RESOLVED, That it satisfactorily appears that neither
the City of Saint Paul nor ahy public utility company or operator
now maintains or operates, or at any time heretofore maintained
or operated, any public utility instrumentality 'in any part of
Worcester Avenue from the east line of Lot 10, Block 6, Granport
Addition,to the west line of 'Davern Street, vacated by the reso-
lution of this Council designated Council File No. 189518,
approved October 14, 1958, or in South Wheeler.Street from the
south line of Saint Paul Avenue to the north line of Field
Avenue, except that portion of South Wheeler Street lying
between the north and south lines of Wilmot Avenue and the
north and south lines of the alleys in Blocks 5 and 6, Granport
Addition, vacated by the resolution of this Council designated
Council File No. 193515, approved August 11, 1959, save that in
respect of said last mentioned vacated section of public street,
Northern States Power Company, a public utility operator, at
the time of said last mentioned vacation, maintained and operated
and has since continued to maintain and operate therein several
overhead electric power lines and appurtenances; that by virtue
of neither of said vacation proceedings nor by virtue of City
of Saint pawl_ Ordinance No. 3394, as .amended, entitled, "An_.
ordinance regulating the procedure and prescribing the conditions
for the vacation of public grounds, streets, alleys and highways
in the City bf Saint Paul," approved March 16, 1915, did said
City of Saint Paul for itself or any public utility company or
operator reserve or does now reserve for itself or any other
person, firm or corporation any easement or right in respect,
of said vacated sections of public street or in respect of either
of the -same for the construction, installation, maintenance or
operation therein of any public utility instrumentality save in
respect of said vacated section of said South Wheeler Street
wherein, by virtue of said last mentioned vacation proceedings,
it reserved an easement or right in favor of said Northern,States
Power Company, as such public utility operator, for the continued
use of said vacated section of public street for the maihtaa nce
and operation therein of its aforesaid overhead elect=ric power
lines and appurtenances; and that the Corporation Counsel be and
