RESOLUTION

Presented by
1 WHEREAS, H& K of Saint Paul, Inc. d/b/a Moonshine Saloon, located at 1179 East 7 Street in
2 Saint Paul, has requested a waiver of the 45-day notice requirement for issuance of on-sale liquor (100
3 seats or less) and Sunday on-sale liquor licenses; and
4
5 WHEREAS, the Dayton's Bluff District Four Community Council, has agreed to the waiver of the
6 notice requirements; and

8 WHEREAS, the Council finds that the application is in order aand there are no grounds for denial of
9 the license and that the failure to grant the waiver and the consequent delay in approving the license would
10 cause exceprional and unusual hardship to the license applicant; and
11
12 WHEREAS, the licensee agrees that in the event a complaint is received priar to the expiration of
13 the 45-day period and the complaint provides a basis for adverse action against the license, that the Office
14 of License, Inspections, and Environmental Protection may direct the licensee to immediatelq discontinue
15 all operations until a public hearing is scheduled, and that the licensee shall comply with said directive;
16 now, therefore, be it,

18 RESOLVED, that the 45 day norice requirements of § 409.06 of the Saint Paul Legislative Code
19 aze hereby waived and on-sale liquor (100 seats or less) and Sunday on-sale liquor licenses are issued to
20 H& K of Saint Paul, Inc. d/b/a Moonshine Saloon, located at 1179 East 7 Street in Saint Paul, subject to
21 the agreement stated above.

Subject: DBCC - 1179 East 7th Street
At our June 9, 2008 board of directors meeting our board passed a resolution i� support of waving the 45 day
waiting period for 1179 East 7�' Street, the Moonshine Saloon. Our board heard some of the concerns of
neighbors, but felt Mr. Kalis will do a good job of managing the saloon as he did when it was Michael's. This
historic building has been a bar for most of its 120 years.
