That 3 application requests an exception to the general hours of operation for the portion of the skyway leading 4 from bridge number 1, allowing the building to have the hours of 6:00 a.m. to 8:00 p.m. daily; and 6 WHEREAS, Chapter 140.11 (b) of the Saint Paul Legislative Code give the Council the power to 7 grant such exceptians; and 8 9 WIIEREAS, St. Joseph's Aospitai is a destination point within the pedestrian skyway system and 10 does not lead to other buildings that are open to the public; and 11 12 WHEREAS, St. Joseph's Hospital is not a part of the main pedestrian skyway system and connects 13 only to two other buildings; and 14 15 WHEREAS, skyway access if through a sensirive azea with "surgical and radiological" equipment; 16 and 17 18 WHEREAS, the Skyway Advisory Committee considered this application and recommended 19 approval of the application; and 20 21 WHEREAS, the Council may reconsider the exception to the general hours if the circumstances 22 change; and 23 24 WHEREAS, the Council held a public hearing on the application for an exception on July l6, 2008, 25 at which time the Council heard a recommendation from the Department of Safety and Inspections, the 26 applicant was given an opportunity to speak, and public testimony was allowed; now therefare be it 27 28 RESOLVED, that the Council hereby finds that the proposed hours of operation are reasonable for 29 the above-stated reasons and approves the alternate hours of 6:Q0 a.m. to 8:Q0 p.m. daily; and be it 30 31 FURTHER RESOLVED, that the Council may reconsider the exception to the general hours of 32 operation if the circumstances that gave rise to the exception change. 33 34 35 36 37 38 39 40 41 42 � . :� 43 A copy of this resolution, as adopted shall be sent by first class mail to the applicant.
