Failure to comply may result in a criminal citation or revocafion of the Fire Certificate of Occupancy. The Saint
Paul I,e�slafive Code requires that no building shall be occupied without a Fire Certificate of Occupancy. The
code also pmvides for the assessment of addifional reinspection fees.
DEFICIENCY LIST
1. SPLC 34.23, MSFC 110.1 - This occupancy is condemned as unfit for human habitafion. This
occupancy must not be used until r�inspected and approved by this office.-Restore basic facilities to
this huilding or it must be vacated.

4. Appeal of Bernard Hilliard to a Certificate of Occupancy Condemnation for property at 554
Van Buren Avenue.
Bernard Hilliard appeared with his wife, Mrs. Hilliazd. The property owner, Tom Thomas, also
appeared.
Ms. Shaff stated that Inspector Urmann inspected the property on June Z after he was contacted by
Xcel Energy that the electricity had been shut off at the property since the beginning of May. When
he went to the property, he was denied access and issued orders on June 4 that the electricity must
be turned back on or the building must be vacated by June 10.
Mr. Hilliazd stated that he had been employed seasonally and had worked for the same company for
over eight years. He explained that since he only worked seasonally, he would get behind on
paying his bills but would catch up when he was working during the wann-weather months. He had
lost his job; however, and did not have the money to pay the Xcel bill which was in the amount of
$1,400. He was looking for assistance and one agency offered him $600 in assistance. He was
working with Pro}ect Hope to see if they would fund the remainder of the bill that was owed as Xcel
would not accept partial payments on bills.
Mrs. Hilliard stated that she only worked part time due to a disability and they did not have the
money to pay all of their bills.
Mr. Thomas stated that the Hilliards were also behind in the rent and currently owed him $3,000.
He said that they were good tenants and he did not want to evict them.
Ms. Moermond expressed concem about the operation of the smoke detectors since the power had
been turned off for so long.
Mr. Thomas stated that he had owned the property far approximately 15 years and was not required
to have hardwired smoke detectors. Ms. Shaff asked when the last time the batteries had been
checked in the smoke detectors. Mr. Hilliard responded that it was probably about four years ago.
Ms. Moermond stated that the batteries in the smoke detectors must be immediately replaced by the
owner. If this was done, she would recommend granting an extension to June 30 to pay the Xcel
Energy bill and the past due rent or the property must be vacated by June 30.
