THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section =,.l, —That- the -Zoning .Code•,-Chapters - 60 -to 64-- inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "A" Residence District to "C" Residence District: •Lots 10, 11 and-12, Block 2, Dawson's Lake Como and Phalen Avenue Addition to the City of St. Paul, Ramsey Co., Minnesota, according to the plat thereof on file and of record in the office of the Register of Deeds F in and for Ramsey County, Minnesota, situated on the south side of Larpenteur Avenue between Agate and Adolphus Streets. Section 2. This ordinance'is hereby declared to be an emergency ordinance rendered necessary for the preser- vation of the public peace, health -and safety. Section 3. W. Gregory to rezone from "A!" to "C" residence property located on the south side of Larpenteur Avenue between Agate and Adolphus Streets. The property is described as Lots 11, 10, 12, Block 2, Dawson's,Lake.Como and Phalen -Ama=e Addition. The zoning is "A" residence and has been since the adoption of the Ordinance in 1922. On December 18, 1959, the Commissioner of Finance reported the petition suffi- cient; that the owners of 11 of a possible 12 (91 %) parcels of land within the prescribed 100 foot radius of the property under consideration bad signed the petition. The petitioner is the owner of-all of the frontage petitioned to be rezoned. The property under consideration is vacant, and the applicant proposes to develop it with an apartment building., The property has a frontage of 120 feet along East Larpenteur Avenue and extends to a depth of 124.94 feet, resulting in a total area of 14,993 square feet. The siteis approximately eight feet below the Larpenteur Avenue street grade. North across Larpenteur Avenue in the Village of Maplewood is an area which is being developed with single - family residences; south across an unimproved alley are single - family residences fronting along East Wheelock Parkway; east and adjoining is vacant -land, farther east is the Mississippi Street Freeway which is under construction and which is depressed below the Larpenteur Avenue Street grade; west and adjoining is vacant land, farther west are three single- family residences fronting on Larpenteur Avenue. Field investigation discloses that the highest'and.best use of the property would be for'single and two- family residential use and the proposed land use plan indicates it should be so developed. It is the opinion of the Board that to reclasify it would constitute "spot zoning ". The granting of this petition would deviate substantially from the purpose and intent of the Zoning Code and failure to do so would not create a hardship on the petitioner as the land could be developed in accordance with the proposed land use plan. In consideration of the above factors, the Board of Zoning recommends the denial of the petition to rezone from "A" to "C" residence the above described property. Sincerely, K �� A. C.
