Whereas, John Lewandowski, an em-
ploye of the Department of Public
Works of the City of Saint Paul, was
injured on September 4, 1958, in a
third party accident, while engaged
in the performance of his duties for the
Department of Public Works, and the
City has incurred medical expenses in

WHEREAS, John Lewandowski;' an- employe of the Department
of Public Works of the City of Saint Paul, was injured on September 4,
1958, in a third party accident, while engaged in the performance
of his duties for the Department of PublicWorks, and the City has
incurred medical expenses in the total amount of $1,643.45 therefor,
and the employe, by reason of said injury, was disabled for work
for a total of 73 weeks to date, being paid workmen's compensation
in the amount of $3,285 therefor; and
WHEREAS, a settlement has been negotiated by the parties
in the total amount of $9,000, and the law firm of Douglass, Sheets
8 Bell, attorneys representing the employe John Lewandowski and the
City in the third party action, is in possession of a draft of
Mutual Cremmery InsuranceCompany for that amount, and made payable
to the City of Saint Paul, on behalf of their assured the third
party involved in said accident; and
WHEREAS, from said total settlement of $9,000, there is
offered to the City for its subrogation interest a settlement in
amount of $4,000, less attorneys' fees and one -half the costs for

the City will pay the outstanding medical bills, one from Dr.
Frank Babb in the amount of $60.00, and one from Dr. Wallace
Ritchie in the amount of $387.00; and
WHEREAS, it is the recommendation of the office of the
Corporation Counsel that said settlement, because of the seriots ness
of the employee's injuries and in view of the amount of the total
settlement agreed upon, be accepted by the City in full payment
of its subrogation interest in this matter, only for fund; expended
to, date,

RESOLVED, That the proper City officers are hereby
authorized to accept said settlement of $4,000, less one - fourth
or $1,000 for attorneys' fees, and less one -half the costs in-
curred by attorneys, or $55.22, a net amount of $2,944.78, in
full payment of its subrogation interest by reason of the injury
r of its employe, John Lewandowski, in said third party accident
of September 4, 1958, only for funds expended to date; and be it
FURTHER RESOLVED, The proper City officers are hereby
authorized and instructed to execute any necessary releases, and
the Commissioner of Finance is hereby directed to endorse for the
City the $9,000.00 draft of the Mutual Creamery Insurance Company
made payable to the City of St. Paul, upon receipt of the draft of
Douglass, Sheets & Bell payable to the City in amount of_$2,944.78,
the latter amount representing the City's subrogation interest in
said third party accident; and be it
FARTHER RESOLVED, The proper City.officers are hereby
authorized and directed to pay the outstanding medical bills: to
Dr: Frank Babb-the amount of $60.00 and to Dr. Wallace Ritchie the

FURTHER RESOLVED, That the full amount of the City's
