WHEREAS, Depar tnent of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, masonry/wood frame duplex and its detached, masonry/wood frame,
one stall garage located on property hereinafter referred to as the "Subject Property" and
commonly lrnown as 475 AOPHINS STREET. This property is legally described as follows, to
wit:
BRUNSONS ADDTTION PART BLK 1 ANU ALL OF 2 THRU 12 NO PART OF VAC
ALLEY ACCRUING AND LOT 10 BLK 3
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before Apri12, 2007, the
following are the now known interested or responsible parties for the Subject Property:
Raymond & Kathryn Hessier, 10140 Adam Ave, Inver Grove Heights, MN 55077; Karen
Malden, 14016 Knollway Drive N, Minnetonka, MN 55305; Sebring Capital Corporation, 4000
International Pkwy, Suite #3000, Carrollton, TX 75007; National City Bank of Pennsylvania,
150 Allegheny Center Mall, Pittsburgh, PA 15212; Usset, Weingarden and Liebo, 4500 Park
Glen Rd, Suite #120, St. Louis Park, MN 55416; Payne Phalen District 5 Planning Council.
WHEREAS, Deparhnent of Safety and Inspecrions has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated March 13, 2008; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Properiy by Apri114, 2008; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul
City Council on Tuesday, June 10, 2008 to hear testimony and evidence, and after receiving

testnnony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with a11 applicable codes and ordinances, or in the altemative by
demolishing and removing the shucture in accordance with all applicable codes and ardinances.
The rehabilitation or demolition of the structure to be completed within tifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, July
2, 2005 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 475 HOPHINS STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demalition and removal of this building(s) is estimated to exceed
five thousand dollaxs ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition have not been corrected.
6. That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declazes it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparnnent of Safery and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
�+�1��-Ii�Hea�F demolition and removal of the structure must be completed within
fifteen (15) days a$er tt�e date of the Council Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is noi removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

The build'ang is a two story, wood frame, single-family dwelling with a detached, one stall
garage on a lot of 7,405 square feet.
According to our files, it has been a vacant building since 3anuary 23, 2006.
The current property owner is Karen Malden, per AMANBA and Ramsey county property
records.
The Ciry of St. Paul has boarded this building to secure it from trespass.
There have been twelve (12) SUMMARY ABATEMENT NOTICES since 2006.
There have been five (5) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of snow and ice
- Removal of a dangerous overhanging tree
On February 28, 2008, an inspection of the building was conducted, a list of deficiencies
which constitut� a nuisance condition was developed and photographs were taken. An ORDER
TO ABATE A NUISANCE BUILDING was posted on March 13, 200$ with a compliance
date of Apri1 14, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registtation fees are delinquent in the amount of $875.00.
TaYation has placed an estimated market value of $40,000 on the land and $85,000 on the
building.
As of April 28, 2006, a Code Compliance inspection has been completed.
As of June 6, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes for the years 2007 - 20 08 are delinquent in the amount of $3,859.45 plus
penalty and interest.
Code Enforcement Officers estunate the cost to repair this structure is $60,000 to $70,000.
The estunated cost to Demolish is $11,400 to $15,400.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the
property owner to repair or remove this structure within fifteen (15) days, if not the resolution
authorizes the Division of Code Enforcement to demolish and assess the costs to the property.

ORDER:
Repair the structure to a habitabie condition.
This structure is a registered vacant building that must have a Code Compliance
Certificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Depaxtment of Safety and Inspections. You may contact 7im
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of Code Compliance Certificate. Under Chapter 33.03 of tYAe Saint Paul
Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the siructure may result in issuance of criminal smnmonses.
There is a pending code compliance report that was prepared on Apri128, 2006 by

members that aze over-spanned, over-spaced, not being carried properly, door and window
openings that are not headered, etc.) aze to be reconstructed as per code.
Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a m;n;mum of 8 sq. ft., one-half of which shall operate and all bedroom
windows sha11 meet emergency egress requirements (20" wide minimum, 24" high

to Abate" with the Ciry Clerk's Office.
If corrective action is not taken wiflun the time specified in this order, the Enforcement Officar
will notify the City Couneil that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which rime testimony will be
heard from intezested parties. A$er this hearing the City Council will adopt a resolution stating

7. Ordering the owner to remove or repair the building(s) at 475 Houkins Street within fifteen
(15) days from adoption of resolution.
The property owner of record, Karen Malden, did not appear. No other parties of interest appeazed.
Mr. Magner stated the building was a two-story, wood frame, single-family dwelling with a
detached one-stall garage on a lot of 7,405 square feet and had been vacant since 7anuary 23, 2006.
A code compliance inspection had been done on Apri128, 2006, the vacant building registration
fees were delinquent in the amount of $875, and the $5,000 performance bond had not been posted.
On February 28, 2008, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
March 13, 2008 with a compliance date of April 14, 2Q08. To date, the property remained in a
condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
Taxation estimated the market value of the land to be approximately $40,000 and the building to be
$85,000. Real estate taYes for 2007 and 2008 were delinquent in the amount of $3,859.45, plus
penaiTy and interest. Code Enforcement estimates the cost to repair the building to be
approximately $60,000 to $70,000. The cost for demolition was estimated to be approximately
$ll,400 to $15,400. There had also been 12 summary abatements issued to this property since
2006, five of which went to work order: to secure the building and the City had to board the
building to secure it from trespass, remove improperly stored refuse, remove snow and ice, and
remove a dangerous overhanging tree. Code Enforcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked how they became awaze this was a vacant building and she questioned the
ownership of the property. Mr. Magner stated that the area inspector found numerous exterior
violations and the building was condemned. He noted that every time the property was inspected,
summary abatement orders had to be issued. The original owners were the Hesslers and this
property had a long, checkered past.
Ms. Moermond noted that she had received a letter from Christina Weber, attorney with Wilford &
Geske, who was representing Litton Loan Servicing. The letter indicated that Ms. Weber's client
had no intention of ineeting the City's requirement to save the building. Said letter is attached and
made a part of this record.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1874 and was an Italianate-style house. Although the property had not been surveyed, she noted
that it was approximately one block away from the Brunson house which was located at 485 Kenny
Road. The building had been stuccoed; however, she believed the building had potential and
encouraged rehabilitation.
Ms. Moermond stated that she will follow up with the Councilmember to see whether there is
interest in stabilizing this property.
