the exception to the general hours of 48 operation if the circumstances that gave rise to the exception change. 49 50 A copy of this resolution, as adopted, shall be sent by first class mail to the applicant.
