O'Connell City Clerk Building Dear Madam: This is in the matter of the appeal of the North Emmanuel Lutheran Church to relax the required 25 foot side yard set back along the north and west property lines to four feet on property located at the northwest corner of Hatch Avenue and Matilda Street. The property is described as Lots 5, 6, and 7,•3lock 37, Auerbach and Hands Addition. The zoning is "B" residence and has been since the enactment of the Ordinance in 1922. The properties under consideration are presently developed with the North Emmanuel Lutheran Church and a two -story residence which is used as a parsonage. Because of the,growtb of the congregation, the applicant proposes to construct an addition for administration and Sunday school use. Chapter 60.14 of the Legislative Zoning Code'requires a 25 foot side yard set back for such use adjoining single or two - family residential uses. The applicant's plan calls for a four foot side yard property line on the north and west sides�of the site. The property under consideration has a frontage of 122J feet on Matilda Street and 132 feet along Hatch Avenue, resulting in an area of approximately 16,170 square feet. A }portion of the property lying directly to the west is developed with a single - family residence which fronts on Hatch Street and is owned by the church. One other parcel of land adjoining is developed with a single - family residence and two -car garage which fronts on Farrington Street. Directly north and adjoining is a single - family residence and garage fronting on Matilda Street. The other immediate area uses are single and two - family residences. Field investigation discloses that there are only two parcels of land which would be directly affected by this proposal, and the proposed relaxation would be at the rear yards of these properties. The owners of the two affected properties have submitted letters of acquiescence to the proposed four foot side yard set back. In consideration of the above factors, the Board of Zoning recommends the granting of the appeal to relax the 25 foot side yard set back along the west and north property lines of the above described property to four feet. Purpose of appeal For relaxation of the property set -back restrictions Need of appeal For the purpose of utilizing as much of the property as possible for building purposes as we are cramped for room at the present time, and being the only protestant church in the immediate district the need for as large buildings as possible is essential. Am also enclosing check in the amount of $20.00 covering filing fee.
