further condition that sidewalks abutting said premises be kept

Dear Mr. Avery:
As requested by Mr. R. W. Winchell in his letter of February 9, 1960
we reviewed the apartment parking lots on the north side of Seventh west
of Hazel. Though the parking area supplied for the adjoining apartments
is not used to full advantage, the city ordinance requires that it be pro-
vided. The new parking area which is being requested should not have ap-
preciable effect on the traffic on Hazel or E. Seventh St. It will ne-
cessitate a few additional! vehicles use the alley. At the time the park-
ing lot plans were submitted and as approved, the layouts were very ade-
quate. However, as pointed out h y.Mr. Winchell in his recent letter,
portable curbs defining all parking lot separations and confining the
access to the alley have not been installed.
The block on the north side of Seventh west of Hazel is zoned com-
mercial. We have no way of knowing what commitments were made regarding
the landscaping of the lot in question, and, therefore, could not on a
traffic basis refuse this parking lot application. We do feel, however,
that Mr. Sullivan should be required to comply with the parking lot plans
which were approved in the original request for permits.
The apartment building owner who is applying for an additional park-
ing lot on the northwest corner of E. Seventh and Hazel should arrange
to have snow plowed away from the alley so as not to restrict access to
the garages fronting to the north. The lot on the northwest corner of
Seventh and Hazel, if used as a proper parking area, should prevent in-
fringements for eastbound cars avoiding the alley barricade at Hazel.
Unless other commitments were made of which we are not aware, I do -not
feel the request for a parking lot at this location can be ^.reftjsed from a
traffic standpoint.

Dear Mr. Avery:
Several years ago, when you were Traffic Engineer, we the residents of
Stillwater Avenue, between Van Dyke and Hazel Streets, petitioned to
have the alley between Stillwater and E. 7th Street, and for the afore-
said block closed to through traffic. At that time, the alley was being
used excessively for cars going to and from the dump. As I remember at
that time, we had concluded that an open alley would prove a safety
hazard with the traffic swinging around from E. 7th Street to Stillwater.
You will, no doubt recall, that a barrier was placed at the end of the
alley abutting Hazel Street. To the best of our knowledge, this has been
a perfect solution and we have heard no complaints.
Mr. John J. Sullivan received a permit to build six apartment buildings
with ten apartments in each. He applied for a parking lot for 60 cars.
Shortly thereafter, he decided to make 11 apartments in each building
and applied for additional parking space. Ultimately, he received
permission for parking 72 cars for the 66 apartments. Individually,
and at a council session, he assured us that cement barriers and
definite ingress and egress lanes would be established. The northwest
corner of E. 7th Street and Hazel was still unfilled, but he assured us
that the corner was to be landscaped. He also assured us that they did
not want the alley opened at Hazel and that the landscaping would assure
no opening.
Mr. Sullivan had individual parking spaces painted on the parking lot,
but he has not installed barriers as promised. This winter he had his
lots plowed, however, the snow was pushed in piles into the alley
instead of being hauled away. This resulted in two families with double
garages on the north side of the alley, being able to use only one side.
With no barriers erected, his tenants drive in and out any place and way,
and at times it is actually dangerous to attempt to take a car from the
garage.

Saturday, we received a notice of another application by Mr. Sullivan for
an additional 11 car parking space. This is to be made on the corner of
E. 7th and Hazel Streets, evidently, in the area promised to be landscaped.
I am attaching hereto a thermofax copy of the notice we received.
This area was filled in last fall, and since the ground has been frozen,
it has been used constantly as a cutover to the alley defeating the
blockade. I have noted that even city squad cars use this route. On
Monday morning, February 8, there was another fire at the dump and the
fire department blocked Seventh Street, hence, the alley was used as a
thoroughfare rather than Stillwater Avenue,
We cannot understand the need for additional parking space for these
apartments and feel that Mr. Sullivan wishes to use it as other than
tenant parking. I checked the current parking area last evening at
10:30 P.M., and counted 23 cars parked in the present 66 car area. It is
my understanding that only a few apartments remain unrented.
We also feel that additional parking area would prove a safety hazard with
the busy traffic at that corner of E. 7th Street.
The public hearing for this application is set for February 18. We would
appreciate your looking into this matter and advising us of any information
which 'is available. I want to personally extend my thanks for the fine
cooperation you have rendered in connection with some of the problems
which have faced us in this area.

This is in the matter of the application of John J. Sullivan for a permit
to install and operate an 11 -car private parking lot in conjunction with
an 11 -unit apartment Building located at the northwest corner of Hazel
and East Seventh Street. The legal description is: Lots 29 and 30,
Block 8, Hazel Park Division #4 and that part of vacated East Seventh
Street and Hazel Avenue adjoining said lots. The zoning is "Commercial"
and- has been since the adoption of the Zoning Ordinance in 1.922• . •
The property is presently vacant, and the applicant proposes to con-
struct an 11 -unit apartment building with 11 private off - street parking
spaces accessory thereto. The site has a frontage of 77.5 feet on East
Seventh Street and extends to a depth of 149.26 feet, which results in
a total area of approximately 11,568 square feet.
The adjacent land uses are: north across a 20 -foot graded alley are
new single - family residences fronting on Stillwater Avenue; south across
East Seventh Street is vacant, low land; east across Hazel Street is
vacant land now used as a City dump; west and adjoining are six similar
11 -unit apartment buildings which have been built recently by the appli-
cant. The plans meet the existing standards for parking lot lay -out and
installation and density and building ground coverage. The Traffic
Engineer has approved the plans as far as traffic movements are con-
cerned. Field investigation discloses no objections.
In consideration of the above factors, the Board of Zoning recommends
that a permit be granted for the 11-car private parking lot on the above -
described property, in accordance with the final plans approved on
January 21, 1960.
