THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 61+ inclusive of the Saint Paul Legislative Code,:as amended, pertaining to Use Districts, Height Districts :and Rezoning of.certain properties in the City of Saint Paul, be and the same hereby is further amended so as to rezone the following described property from "B" Residence to Commercial District: Lot 6, Block 5, Robertson -Van Etten's.Adddition, according to the plat thereof on file and of record in the office of the Register of Deeds in and for RamsEy County, Minnesota; located on the northeast corner of Edmund .Avenue and Elfeit Street, subject to the following express exceptions and conditions: 1. That, subject to any further reclassification of the hereinabove described real estate by virtue of pro- ceedings therefor hereafter instituted, conducted and completed according to applicable provisions of said Zoning Code, as amended, and applicable provisions of the statutes of the State of Minnesota, hereby, the employment of said real estate henceforth is restricted and limited to the following specified uses, to -wit: (a) Residential District uses permitted by the regulatory provisions of the said Zoning Code, as amended, in "A" Residence District, "B" Residence District and "C" Residence District, thereby established, and fb) Commercial Uses which shall include no more than the establishment, maim tenance and conduct of -a hair dressing and beauty culture shop, subject to all applicable statutes, ordinances, .rules and regulations prescribed and promulgated by governmental agencies having cognizance, and without the use or employment o£ any advertising sign or placard pertaining to the same. 2. The property is described as Lot 6, Block 5, Robertson -Van Etten's Addition. ':The zoning is-"B" residence and has been since the adoption of the Ordinance in 1922.,• On-August 4, 1960, the Commissioner of Finance reported the petition sufficient with 10 of a possible 14 (71.437'.) owners of property within the prescribed 100 foot radius havingisigned the petition. The property is presently developed with a two - family- residence. The applicant proposes to rezone the property to commer- cial for the purpose of remodeling the existing structure to permit the operation of a beauty shop inthe home, also continuing the present two - family use. This is a corner lot witha 50 foot frontage on Edmund Avenue and 132.25 feet along Elfelt Street, resulting in a total area of 6,613 square feet. The preliminary Land Use Guide Plan alndicates this area should retain its residential classification as the highest and best use for this area is found to be for residential purposes only. Field investigation discloses that this area is predominately residential in .character other than for an occasional existing non - conforming commercial use. It appears that a trend has developed in the last year or two of beauty parlor operators securing reclassification of their homes to commercial for the purpose of operating beauty parlors within a residential district. They thereby avoid the overhead of maintaining a shop in a proper commercial district. The granting of these reclassifications has established an extremely undesirable pre- cedent, as it is the opinion of the Board of Zoning and the staff that a use of this nature should properly be in a commercial area, that is, an area best suited for commercial uses. To reclassify this property would constitute "spot zoning" and would be detrimental to the area, would deviate substantially from the purpose and intent of the Ordinance as well as the adopted Land Use Plan. In consideration of the above factors, the'Board of Zoning recommends the denial of the petition to rezone the above described property to commercial district for the purpose of operating a beauty parlor in the home. a� Sincerely, 1 c H.
