NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary
and finai plat fior Whitali Townhomes, located at Whitall and Wells east of Edgerton, subject to the foliowing
conditions:

3 WHEREAS, Sherman Associates, in File No. 07-204-918, has submitted for City Council approval the attached
4 preliminary and finai plat for subdivision of property at Whitall and Welis east of Edgerton, to create 18
5 residential parcels and one outlot; and
WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended
conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and

lo WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of
11 the City and notices were mailed to each owner of affected property including ail property situated within 350
12 feet of the subject property; and

14 WHEREAS, the City Council held a public hearing on the proposed plat on June 18, 2008, where ail interested
15 parties were given the opportunity to be heard, and the Council considered all the facts and recommendations
16 concerning the plat;

1. A parkland cash dedication in the amount of $3,894 is paid prior to the city clerk signing the
final plat.
2. The applicant shall file a copy of the Council Resolution approving the Final Plat with the
Ramsey County Recorder's Office.

City staff have reviewed the proposed subdivision, requested changes to the Preliminary Plat
(letter dated January 14, 2008), and signed off on the Final Plat on June 2, 2008. A staff report
will be prepared and provided to the City Council the week prior to the public hearing.

public hearing request will appear on the agenda on or before the June 11, 2008 City Councit

ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1) creates
five or more iots or parcels each of which is 2%: acres or less in size, or (2) requires paved streets,
alleys and other public improvements, or (3) is previously unplatted land. §69.304 fists conditions for
lot splits and adjustments of common boundaries. §69.406 provides criteria for review of subdivision
applications. These criteria are covered below under "Required Findings.° §69.511 regulates
parkland dedication.
HISTORYIDISCUSSION: A site plan for the townhouse project was approved in January 2007 (ZF
# 06-119051) .
G. DISTWCT COUNCIL RECOMMENDATION: The District 5 Council had not commented at the time
this staff report was prepared.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings shall
be made prior to approvai of a subdivision:
1. A!f the applicable provisions of the Legislative Code are complied with. City staff have
reviewed the proposed plat and have determined that all applicable provisions of city codes are
met. A site pian for the project was approved in January, 2007.
2. The proposed subdivision witl not be detrimental to the present and potential surrounding land
uses. The proposed plat is consistent with the surrounding land uses, and will not be
detrime�tal to present and future use of surrounding land.
3. The area surrounding the,subdivision can be planned and developed in coo�dinatron a�d
compatibility wrth the proposed subdivision. The area surrounding the proposed plat is already
developed and compatibie wiih ihe proposed ptat.
. 4. The subdivision is in conformance w'�th the comprehensive plan. The subdivision is in
conformance with the tiousing chaptsr of the comprehensive pfan, which cails for providing a
range of housing types (Policy 5.4). It is also in conformance with redevelopment plans for the
area.

5. The subdivision preserves and incorporates the srte's imporfant existing natura( features
whenever possible. The site is in a fuliy-developed part of St. Paul with no remaining natural
features.
6. A!I land intended for building sites can be used safely without endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace.
The site is a flat, fuily developed area with no flooding, erosion, high water table or soil
condition problems.
7. The subdivision can be economica/!y served with public facilities and services. The subdivision
can be economically served with pubiic facitities and services from surrourtding streets.
i. PARKLAND DEDICATION: §69.51 T requires dedication of two (2) percent of the total land area
of the plat for public use, for parks, playgrounds, trails, open space, or conservation purposes. Af
the discretion of the City Council, a cash dedication in lieu of land may be paid prior to the city
clerk's signing of the final plat.
For this subdivision, Parks staff recommends a psh dedication in the amount of $3,894 in lieu of
dedication of land.
J. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval
of the preliminary and final plat for Whitall Townhomes subject to the following conditions:
1. A parlcland cash dedication in the amount of $3,894 is paid prior to the city clerk signing the
final plat.
2. T(ie applicant shall file a copy of the Council Resolution approving the piat with the Ramsey
County Recorder's Office. �
