WHEREAS, in the Matter of Comptrollers s Contract L- 6170-5
for the Installation of Ornamental Lighting System on
SHEPARD ROAD from Elm Street to Wilkin Street, COMMONWEALTH
ELECTRIC COMPANY, Contractor, the specified date of completion
is September 23, 1960, and
WHEREAS, the Contractor has prosecuted the work diligently, but
due to delay awaiting th3 completion of the Paving between said
limits on Shepard Road, it was not passible to complete the
lighting contract by said date of completion, there fore be it
RESOLVED, that the proper city officials be and they are hereby
authorized and directed to execute an amendment to said con-
tract extending the time of completion to OCTOBER 28, 1960,
provided that this Resolution shall have no force e& effect t
unless the Sureties on the Contractor's Bond consent thereto
in writing and file such consent with -the City Comptroller, and
be it
FURTHER RESOLVED, that the City of St. Paul hereby waives all
claim fcr liquidated damages and that no' engineering and in-
spection costs on this Project will be charged by the City on
account of such extended period.
