1 WHEREAS, adverse action was initiated against the Cigazette/Tobacco license held by Tala
2 Tobacco Shop, Inc., d/b/a Tala Tobacco Shop (License ID #20040004650) for the premises located at 279
3 McKnight Road South in Saint Paul by Notice of Violation dated May 29, 2008, alleging licensee sold
4 individual cigarettes from a package behind the counter of the establishment in violation of Saint Paul
5 Legislarive Code §324.07(a); and

7 WHEREAS, the licensee did respond to the Notice of Violation to request a public heazing which
8 was then scheduled for July 16, 2008; now, therefore, be it

10 RESOLVED, that the Cigarette/Tobacco license held by Tala Tobacco Shop, Inc., d/b/a Tala
11 Tobacco Shop is hereby ordered to pay a matrix penalty of $500.00 for selling individual cigazettes from a
12 package in violation of Saint Paul Legislative Code §324.07(a).

14 This resolution, and action taken above, is based upon facts contained in the May 29, 2008, Notice
15 of Violation sent to the licensee and the uguments made at the public hearing on 7uly 16, 2008.

for their consideration. This is an uncontested matter concerning the fact that on May 15, 2008, a plain ciothed St. Paul
Police sergeant was able to purchase individual cigazettes from a package behind the counter of your establishment in
violation of Saint Paul Legislative Code §324.07(a). This matter has been placed on the public heazing agenda portion of

was greeted by the store clerk: a middle eastern male, 45 yrs., 5-7, medium build, had short biack hair w/ a
receding hair Iine, i went to a cooler and grabbed a can of Diet Pepsi and brougfit if to the counter. The clerk
rang it up on the register asking for 75 cents. I handed him a dollar and had another dollar biii in my hand, I
asked if fie had a"coupie of smokes'. The Clerk said °sure°. I told him I Iiked Marlboros, he apologized and
said he only had Newports. I toid him ! would take them because ! didn't have enough money for a pack. He
grabbed an open pack of Newport 100's from behind the counter, took out three cigarettes and gave them to
me. I handed him the dollar from my hand and thanked him. He gave me a quarter change for the can of pop.
The cigarettes will be kept in my office until needed.

The Depar4nent of Safety and Inspections wili reco�nmend adverse action against the
Cigazette/`I'obacco license held by Ta1a Tobacco Shop, Inc., d/b/a Ta1a Tobacco shop £or the
premises located at 279 McKnight Road South in Saint Paul. The basis for the recommendation
is as foilows:
On May 15, 2008, a plain clothed St. Paul Police sergeant, came fo
yonr store to investigate complaints that you were selling individuai
cigarettes (CN #08-0&8-529). He entered tke store and went to the
cooler to get a can of Diet Pepsi and brought it Yo the counter. He
paid for the Pepsi and had another dollar in his hand. The police
sergeant asked for a"couple of smokes" and the clerk said "sure".
The sergeant said he liked Marlboro but the clerk said they only had
Newport He toid the clerk he would take fhem because he didn't
have enough money for a pack. The clerk grabbed an open pack of
Newport 100's from behind the counter, took out three cigarettes and
handed them to the sergeant. He paid for the cigarettes and left the
store.
This is a violation of Saint PauI Legislative Code §324.07 (a) whiclz states "no person shall sell
ct cigra�etYe outside its original packaging containing health warnings satzsfying the requirements
offederal law. No cigarettes shall be soZd in packnges offewer than twenty (20} cigarettes. "

Therefore, as per Saint Paut I.egislative Code §310.05 (m)(2), the licensing office will
recommend a mahix penalty af $500.00.
At this iime, you have three options on how to proceed:
1. You can pay the recommended $500.00 penalty. lf tUis is your choice, please send the
payment to the Department of Safety and Inspections (DSn at 8 Fourth Street East, Suite
200, St. Paul, Miunesota 55101-1002 no later than NLonday, Jnne 9, 2008. Payment
should be clirected to the attenizon of Chrisdne Rozek. A self-addressed envelope is
enclosed for your convenience. Payment of the penalty will be considered a waiver of
the hearing to which you are entitled.
2. If you wish to admit the facts but contest the penalty, you may have a public hearing
before the Saint Paul City Council, you will need to send me a latter with a statement
admitting the facts and requesfing a public hearing. We will need to receive your letter by
Monday, June 9, 2008. The matter will then be scheduled before the City Council for a
gublic hearing to deternvne whether to unpose the penalty. You will have an opporhuiiry
to appear before the Council and make a statement on your own behalf.
3. If you dispute the above facts, you can request a hearing before an Adwinistratave Law
Judge. At that hearing both you and the City wiil be able to appeaz and present
witnesses, evidence and cross-examine each other's wifnesses. The St. Paui City Council
will ultimately decide the case. If this is your choice, please advise me no later than
Monday, June 9, 2008, and I will take the necessary steps to schedule the acimuiisirative
hearing.
If you have not contacted me by that date, I will assume that you are not contesting
the impositiott of the $500 penalty. In that case, the matter will be pIaced on the Councit's
Consent Agenda for approval of the recommended penalty.

(a) No person shall sell a cigarette outside its origirtal packaging containirtg heaith warnings satisfying the requir
law, No cigarettes shali be sold in packages of fewer than twenty (20) cigarettes.
(b) No person shall seil or dispense cigarette paper or cigarette wrappers from a vending machine or a motor ve
shall sell or dispense tobacco from a motor vehicle.
(c) No person shaii activate the remote control or provide tokens for a tobacco vending machine or sell tobacco
Yhe age of eighteen (18).
(d} Any violation of this chapter shaii subject the licensee to provisions of secfion 310 and section 324.10 of the
Legislative Code.
