O'Connell City Clerk Building Dear Madam: This is in the matter of the appeal of the Cherokee Agency Inc. to extend to the entire site the commercial use permitted on a portion of the site on property located on the west side of Smith Avenue be- tween King and Stevens Streets, and described as all of Lot 7, and the south 50 feet of 'Lots 1 thru 6, Block 26, Balme's Addition; also Lot 6, except the south 100 feet thereof, Marion Addition. The property is zoned commercial to a depth of 100 feet west of Smith Avenue (this amounts to about 73% of the tract), the balance is "B" residence and has been since the adoption of the Ordinance in 1922. The property under consideration was formerly developed with a single - family dwelling which has recently been removed for the proposed addition of a drive -in banking facility and off-street parking lot for the Cherokee State Bank. In order to develop the site as proposed, the applicant is appealing to the Council pursuant to Chapter 64.03, paragraph "a" of the Zoning Code. This is an irregularly shaped tract of land having a frontage on South Smith Avenue of 88.58 feet and extending to an average depth of about 150 feet which results in an area of approximately 11,774 square feet. North and adjoining is a single - family residence which fronts -on South Smith•Avenue; west and adjoining is the rear yard of a two - family residence which fronts on Ottawa Avenue; south and adjoining is a single - family resi- dence which fronts on King Street; also the existing Cherokee State Bank; east and across South Smith Avenue are commercial uses and one single - family residence all of which front on South Smith Avenue. Field investigation discloses no basic objection to the extension of the commercial use in that the elevation of this property when improved accord- ing to the applicant's proposal, will be approximately six to eight feet below the grade of the adjoining residential properties. It is the opinion of the Board of Zoning that the granting of this appeal will not deviate "_.substantially from the purpose and intent of the Ordinance. In consideration of'th'e above factors, the Board of Zoning recommends the granting of the above described appeal in accordance with plans approved June 14, 1960. HCW:FGI Encl. The parking lot is in- tended to be used for customers of the Cherokee State Bank at this location. We feel that the offstreet parking is necessary to avoid traffic congestion in the area and we wish to make use of the property as shown on the attached plot plan. The name of the applicant is Cherokee Agency, Inc., Mr. Russell Gesell, President, located at 607 South Smith Avenue, St. Paul 7, Minnesota. The Legal'Description of the Property is as follows: All of Lot #7, and the South 50' of Lots #1 to #6, inclusive, Block #26 - Balme's Addition. All of Lot #4 and the East 35' of,the South 100' of Lot #5 and all of Lot #6 except the South 100' thereof, Marion Addition, St. Paul, Minnesota. This appeal is made under Section 20-a of Building Zone Ordinance No. 58+0, because the use district boundary line divides the property and we wish to extend the commercial zoning to the entire property as stated above.
