WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, stucco eight unit structure located on property
hereinafter referred to as the "Subject Property" and commonly known as 500 SHERBURNE
AVENUE. This property is ]egally described as follows, to wit:

following are the now known interested or responsible parties for the Subject Property: Anchor
Bank Fsb, PO Box 7933, Madison, WI 53707; Fredrikson & Byron, 200 S. Sixt St., Suite #4000,
Minncapolis, MN 55402; '1'homas-Dale District 7 Planning Council.

WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to eonstitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WH�REAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Pau] Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, June 24, 2008, Jalv 29, 2008;
WHEREAS, discussions were also held on 3 occasions involvin� Greater Froptown
CommunitY Development Cor�oration, District 7 Planning Council, Historic Saint Paul,
interested nei�hbors and City staff in which ideas were refined that best met the needs of both
the community and developer; and

to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with
all applicable codes and ordinances. The rehabilitation or demolition of the structure to be
completed within fifteen (15) days after the date of the Council Hearing; and
WHEREAS, the Leaislative Hearine Officer recommends that if the Counci] �rats 180
days for the rehabilitation or removal of this structure, that �rant of time should be contin�ent
unon the following conditions beine met:
� Facade improvement shall be consistent with the plans ouUined by Historic Saint Paul;

� A community space, such as a lar�e screened natio s�ace, shall be developed to allow
tenants to congreeate without creating loitering and nuisance behaviors.
� Li2htinQ fixtures shall be consistent with Historic SainY Paul plan.
5� The parking lot/patio space in the rear of the building shall be properly and thorou�y lit
for safety. Li�htin� should be screened to not produce a liaht pollution nuisance for
nei ng bors.

7� Cameras shall be installed for securitv and records maintained for 30 davs. Cameras mav

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 500 SHERSURNE AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multip]e I3ousing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safeYy and welfare and remove its
blighting influence on the community by rehabiliYating Yhis structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with a11 applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within

persona] property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Pau] shall remove and dispose of such property as provided by law.

Ms. Moerxnond stated that this was continued from the City Council Public Hearing on July 16 to
discuss the exterior faFade issues of the building. She said that she had also talked to the architect
that Mr. Palmer had retained on options for rehabbing the exterior of the building.
Tait Danielson-Castillo, District 7 Planning Council, stated that this property had been a major
nuisance in the neighborhood. Lucy Passus had contacted him as she lived next door to this
property and the building was practically on top of her house. He believed that demolition was the
best solution given the history of the property.
Ms. Moermond responded that this was private property and since Ms. Passus bought the property
next to 500 Sherburne, she had to have been aware o£ the issues concerning the property.
Ms. Moermond asked Mr. Palmer what his plans were for the building. Mr. Palmer responded that
he had been in contact with the Greater Frogtown CDC and Historic St. Paul to discuss different
options for the building. Greater Frogtown put in him in contact with Marvin Smith, Network for
Better Futures, who expressed interest in signing a one year master lease for the property. Mr.
Smith indicated to him that he would like to see the building remain as an eight-unit building.
Mr. Magner stated that the issues from the previous hearing were concerning the egress windows in
the lower units to the neighboring property and he believed Mr. Palmer was going to contact Jim
Seeger and Pat Fish to see if this was a concern and how it could be resolved if it were an issue.
The other issue was how this property was going to become an asset to the neighborhood given its
high density and how the property was going to be managed. He believed that if the building were
brought back to more of its original character, it would be more aesthetically pleasing and would be
a benefit to the neighborhood.
Mr. Palmer stated that he was working with his contractor concerning the egress windows and they
developed a new plan to move the kitchen into a different room, move the living room were the
kitchen had been, and move the bedroom to another area of the unit that had an egress window.
There were four units upstairs and four units downstairs. He explained that as far as management of
the building, Network for Better Futures takes men in transirion after incarceration to get them back
into the wark force. They would have counselors on site six to eight hours per day supervising the
men and the men would be off site from 6:00 a.m. to 5:00 p.m. They were also working with
Historic St. Paul to bring the building back to its original character as well as assist with funding.
Ms. Moersnond stated that issues conceming the building were behauioral, aesthetics, density, and
shared community space. She asked Mr. Palmer whether he would be willing to downsize the
number of units to six and use the storefront space for shared space. She also suggested that
perhaps they could consider making the roof top into green space.
Mr. Palmer stated that in taking on this project, their problem was h to make everyone happy
which was slowing down the project. It was his understanding that Mr. Smith did not want the

Mr. Magner stated that he had concem with the units remaining as efficiencies and one bedroom as
it seemed to attract the same negative element. If Mr. Palmer were to sell the building or the lease
management agreement with Mr. Smith does not work out, the building will likely become a
nuisance again. He believed a mix of the number of bedrooms in the units would be more
beneficial.
Ms. Moermond indicated that she will have a meeting set up for the following week with all of the
interested parties to discuss the options far rehabilitating the building.

The building is a two-story, wood frame, multi-unit dwelling, on a lot of 3,049 square feet.
According to our files, it has been a vacant building since Apri127, 2007.
The current property owner is Anchor Bank FSB, per AMANDA and Ramsey county property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2007.
There have been eleven (11) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of snow and ice
- Removal of tall grass and weeds
On March 12, 2��8, an inspection of the building was conducted, a list of deficiencies which constitute
a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A
NUISANCE BUILDING was posted on April 1, 2008 with a compliance date of May 1, 2008. As of
this date this property remains in a condition which comprises a nuisance as defined by the legislative
code.
The Vacant Building registration fees aze paid.
Taxation has placed an estimated market value of $120,000 on the land and $346,800 on the building.
A C of O Team Inspection had been done on May 14, 2007.
As of June 23, 2008, the $5,000.00 performance bond has not been posted.
Rea1 Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$70,000. The estimated
cost to Demolish is $10,400 to $14,400.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes the
Division of Code Enforcement to demolish and assess the costs to the property.

Inspecrions, Division of Code Enforcement, hereby declares the premises located at:

With the following Historic Preservation information:

to comprise a nuisance condition in violafion of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On March 12, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame, stucco, 8 unit structure.
Exterior
1. The windows and/or storm windows aze in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated riim in a professional manner. Permit may be
required.
The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that tYu�ee (3) risers with handrails which
are grippable and installed 34" to 38" above the nose of the stair treads.
3. There are missing ar defecrive guardrails. Provide all stairways, porches,
decks or steps which are more than 30" high with guardrails and intermediate
rails with openings in the guardrail no more than four (4) inches apart and in
accordance with the State Building Code.
4. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
Interior
5. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
6. G.F.C.I.: The bathroom is lacking an electrical G.F.CI. outlet. Permit May
Be Required.
There is evidence of a rodent infestation. Tmmediately exterminate and
eliminate all rodents from the enrire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
8. SANITATION: Iinmediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, 6xes, etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.

Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
10. Lack of Water Service. Immediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
As owner, agent or responsible party, you aze hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by May 1, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessec3 against the property taxes as a special assessment in
accordance with law.

any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners ar responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Departrnent of Safety and Inspections,
Division of Code Enforcement. The departsnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the rime specified in this order, the Enforcement Officer
will notify the Ciry Counci2 that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a tzme within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administraYive costs will be assessed against the property as a special
assessment in accordance with law.

Your building was inspected on MAY 10, 2007 for the renewal of your Certificate of Occupancy. Approval for
occupancy will be granted upon compliance with the following deficiency list. The items on the list mnst be

12. Ordering the owner to remove or
Rich Robbins, Coldwell Banker Burnet, appeared on behalf of the property owner, Anchor Bank
FSB. Kevin Palmer, Palmer Management, LLC, appeared as the potential purchaser.
Mr. Magner stated the building was a two-story, wood frame, multi-unit dwelling on a lot of 3,049
square feet and had been vacant since Apri127, 2007, A C of O team inspection had been done on
May 14, 2007, the vacant building registration fees were current, and the $5,000 performance bond
had not been posted. On March 12, 2008, an inspection of the building was done and a list of
deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance
building was posted on April 1, 2008 with a compliance date of May 1, 2008. To date, the property
remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey
County Taxation esrimated the market value of the land to be approximately $120,000 and the
building to be $346,800. Real estate taxes were current. Code Enforcement estimates the cost to
repair the building to be approximately $50,000 to $70,000. The cost for demolition was estimated
to be approximately $10,400 to $14,400. There had also been six summary abatements issued to
this property since 2007, 11 of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and
weeds, and remove snow and ice. Ae said that most of the wark orders were for boardings done at
the property as the b uilding was a magnet for illegal occupancy. Code Enforcement recommends
the building be repaired ar removed within 15 days. Mr. Magner presented photographs of the
property.
Ms. Moermond asked far a report from Ms. Barr. Ms. Ban stated that this building this was a brick
structure located on the corner of Sherburne and McKubin. It was identified in the 1983 survey as a
site of major significance. The exterior had been altered and was covered with stucco and the
windows had also been altered. It is located near several other properties that are listed as potential
historic eligibility. It was located in the Frogtown neighborhood and was listed in the commercial
context study conducted in 2001. She would recommend this property be forwarded to the HPC for
review.
Mr. Palmer stated that he had a purchase agreement and financial plan, which he submitted for
review. He did not have the opportunity to do a complete work plan; however, he planned to
submit one for review. It was his intention to keep the building as an eight unit, commercial multi-
family dwelling. He understood there had been a history of problems at this property.
Ms. Moermond asked whether he had been a landlord before. Mr. Palmer responded that he had
been a landiord for approximately four years. He had owned 1806 Arlington since December,
2003; he also owned and managed 497 Hopkins Street, 351 Hope Street, and 359 Geranium
Avenue. He stated that it was his intention to post the $5,000 performance bond immediately after
the hearing.
Ms. Moermond asked how long the bank had owned the property. Mr. Robbins responded that the
redemption period expired earlier in the year; however, he did not have a specific date. They
contacted him in April, 2008 and had a signed contract with the bank as of Apri123. He had listed
the property and had two offers within the first two days. They selected Mr. Palmer because of his
financial ability and construction plan to complete the rehab.

Lucy Passus, 506 Sherburne Avenue, stated that she wanted to see the
tenants. She said that the windows on the first floor abutted her house and she had to install fence
approximately two years ago to keep the tenants from entering her property at all hours of the night
and day. She did not believe the first floor should be occupied given there was no egress for any
tenants on the first floor. She also complained about the trash container and not being able to be
outside during the summer months because of the horrible smell. She also had complaints about the
balcony as it was not well lit and vagrants liked to "hang out." There was also a lot of police action
concerning this property. She also suggested to Mr. Palmer that if he plans to buy the property, that
he introduce himself to the neighbors and provide his contact informarion so that they l�ow who to
call.
Mr. Palmer stated that Mahmood Hassan previously owned the property and had a vast portfolio of
properties that he did not take care of. He indicated that he would give Ms. Passus and the
neighbors his cell phone number.
Mr. Magner stated that that earlier in 2000, tlus property was owned by Delisle, it was then sold to
Mahmood Hassan. There had been many properties that had gone through the legislative process
which were owned by Mr. Hassan and there was a lengthy history with Mr. Hassan's lack of
management of his properties. He strongly encouraged that if Mr. Palmer purchases the property,
that he wark with the neighbors, as well as Crime-Free Multi Housing, and develop a management
plan. The neighbors had experienced at least a decade of non-management of the property and if
these neighborhoods were going to be stabilized, there needed to be pxoperty owners who had a
long-term commitment to managing them. As far as the egress windows, he suggested Mr. Palmer
contact Pat Fish in Fire and Jim Seeger in Licensing to determine if the window egress was code
compliant.
Ms. Moermond stated that she would require Mr. Palmer consult the Police Department to work on
a management plan, attend Crime-Free Multi Housing training. She stated that the deck needed to
be rebuilt ar torn down as it was in a serious dilapidated state. She was also concerned about the
garbage situation and asked Mr. Palmer to commit to having bi-weekly garbage pick up at the
property. She also suggested he build an enclosed area for the trash containers in an attempt to keep
the smell to a minimum. She asked whether he had considered hiring an architect for this project.
Mr. Palmer responded that he had not. She said that an architect could likely give him suggestions
on how to restare the exterior windows and possibly removing the stucco to restore the building to
its original state.
Ms. Barr suggested Mr. Palmer look at the Stutzman block and 800 Third Street East both located in
Dayton's Bluff to see how those buildings had been restored.
Mr. Palmer stated that in the materials he had submitted, he provided a management plan which
outlined their screening process. They were also an active member of SPARL.
Ms. Moermond stated that she and staff would need to review the materials that had been submitted.
She stated that the following must be provided by July 9: 1) the bond must be posted; 2) provide a
management plan; 3) provide a lease agreement; 4) the property must be maintained; and 5) consult
with an architect on the rehab of the building. She would then recommend to the City Council that
they grant 180 days to complete the rehab of the property.
