An ordinance amending the Zoning Code,
Chapters 60 to 64, inclusive, of the Saint Paul
Legislative Code, pertaining to Use Districts,
Height Districts and Rezoning of certain proper-
ties in the City of Saint Paul, as amended. This
is an emergency ordinance rendered necessary for
the preservation of the public peace, health,
and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the.Zoning Code, Chapters 60 to 64, inclusive,
of the Saint Paul Legislative Code,'pertaining to Use Districts, Height
Districts, .and Rezoning of certain properties in the City of Saint Paul,
as amended,, be and the same is hereby further•amended so as to rezone
the following described property from "A" Residence to '"Clu Residence, to -wit:
Lot 12 and the east 20 feet of Lot 13, Block 2,
Vilder's Addition, • according to the plat thereof
on file and of record in the office of the
Register of Deeds in and for Ramsey County,
Minnesota, being located on the south side of
Orange Avenue between Arcade and Mendota Streets;
-and so as to rezone the following described property from Commercial
District to "C" Residence, to wit:
The west 20 feet of Lot 13, and except the south

Wilder's Addition, according to the plat thereof
on file and of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota, being
located on the south side of Orange Avenue between

ordinance rendered necessary for the preservation of the public peace,

Dear Madam:
This is in the matter of the petitionof Henry Einum to reclassify property
located on the south side of, Orange Avenue between Arcade and Mendota
Streets as follows: Lot 12 and the east 20 feet of Lot 13, Block 2, Wilder's
Addition from "A" residence to "C" residence; the west 20 feet of Lot 13,
and except ,tbe soutb 45 feet, the east 26 feet._ of Lot 14, Block 2, Wilder's
Addition from commercial to "C" residence.
On August 26, 1960, the Commissioner of Finance reported the petition sufficient
with the owners of 12 of a possible 12 (100%) tracts of land within the pre-
scribed 100 foot radius having signed the petition. In 1955 an attempt was
made to reclassify Lots 14 and 15 and the west one -half of Lot 13 to a - --
light industrial district, but the petition was withdrawn by the petitioner.
In 1958 an appeal was granted by the Council to establish a building line along
Orange Avenue of 8 feet in connection with a proposed clinic building on the
same property. An appeal was also granted to extend the commercial use to
cover all of Lot 13. The clinic building was never constructed, and the
appeals therefore expired.
The land under consideration is presently vacant, and the applicant proposes
to develop it with an 11 unit, 2J story apartment building with off- street
parking accessory thereto. This is an irregularly shaped tract of land
having a frontage of 106 feet along Orange Avenue and extends to a depth of
121 feet, resulting in an area of approximately 11,656 square feet. North
and across Orange Avenue is the First Covenant Church which occupies the entire
block to the north; east and adjoining are ten single - family residences which
front along Orange Avenue; west and adjoining is an auto repair garage which
fronts on Arcade Street, also a small vacant building formerly used as a fill-
ing station; south and across a public alley are two vacant lots and single -
family residences fronting on Hawthorne Avenue, also a filling station which
fronts on Arcade Street.
The proposed development meets the recommended standards for density and
building ground coverage. Field investigation discloses that the reclassi-
fication of this property to "C" residence would be proper as it provides a
transitional use between the single - family development to the east, and the
commercial activities on Arcade Street. The Board is of the opinion that the
rezoning of this property would not be detrimental to the development of the
neighborhood.
In consideration of the above factors, the Board of Zoning recommends the
granting of the petition to rezone the above described property as stated
in the first paragraph.
