WHEREAS, in the matter of Comptroller t s Contract L -6136, for
the Grading of Flandrau Street from Hyacinth. Street to Hoyt
Avenue, Walter J. Ebertz, Contractor, the specified date of
completion is November _ 12, 19593 and
WHEREAS, the Contractor has prosecuted the diligently, but due
to inclement weather, it was not possible to complete the
work by said date of completion, therefore be it
RESOLVED, that the proper City Officers be and they are hereby
authorized and directed to execute an amendment to said' Con-
tract' extending the time of completion to JULY 26, 1960, pro-
vided, however , that this Resolution shall have no force or
effect unless the Sureties on the Contractor's Bond consent
the ret o' and file such consent in writing with the City Comp-
troller, and be it
FURTHER RESOLVED, that the City
claim for liquidated damages
charges be made . on th i s
