Presented
1 WHEREAS, Deparhnent of Safety and Inspecrions has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two story, wood frame duplex and its shed located on property hereinafter
4 refened to as the "Subject Property" and commonly known as 157 FRONT AVENUE. This
5 property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
informarion obtained by Department of Safety and Inspections on or before January 7, 2008, the
following are the now known interested or responsible parties far the Subject Property:
Mortgage Elec Reg Systems Inc/Co Sason, 4708 Mercantile Dr N, Fort Worth, TX 76137; Reiter
& Schiller, PA, 25 North Dale St, 2" Floor, St. Paul, MN 55102; District 6 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order idenfified as an"Order to
Abate Nuisance Building(s)" dated March 13, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
struchue located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the shuchue located on the Subject Property by April 14, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declarittg this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings befare the Legislarive
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served norice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislarive Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, June 10 and June 24, 2008 to hear tesfimony and evidence, and after
receiving testimony and evidence, made the recommendafion fo approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this shucture in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolifion of the structure to be completed within fifteen
(15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, July
2, 2008 and the testimony and evidence including the acfion taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 157 FRONT AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violarions at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notifica6on requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties sha11 make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and conecting a11

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s} in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fifteen (1� days after the date of the Council Hearing.
If the above cosective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is Purther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two story, wood frame, duplex on a lot of 4,356 square feet.
According to our files, it has been a vacant building since October 30, 2006.
The current properry owner is MERS c/o Saxon, per AMANDA and Ramsey county properry
records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been nine (9) SUMMARY ABATEMENT NOTICES since 2006.
There have been six (6) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Boazding
On March 5, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on March 13, 2008 with a compliance date of
April 14, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $625.00.
Taxation has placed an estimated market value of $29,600 on the land and $147,200 on the
building.
As of May 19, 2008, a Code Compliance inspection has been completed.
As of June 6, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000 to $60,000.
The estimated cost to Demolish is $9,704 to $12,704.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the
properiy owner to repair or remove this structure within fifteen (15) days, if not the resolution
authorizes the Division of Code Enforcement to demolish and assess the costs to the properry.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspecrions, Division of Code Enforcement, hereby declares the premises located at:
157 FRONT AVE
and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On March O5, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As t"irst remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identi£y specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($S,OQ0.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

This is a two story, wood frame duplex and its shed.

The foundation is deteriorated, defecrive or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-right, water-tight and
rodent-proof condition. Permit may be required.
2. The eaves and soffits aze in a state of disrepair or deterioration. Repair a11
defects, holes, breaks, loose or rotting boazds, to a professional state of
maintenance. Pemut may be required.
3. The exterior walls and/or trim of the house and/or garage has defecrive,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
4. The exterior wa11s of the house and/or garage are defecrive. Repair a11 holes,
breaks, loose or rotting siding, to a professional state of maintenance.
5. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
6. The window and/or door screens are missing, defecrive or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
7. The steps are deteriorated. Repair/replace.
8. The front door is in disrepair. Repair/replace.
9. The storm door is in disrepair. Repair/replace.
10. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a pemut.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulring nuisance condition is not corrected by April 14, 2008 the Department of Safety and
Inspecrions, Division of Code Enforcement, will begin a substanrial abatement process to
demolish and remove the building(s). The costs of this acrion, including administrarive costs
and demolirion costs will be assessed against the property taYes as a special assessment in
accordance with law.
As first rexnedial acrion, a Code Compliance Inspection Report must be obtained,from the
Building Inspecrion and Design Secfion, 8 Fourth Street, Suite #200, Commerce Building,

(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declazes it
to be a"nuisance condirion", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the tune specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public HeaiYngs before the City Council at which time testimony will be
heazd from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution ca11s for abatement acrion the Council may either order the City to take the
abatement acrion or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conecrive action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
acrian, including administrarive costs will be assessed against the property as a special
assessment in accordance with law.

Pursuant to your request the above-referenced property was inspected and the following report is
submitted:
BUILDING
1. Install riser boards on basement stairs and insure rise and run are uniform.
2. Install landing to code for first floor unit, either front or rear.
3. Install new exterior door on second floor unit at rear entry.
4. Recommend replacement of roof within 3 years, on main part of house.
5. Insure basement cellar floar is even, is cleanable, and all holes are filled.
6. Install hand and guardrails on all stairways and steps, including basement, as per attachment.
7. Strap or support top of stair stringers.
8. Install plinth blocks under posts in basement.
9. Tuck Point interior/exterior foundation.
10. Install floor covering in the bathroom and kitchen that is impervious to water.
I 1. Install tempered glass in window over bathtub, in both units.
12. Provide thumb type dead bolts for all enhy doors. Remove any surface bolts.
13. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
14. Provide complete storms and screens, and in good repair for all door and window openings.
15. Repair wa11s and ceilings throughout, as necessary.
16. Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation,
glass, weather stripping, etc.) shall meet new energy code standards.
17. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).
18. Provide general clean-up of premise.
19. Provide smoke detectors as per the Minnesota State Building Code.

20. Repair soffit, fascia trim, etc. as necessary.
21. Provide proper drainage azound house to direct water away from foundation.
22. Provide total rehabilitation of storage shed or remove it. Shed should meet building and
zoning code when done.
ELECTRICAL
1. Bond azound water meter with a copper wire sized for the electrical service per Article 250
of the NEC.
2. Provide a complete circuit directory at service panel.
3. Verify a separate 20 ampere laundry circuit & a separate 20 ampere kitchen appliance circuit.
4. Install "S" type fuse adapters and proper size "S" fuses.
5. Verify that circuit breaker amperage matches wire size.
6. Install GFCI receptacle in second bathroom adjacent to the sink.
7. Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers and piates.
8. Check a113-wire outlets for proper polarity and verify ground.
9. Throughout building, install oudets and light fixtures, as specified in Bulletin 80-1.
10. All electrical work must be done by a licensed electrical contractor under an electrical permit.
11. Any open walls or walls that are open as part of this project must be wired to the standards
of the 2005 NEC.
12. Add a receptacle in first floor dining room and bedrooms, and in second floor main room and
northwest bedroom (ARC fault).
PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
Basement:
1. Water heater is not fired and not in service.
2. Gas venting and water piping, on both units, is incorrect.
3. Water meter is removed and not in service.
4. Service valves are not functional or conect.
5. Repair or replace all corroded, broken or leaking water piping.
6. Replace corroded gas piping.
7. Dryer gas shut-off, connector or gas piping is inconect.
8. Soil and waste piping has no front sewer clean-out; no soil stack base cleanout.
9. Soil and waste piping has improper pipe supports, connections, transitions, fittings or
pipe usage.
10. Laundry tub is unvented and waste is incorrect.

6. Ordering the owner to remove or repair the building(s) at 157 Front Avenue within fifteen
(15) days from adoprion of resolurion.
The property owner of record, MERS c/o Saxon, did not appear. No other parties of interest
appeazed.
Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 4,356 square feet
and had been vacant since October 30, 2006. A code compliance inspection had been done on May
19, 2008, the vacant building registration fees were delinquent in the amount of $625, and the
$5,000 performance bond had not been posted. On March 5, 2008, an inspection of the building
was done and a list of deficiencies which constitute a nuisance condition was developed. An order
to abate a nuisance building was posted on March 13, 2008 with a compliance date of April 14,
2008. To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taxation estimated the market value of the land to be
approximately $29,600 and the building to be $147,200. Real estate tases were current. Code
Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The
cost for demolirion was estimated to be approximately $9,704 to $12,704. There had also been nine
summary abatements issued to this property since 2006, six of which went to work order: to secure
the building and the City had to board the building to secure it from trespass, remove improperly
stored refuse, cut tall grass and weeds, and boarding. Mr. Magner stated that he had several
inquiries conceming this property and he told the agent that any potential buyer needed to attend the
hearing and present a work plan. He also noted that the property did not have a code compliance
inspection and he was unsure as to whether there had been a recent truth-in-sale-of-housing report.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that
the inspector far the area found numerous code violations and referred the property to the Vacant
Building Progam. He noted that the work orders were continuous on this property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that she was unsure when the
house was built as Ramsey County records were different from the permit which listed the property
as being built in 1889 and was a worker's cottage-style house. There were numerous exteriar
changes to the house and the building lacked integrity. It was also not located on a contiguous
block face. She also noted that the house was located in close proximity to the Oakland Cemetary.
Ms. Moermond requested Ms. Vang send letter to bank with the normal list of conditions which
must be received by June 20, and if not, she will recommend demolition with no option for repair
within 15 days.

Chrisri Fetter appeazed on behalf of the listing agent, Todd Cruz, representing Fidelity National
Asset Management Solurions.
Mr. Magner stated that no one appeazed at the June 10 Legislarive Hearing and the recommendation
was to remove the building within 15 days.
Ms. Fetter stated that they had received two verbal offers to purchase the property; however, they
did not have a signed purchase ageement. The listing price was currently $24,900. She requested
that they be given additional time to July 24 when their listing contract ended.
Mr. Magner stated that there was no signed purchase agreement, no work plan, no financial plan,
the vacant building fees had not been paid, the bond had not been posted, and the property was not
being maintained. He stated that the most recent work order was sent on June 9 to mow the lawn.
Ms. Fetter responded that the bank had hired a separate company to maintain the property. She
claimed that Mr. Cruz actually had mowed the lawn prior to the City coming to do the work.
Ms. Moermond stated that it was her recommendation that a representative of Fidelity attend the
Council Public Hearing on July 2 to make their case on saving this property. The vacant building
fees would need to be paid, the vacant building registration would need to be filed, the bond would
need to be posted, and it would be helpful to have a signed purchase agreement. If this was done by
the Council Public Hearing, she could recommend referring the matter back to another Legislarive
Hearing. Otherwise, she would recommend the building be removed within 15 days.

Mr. Magner stated that at the hearing on 7uly 10, the REO requested additional time to sell the
property since a potential purchaser had backed out. The new buyer had paid the vacant building
fees and filled out the vacant building registration form. He was also in attendance at this hearing
and indicated that they were closing on the property that very afternoon.
Chuck Repke, NENDC, stated that they closing on the property in the afternoon and he was
requesting the building be demolished.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
