BE IT RESOLVED that, upon the petition of Renee Bergeron and Adam Crranger, as
documented in Public Works Technical Services, Vacation File Number 08-2008, the public
properry hereinafter described, and as depicted on attached map, Eghibit A:
The easterly/westerly alley of block 45, St. Anthony Park, from the easterly line of lot
4, said block 45, easterly to the southwesterly line of Blake Avenue;
is hereby vacated and discontinued as public property, and subject to herein stated objections, the
easements within said public right-of-way are hereby released.
This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successors and assigns shall pay $600.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That an easement shall be retained on behalf of Comcast, a Pennsylvania Corporation, for
existing facilities. The peritioner or its successor shall provide new easements if required
and the petitioner or its successor shall assuxne all costs of relocating facilities to the new
easements.
3. That an easement shall be retained on behalf of Northern States Power Company d/b/a
Xcel (Electric), for eacisting facilities. The petitioner or its successor shall provide new
easements if required and the petitioner or its successor shall assume all costs of
relocating facilities to the new easements.
4. That the pefitioner, their successors and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its o�cers and employees from all suits, actions or claims
of any character brought as a result of injuries or damages receaved or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
properiy, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petidoners or any of their agents or employees.

5. That the pefitioners, their successors and assigns sha11, within 60 days of the effective date
of this resolution, file with Public Works, City Real Estate, an acceptance in writing of the
conditions of this resolution and shall, within the period specified in the terms and
condirions of this resolution, comply in all respects with these terms and conditions.

Having said that Iet me throw out an idea for your mnsderation. i know Public Works generally likes to have a little tum around at
the end of dead end alleys. So maybe the City should keep a little more of the alley as shown on the attached.
No big deal, just a thought.

portion of platted, unopened alley.
