4 WI-IEREAS, §293.11 provides for the granting of variances from the sound level limitations

WHEREAS, Lighhung Run/Minnesota Medical Foundation, represented by Valerie Petermann,
Associate Director of Events, and Gregg Anderson, Site Director, who have been designated as the
responsible persons on the application, has applied for a variance to present music at Summit Brewing
Company, 910 Montreal Circle; and
WHEREAS, applicant is seeking a vaziance for the hours of 6:00 p.m. to 10:00 p.m. on July 25,
and from 8:QQ a.m. to 6:QQ p.m. on 7uly 26, 20o8; and
WHEREAS, if applicant is not granted a variance it will not be able to present the music at 910
Montreal Circle; and
WHEREAS, the Department of Safety and Inspecfions has reviewed the application and has made
recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Lighming
Run/Minnesota Medical Foundation, subject to the following conditions:
1) The variance shall be for the hours of 6:00 pm. to 10:00 p.m. on July 25, and from 8:00 a.m. to
6:00 p.m. on July 26, 2008.
2) All electronically powered equipment used in conjunction with the event shall not exceed
95 dBA, as measured at the closer of the sound mix or 100 feet from the noise source.
3) The applicant shall provide personnel and equipment who shall provide continuous sound levei
monitoring at all noise sources and each sound mix during the hours of the variance.
4) All electronically powered equipment, PA systems, loudspeakers or similaz devices sha11 be
turned off no later than 10:00 p.m. on Ju1y 25, and 6:00 p.m. on July 26, 2008.
WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of
noise in the City of Saint Paul; and

41 FURTHER RESOLVED, that any violations of the conditions set forth above on the first date may
42 result in revocarion of the grant of a variance for the subsequent date, in addirion to any criminal citation
43 which might issue.
