That the Subject Property comprises a nuisance condition as defined in Saint Paul LegislaYive Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($S,O�O.OQ). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. According to our files, it has been a vacant building since July 26, 2007. The current property owner is Bulmaro Peralta Tadeq per AMANDA and Ramsey county property records. The City of St. Paul has boazded this building to secure it from trespass. There have been five (5) SUMMARY ABATEMENT NOTICES since 2007. There have been three (3} WORK ORDERS issued for: - Removal of improperly stared refuse and miscellaneous debris - Removal of tall grass and weeds On March 26, 2008, an inspection of the buiiding was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on Apri14, 2008 with a compliance date of May 5, 2Q08. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Ordering the owner to remove or repair the building(s) at Ryan Krumrie, attorney, appeared on behalf of the property owner, Indymac Bank FSB. Mr. Magner stated the building was a rivo and one-half story, wood frame, dupiex with a detached two stall gazage on a lot of 4,792 square feet and had been vacant since July 26, 2007. A code compliance inspection had been done on September 10, 2007, the vacant building registration fees were current, and the $5,000 performance bond had not been posted. On March 26, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on Apri14, 2008 with a compliance date of May 5, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Rasnsey County Taxation estimated the market value ofthe land to be approximately $45,000 and the building to be $105,000. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $9,300 to $12,300. There had also been five summary abatements issued to this property since 2007, three of which went to work arder: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and miscellaneous debris, and cut tall grass and weeds,. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked far a report from Ms. Barr. Ms. Barr stated that this building was built in 1900 and was a workers cottage-style house. There was extensive loss of integrity with the porch being enclosed. She did not believe there would be any adverse effect if the building were demolished. Mr. Krutm�ie stated that this property went to sheriff's sale on May 1, 2008 and they had gone to court to reduce the redemption period to five weeks which was granted on June 11, 2008. Ae believed the redemption period would end on July 16, the Council public hearing date. He said that he had advised his client to hire a property management company to maintain the property, to fill out the vacant building registration notice, to pay the vacant building fees which they had done. He advised his client not to post the bond at this time. They were interested in keeping the property and he was requesting time to market it for sale. In the event they were unable to find a buyer to do the rehab, the bank intended to come up with a work plan to rehab the property themselves. Ms. Moermond asked what the policy was on returning the perFormance bond in the event the City CounciJ recommended demolition. Mr. Magner stated that in that event, the owner could request the bond be retumed. Betty Revoir, 708 Hawthorne Avenue East, stated that it was her information that no one ever moved into the house when it was sold. Mr. I�'umrie responded that the person who purchased the property only made one or two mortgage payments and quit. The property then went into foreclosure. Ms. Moermond stated that the $5,000 performance bond must be posted by July 9. If it is posted, she will recommend continuing the Legislarive Hearing to August 12 and Council Public Hearing to August 20. Ms. Moermond stated that tkris was a continuarion of the hearing as the condition of the bond being posted had been met. She asked Mr. Knurnie what his client wanted to do with the property. Mr. Knmzrie responded that the bank would like additional time to sell the property and were not interested in rehabbing it themselves. It was his undersYanding that there was one offer of $75,000 received which the bank would not accept. He asked if he could have a copy of the demo bids to see if the bank would be willing to demo the property themselves. Mr. Magner stated that the two lowest bids that had been received, the contractors were in good standing with the City. Ms. Moermond stated if the Council recommended to remove the building within 15 days, she would require a signed contract with a demolition contractor and the permit would need to be pulled. This would need Yo be done within 15 days a8er Council's decision.
