Saint Paul, in accordance with instructions from the Council, appeared with Solly Robins of the firm of Robins, Davis & Lyons, before the Judge in Chambers, of the Ramsey County District Court, the Honorable James C. Otis, for the purpose of ascertaining whether the Court would approve a minor settlement in connection with the cases of Geraldine Fincel, a minor, by her father and natural guardian, Frank A. Fincel, vs. City of St. Paul and the Board of Education of the City of St. Paul, and Frank A. Fincel vs. City of St. Paul and the Board of Education of the City of St. Paul, and WHEREAS, the Court indicated that it would approve such settlement, as is indicated in its Order, a copy of which, is attached hereto and made a part hereof by reference, and WHEREAS, Mr. Robins of the firm of Robins, Davis &' Lyons, has submitted t this Council, for filing in the District Court, Dismissals wit;rejudice of the above captioned actions, and WHEREAS, Mr. Robins has agreed on behalf of his client to furnish'to the Corporation Counsel a letter, signed by the parents of Geraldine Fincel indicating that they recognize that the settlement for the sum of $100,000 is a full, final and complete settlement of all claims involved in both lawsuits and that Geraldine's injuries, both known and unknown, are included in the settlement, and WHEREAS, Mr. Robins has also agreed to file with the Corporation Counsel of the City of Saint Paul, when the same is issued, the Order of the Court setting forth the manner and allowance of disbursements to be made, including medical, hospital and related expenses, as referred to at Paragraph 2 in the attached Order of the Honorable James C. Features of the new form were described by Mr. Simmer and Dr. Leino. Other members of the subcommittee present who commented on advantages of the new form were Mrs. Richard Hunt, Co- chairman Education Committee, PTA Council; Gerald McKay, President, Murray PTA; Malcolm Smiley, Princi- pal, Cleveland Junior High School; Claudius Wilken, teacher, Monroe High School; James Palmer, counselor, Murray High School. Both Mr. Hagstrum and Mrs. Bratnober expressed disappointment with the quartile plan. MOTION - After a lengthy discussion of the new form, Mr. Hagstrum moved that the Board accept the report of the committee and adopt the proposed pupil's progress report for secondary schools, and that the Reporting Practices Committee be retained for one year for the purpose of review and evaluation of this system. Motion seconded by Mrs. Paul. Carried. The President thanked the members of the Committee for their presen- tation and for a very fine job in this study. 14 - Consideration of Chapter 332, Special Laws of 1959 - B.F. No. 3101 The President presented the matter of the Geraldine Fincel case. He stated that the Legislature has made it possible for the City to waive defense of governmental immunity. The matter was referred to the City Council who, in turn, has referred it to the Board of Education for a recommendation. The President submitted a resolu- tion for consideration of the Board. MOTION - Mr. Hagstrum moved that the following resolution be adopted: RESOLVED, that having had the matter referred to it by the City Council, the Board of Education, after due consideration, hereby recom- mends that the Council of the City of Saint Paul approve Chapter 332, Special Laws of 1959, in the event and only in the event of a prior and effective District Court Order contingent upon such Council approval of said law, approving and authorizing a settlement whereby the total liabilities of the City and the Board of Education, respectively, shall be limited and defined as to the aggregate amount to become payable by them or either of them on account of the unfortunate accident which provoked such legislation, and that otherwise the Board of Education recommends against the approval of said law by said Council. Motion seconded by Mrs. Bratnober. III - CONANT REPORT Mr. Rock announced that today's discussion would take into consideration recommendations 5 and 6 of Dr. Conant's report: Supplement to a High School Diploma and English-Composition Robert Schanke, Assistant Principal, Mechanic Arts High School, discussed the recommendation that each graduate should be provided a wallet -size card con- taining his high school scholastic record, in addition to a diploma, which record would be readily available to employers. Mr. Schanke felt that no individual should be asked to parry this type of personal record, and further that this information would give only a partial history of school Achievements- -that it would not take into account extra- curricular activities, personal qualities, ability to get along, etc. He said that to get a true evaluation the employer should call the school coun- selor who is in a position to fill him in on all details concerning the applicant. Miss Jenny Ann Kloet, English teacher, Highland Park Junior High, discussed the recommendation that half the time devoted to the study of English should be given to English composition. She said that she felt in the development communication should be covered -- reading, organizing material, as well as writing - time devoted to these areas as background to English composition, then she would be factor. of English composition all areas of speaking, listening, spelling, and that if Dr. Conant considered to be included in the period devoted in agreement with him on the time She said that a folder is kept on each student showing samples of work; that it is passed on to the next teacher who Adde to it, and so on, thereby giving each succeeding teacher background on which to measure the pupil "s progress composition -wise.
