WHEREAS, Depatlment of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, duplex located on property hereinafter referred to as the
"Subject Property" and commonly lrnown as 990 REANEY AVENUE. This property is legaily
described as follows, to wit:

MIlVN. E 1/2 OF LOT 3 BLK 21
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspectaons on or before December 31, 2007,
the following are the now lrnown interested or responsible parties for the Subject Froperty:
Michelle Ann Eder, 646 Old Orchard Rd, Waconia, MN 55387; Usset, Weingarden & Liebo,
4500 Park Glen Rd, #120, St. Louis Park, MN 55416; Deutsche Bank National Trust, 482& Loop
Central Drive, Houston, TX 77081; Dayton's Bluff District 4 Community Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legisiative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated March 12, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, tYris order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by April 11, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WfIEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, May 27, 2008 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, Jnne
18, 2008 and the testimony and evidence including the acrion taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Pau1 City Council hereby adopts the following Findings and
Order concerning the 5ubject Property at 990 REA.NEY AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Properiy which deciares it to be a nuisance condition subject to demolirion.
That this building has been routinely monitared by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter AS have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Froperty
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the sh in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Pau1 shall remove and dispose of such property as provided by law.
102 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
103 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two story, wood frame duplex on a lot of 3,049 square feet.
According to our files, it has been a vacant building since January 26, 2007.
The current propefty owner is Deutsche Bank National Trust Company, pez AMANDA and
Ramsey county property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been eleven (11) SUMMARY ABATEMENT NOTICES since 2007.
There have been eleven (11) WORK ORI7ERS issued for:
- Removal of improperly stored refuse and miscellaneous debris
- Boarding
- Removal of tall grass and weeds
- Removal of snow and ice
On February 29, 2008, an inspection of the building was conducted, a list of deFiciencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCB BUILDING was posted on March 12, 2008 with a compliance date of
April 1 l, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
TaYation has placed an estimated market value of $28,200 on the land and $86,100 on the
building.
As of March 20, 2007, a Code Compliance inspection has been completed.
As of May 26, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$60,000. The
estimated cost ta Demolish. is $7,200 to $10,200.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes

The VacantlNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legisiative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On February 29, 2008, a Building Deficiency Inspecfion Report was compiled and the
following aonditions were observed.
This list of deficiencies is not necessarily all the deTiciencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection rvill identify specific defects,
necessary repairs and legal requirements to correct tt►is nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used far occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

Interior
1. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanabie throughout the
bathroom and seal around the edges and fixtures.
2. FiJRNACE: Have a licensed heating contractor service and ciean the
furnace or boiler and make any necessary repairs. Perform a C!O test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
3. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Perniit
May Be Required.
4. The interior ceilings are defective. Repair a11 ceiling defects and finish in
a professional manner.
5. The interior wa11s are defective. Repair a11 wall defects and finish in a
professional manner.
6. The interior floors are defective.
There is evidence of a rodent infestation. Immediately exterminate and
eliminate ali rodents from the entire building. Remove rodent harborages
in the yard azeas. Tuckpoint the foundarion if necessary to rodent-proof
the building to prevent re-infestation. Tmmediately remove any dead
rodents from the premises.
8. SANITATION: Immediately remove improperiy stored or accumulated
refuse including; garbage, rubbish, junk, vehicle parts, wood, metal,
recyciing materials, household items, building materials, rubble, tires, etc.,
from yard. The Saint Paul Legislarive Code requires all exterior property
areas to be maintained in a clean and sanitary condition. Usable materials
must be stored in an approved manner, so as not to constitute a nuisance.
9. 5moke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.

10. The eaves and soffits aze in a state of disrepair or deteriorarion. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Pennit may be required.fihe eaves and soffits are in a state

11. The exterior walls and/or trim of the house andlor garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
12. The foundarion is deteriorated, defective or in a state of disrepair. Repair
ali foundarion defects in a professional manner to a weather-tight,
water-fight and rodent-proof condirion. Peimit may be xequired.
13. There are missing or defective guardrails. Provide a11 stairways, porches,
decks or steps which are more than 30" high with guardrails and
intermediate raiis with openings in the guardrail no more than four (4)
inches apart and in accordance with the State Building Code.
14. The stairs have missing ar defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippabie and installed 34" to 38" above the nose of the stair
treads.
15. The exterior wa11s of the house and/or garage are defecfive. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.
16. STORM DOOR(S): The storm door(s) are in disrepair; repair or repiace
the door(s).
17. The window andior door screens are missing, defec6ve or in a state of
disrepair. Provide proper window and door screens far ali openable
windows and doors. Screens must be tight-fitting and securely fastened to
the frames.
18. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit
may be required.
As owner, agent ar responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by April 11, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, wi11 begin a substantial abatement process to
demolish and remove the building(s). The costs of ttris action, including administrative costs

and demolition costs will be assessed against the property taa�es as a special assessment i�
accordance with law.

As an owner or responsible party, you are required by law to provide fuli and complete
disclosure of this "Order to Abate" to all interested parties, all present ar subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsibie parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolirion and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken witlain the time specified in this order, the Enforcement Officer
will notify the City Council that abatement acuon is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolufion stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either arder the City to take the
abatement acrion or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legslative Code and provide that if corrective action
is not taken within the specified tnne, the Ciry shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

4. Ordering the owner to remove or repair the building(s) at 990 Reanev Avenue within fifteen
(15) days from adoption of resolution.
Christina Weber, Wilford & Geske, attomey for the property owner, Deutsche Bank National Trust
Company, appeared.
Mr. Magner stated the building was a two-story, wood fratne duplex on a lot of 3,049 square feet
and had been vacant since 7anuary 26, 2007. A code compliance inspecrion had been done on
March 20, 2007, the vacaut building registration fees were current, and the $5,000 performance
bond had not been posted. On Febivary 29, 2008, an inspection of the building was done and a list
of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance
building was posted on Mazch 12, 2008 with a compliance date of April 11, 2008. To date, the
property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County Taxation estimated the market value of the land to be approximately $28,200 and
the building to be $86,100. Reai estate taxes were current. Code Enforcement estimates the cost to
repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated
to be approximately $7,200 to $10,200. There had also been 11 suuunary abatements issued to this
property since 2007, 11 of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse and miscellaneous
debris, boarding, cut tall grass and weeds, and remove snow and ice. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that Ramsey County records
indicate that this building was built in 1900; however, the permit records indicate that the building
was built in 1891. At one point, she believed this was a good example of a Queen Anne style;
however, the front had been significantly altered and there was a major loss of integrity to the
building. It has not been surveyed and was outside the boundaries of the Dayton's Bluff historic
district.
Ms. Moermond asked how long Deutsche Bank had been in possession of the property. Mr.
Magner responded that the sheriffs sale was November 2'7, 2007.
Ms. Weber stated that they had received a bid to purchase the properiy and the bank was
considering the offer; however, they had not yet made a decision. They had also received bids to
repair the building; however, their preference was to sell the property to someone who wouid do the
rehab.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that
the building was open to access, there were numerous exterior violations and the building was
vacant. Ms. Moermond asked about the history on the work orders. Mr. Magner responded that
every time tbey inspected the propezty, it resulted in a work order. He said that there were
approxnnately three or four homes in close proximity to this property that were in the same
condition.
Ms. Weber stated that the bank was talking to an investor who was interested in purchasing several
of these properties for rehabilitation. She was requesring additional time far the bank to be able to
sell the property.

Ms. Moermond stated that she wouid let the Council make the decision given the poor history of
maintenance at the properiy. She may recommend granting tune only if the following is provided
by the end ofbusiness on June 13: 1) the property is maintained; 2) there is a purchase agreement
and ciosing documents; and 3) the bond is posted. If those conditions are not met, she will likely
recommend 15 days to remove the building.
