WHEREAS, on September 4, 1958, while in the employ of
the Department of Public Works of the City of Saint Paul, John
Lewandowski sustained an injury arising out of and in the course
of his employment, in a third party accident; that a third party
action was commenced and settled in January 1960, the City of
Saint Paul receiving an amount in settlement of its subrogation
interest for medical expenses and compensation paid on behalf of
the employee; and
WHEREAS, said employee filed with the Industrial Com-
mission of Minnesota a claim petition for temporary total dis-
ability from November 159 1959 to March 9, 1960 and permanent
partial disability amounting to 20 per cdnt of the back, the
City having paid temporary total disability compensation to
November 15, 1959 and continuing such compensation to Ncwember
18, 1960, on the basis of permanent patial disability; and
WHEREAS, a stipulation for settlement• 1' a— '`b_een arrived
at whereby the amounts paid to employee by the City from and
after March 9, 1960, will be credited toward the sum of $3150.00
to be paid employee for 20 per cent permanent partial disability
to his back, leaving a balance of $1,521.00; of said amount of
$1,521.00, the sum of $787.50, representing one - fourth the total
settlement, is to be paid to the employee's attorneys, Douglass,
Sheets & Bell; and the balance of $733.50 is to be paid in one
lump sum to the employee, John Lewandowski; that the outstanding
medical bill of Dr. Wallace P. Ritchie in the amount of $30.00
is to be paid directly by the City; said payments to be in full
and final settlement of any and all claims that the employee may
have under the workmen's compensation law of Minnesota on account
of personal injury sustained on September 4, 1958, except that
in the event the employee requires further medical care and atten-
tion to cure and relieve from said back injury, the City shall
pay the reasonable worth and value of said expense; and that
the City will pay to the Special Compensation Fund the amount
required by law, 6% of $3150.00 or $189.00; and

that the proper City officers be authorized to enter into such
stipulation and to pay the Award of the Industrial Commission
made in accordance with such Stipulation,
Now, Therefore, be it
RESOLVED, That the proper City officers are hereby
authorized to enter into such Stipulation for Settlement df the
claim of employee John Lewandowski in connection with the injury
on duty of September 4, 1958, and to pay the Award of the Industrial
Commission made in accordance with said Stipulation.
